J&A No. 24-018
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Department of the Navy, Naval Facilities Engineering Systems Command (NAVFAC), Pacific, Architect-Engineer (A-E) Contracts Branch, Joint Base Pearl Harbor Hickam, Hawaii.
2. Description Of Action Being Approved.
The purpose of this Justification & Approval (J&A) is to include proprietary specifications for the following brand name item in Solicitation Work Order No. (WON) 1812861, Fiscal Year 2025 (FY25) Military Construction (MCON), Missile Defense Agency (MDA) Project 693 (P-
693) Pacific Deterrence Initiative (PDI): Guam Defense System, Command Center, Andersen Air Force Base (AAFB), Guam. The brand name description is essential to the activity’s requirements, thereby precluding consideration of a product manufactured by any other company. This J&A is to cover only the portion of the acquisition that relates to this brand-name specification.
One (1) Federal Signal Mass Notification Remote Terminal Unit UVRI-B UltraVoice®
3. Description Of Supplies/Services.
FY25 MCON, MDA P-693 PDI: Guam Defense System, Command Center, AAFB, Guam will construct a command center, power generation facility, switchgear building, fuel storage facility entry control facility, and associated equipment. The command center will include functional areas to accommodate personnel, computing equipment, user interfaces and communications needed for planning, controlling and directing mission activities. The power generation facility will provide power via the switchgear facility for the command center and associated infrastructure with the fuel from the storage facility consisting of above ground fuel tanks. The newly constructed facility will require a mass notification remote terminal unit (RTU) for communication with commercial vendor Federal Signal’s Base Control and Communication System at Joint-Region Marianas (JRM) Emergency Management Center (EMC). The project will provide one mass notification remote terminal unit (RTU) sold by commercial vendor Federal Signal. The estimated cost for one mass notification RTU is , which comprises of the total project cost of .
Fiscal year 2025 (FY25) military construction funds will be used to fund the mass notification RTU requirements when it becomes available in FY25. The mass notification RTU will be acquired by the construction contractor as part of the performance of P-693, a project which will not commence before FY25.
The contractor shall be required to commence work within 15 days after notice to proceed and complete the contract within 1,386 calendar days after the notice to proceed. The mass notification RTU will be delivered and installed within the 1,386-day construction time.
4. Statutory Authority Permitting Other Than Full And Open Competition.
The statutory authority permitting other than full and open competition is Title 10 U.S.C.
3204(a)(1) and (b)(B)(i) and (ii), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Rationale Justifying Use Of Cited Statutory Authority.
Award to another source would result in substantial duplication cost to the Government that is not expected to be recovered by competition.
The Base Emergency Communications Control at Joint-Region Marianas (JRM) Emergency Management Center (EMC) utilizes “Federal Signal” manufactured equipment for communication with individual facilities equipped with Federal Signal RTU on base. All Department of Defense (DoD) installations under Joint Region Marianas and Andersen Air Force base utilize the Federal Signal Mass Notification System. Federal Signal has the Authority to Operate (ATO) and is the approved system of record for the Navy and deployed onboard Guam Navy installations.
A Federal Signal System RTU installed for the new facility will provide the means for remote control and status monitoring for the facility mass notification system, and establish a communication link between the Base Emergency Communications Control and the facility mass notification system. The new RTU provides the communication bridge for the public safety official or anti-terrorism officer to have the ability to alert, notify and transmit emergency communications from the Base System to the new facility. The new RTU built-in radio transceiver interface will receive and respond to remote control signals from the Base System to provide warning signals and both live and recorded voice messages to the facility. In addition, the new RTU has the added flexible capability to interface self-amplified speakers and create additional notification directly from the RTU itself.
The Wide Area MNS and individual building indoor systems will be tied into the exterior portion of the system, which currently will receive transmitted signals from the Joint Region Marianas (JRM) Operations Center, and the JRM Region Dispatch Center, both located in JRM Headquarters, (Bldg ) at Nimitz Hill. JRM Operations Center currently controls all the bases, including the site in which this project is located.
As substantiated within section 6 of this document, Federal Signal is the only system that meets all the requirements for interface and operational characteristics and NAVFAC ATFP; including UFCs, Performance Specifications (PSPEC), and an approved ATO. Though other systems can obtain ATO, efforts to develop and approve an ATO are costly and time consuming. Use of an anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions To Remove Barriers To Future Competition.
This is a one-time procurement. This J&A applies to the procurement of a mass notification remote terminal unit (RTU), for design and construction of FY25 MCON, MDA P-693 PDI:
Guam Defense System, Command Center, AAFB, Guam. A market survey to ascertain the availability of new technology that may provide for other sources to meet the Government’s needs has been conducted as referenced above. Should any other offers for compatible remote interface units be submitted during the source selection process, the Government will consider each as applicable.

3. Description Of Supplies/Services:
Fiscal Year 2025 Military Construction, MDA Project 693 PDI: Guam Defense System, Command Center, Andersen Air Force Base, Guam will construct a Command Center (CC), power generation facility, switchgear building, fuel storage facility entry control facility, and associated equipment. The CC will include functional areas to accommodate personnel, computing equipment, user interfaces and communications needed for planning, controlling and directing mission activities. The power generation facility will provide power via the switchgear facility for the CC and associated infrastructure with the fuel from the storage facility consisting of above ground fuel tanks. As part of the project, three (3) Knox Box fire department access boxes and two (2) Knox Gate and Key Switches will be installed on the exterior of the building, entry control facility and vehicle access gates. The present fire department access box system employed by the Government uses Knox Box fire department access key box system, which operates only with keys furnished by the Knox Company. The Government needs to add three
(3) Knox Boxes and two (2) Knox Gate & Key Switches to store gate entry keys. The estimated cost for three Knox Boxes and two Knox Gate & Key Switches is , which comprises of the total project cost of .
This project will be funded by the U.S. Government. Fiscal Year 2025 (FY25) military construction funds will be used to fund the Knox Box and Knox Gate and Key Switch requirements. The boxes will be acquired by the construction contractor as part of the performance of MDA project 693, a project which will not commence before FY25.
The construction contractor shall be required to commence work within 15 days after the notice to proceed and complete the contract within 1,386 calendar days after the notice to proceed. The fire department access box will be delivered and installed within the 1,386-day construction time.
4. Statutory Authority Permitting Other Than Full And Open Competition:
The statutory authority permitting other than full and open competition is Title 10 U.S.C.
3204(a)(1) and (b)(B)(i) and (ii), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use Of Cited Statutory Authority:
As explained more thoroughly below, award to another source would result in increased costs to the Government that is not expected to be recovered by competition.
In accordance with the National Fire Codes®, National Fire Protection Association (NFPA) 1, when required by the authority having jurisdiction (AHJ), a fire department access box is required in an accessible location when access to or within a facility is difficult due to security.
The fire department access box and key switch allows keys unique to each facility to be stored within the access box, allowing responding fire department personnel rapid entry through electronic gates and into the building during emergency responses without forced entry or damage to the electronic gate access and the facility. The current procedure at Andersen Air Force Base is to issue Knox Box master keys to specific fire apparatus such that responding fire department personnel can override electronic gates and open any Knox Box fire department access box and retrieve keys necessary to gain entry into the facility. A mix of manufacturers equipment is not acceptable due to the necessity to issue keys to the fire department for each manufacturers access box system. The mixed use of Knox and non-Knox company products will delay fire protection capabilities upon response and therefore endanger life and property. The requirement for a Knox Box fire department access box system ensures rapid response without confusion, delay, or forced entry into the new buildings. NFPA 1 also requires the box to be of an approved type listed in accordance with Underwriters Laboratories (UL) 1037 Standard for Antitheft Alarms and Devices.
Installation of non-Knox company access boxes will have high cost and maintenance implications that will exceed the Governments minimum needs. As of March 2020, there were approximately 200 Knox Boxes installed at Andersen Air Force Base. Procuring a different type of access box will require replacement of over 200 Knox Boxes since the boxes are not interchangeable due to compatibility with the fire department master key. A UL 1037 key access-box from a competitor ( ) costs approximately . Replacement of all 200 boxes would therefore cost approximately . In comparison, the cost of purchasing three (3) Knox Box access box and two (2) Knox Gate and Key Switches would only be
. Due to the sensitive nature of the facilities on Andersen Air Force Base, issuance of keys to enter facilities is strictly controlled to meet Department of Defense security requirements.
FY25 MCON P-693 PDI: GUAM DEFENSE SYSTEM, COMMAND CENTER
JOINT REGION MARIANAS, GUAM WON 1812861
The use of master keys for all facilities may compromise the security requirements for each facility and the tracking of all master keys would be burdensome. The Knox Box fire department access box system allows facility keys to be stored in a locked, high security, tamper-proof box installed at each facility. This relieves the Fire Department of maintaining key rings with keys to every facility at Andersen Air Force Base or for the need to forcibly enter a facility upon response. Issuance of the Knox Box access keys are only to specific fire department apparatus with the Fire Chief ultimately accountable for the security of these access keys. This ensures security is maintained without compromise to emergency response.
6. Description Of Efforts Made To Solicit Offers From As Many Offerors As Practicable:
On 19 April 2024, an announcement was published on the System for Award Management (SAM) website, in accordance with DFARS 206.302-1 to identify other potential responsible sources of supply that can provide a fire department access box and gate and key switch with equal performance and listing/approval requirements compatible to the Knox Box and Knox Gate and Key Switch. The announcement closed on 3 May 2024 with no responses received.
Although there are similar fire department access boxes in the market like the that we can gather comparable pricing information, there are currently no known manufacturers other than Knox Company who provides an emergency gate and key switch to override electronic gates. As such, it can be interpreted that there are currently no other responsible sources of supply, other than Knox Box and Knox Gate and Key Switch, that can meet the Governments requirements for Fiscal Year 2025 Military Construction, Missile Defense Agency (MDA) Project 693 PDI: Guam Defense System, Command Center (Inc), Andersen Air Force Base, Guam. Therefore, the Knox Box and Knox Gate and Key Switch is the only fire department access box and gate and key switch that meets the Governments requirements.
7. Determination Of Fair And Reasonable Cost:
Paragraph 5 explains the cost savings comparisons with installing the current infrastructure of the Knox Box fire department access boxes instead of replacing the current infrastructure of Knox Box fire department boxes with a competing brand of fire department access boxes.
Therefore, the Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
8. Actions To Remove Barriers To Future Competition:
This is a one-time procurement. This J&A applies to the design and construction of Fiscal Year 2025 Military Construction, Missile Defense Agency (MDA) Project 693 PDI: Guam Defense System, Command Center (Inc), Andersen Air Force Base, Guam; for which a market survey to ascertain the availability of new technology that may provide for other sources to meet the Governments needs has been conducted, as referenced above. FY25 MCON P-693 PDI: GUAM DEFENSE SYSTEM, COMMAND CENTER
As explained more fully below, award to another source would result in increased costs to the Government that is not expected to be recovered by competition.
The existing radio fire alarm system at the AAFB Building 20010 is a Monaco D-21 radio fire alarm system comprised of one Monaco radio fire alarm receiver. A Monaco D- 500 radio fire alarm system serves as a back up to the Monaco D-21 radio fire alarm system. Approximately Monaco transmitters are currently on line with the radio fire alarm receiver.
Specification Section 28 31 63.00 20, Analog/Addressable Interior Fire Alarm System, paragraph 1.6.1 requires the devices and equipment for fire alarm service to be listed by Underwriters’ Laboratories (UL), or approved by Factory Mutual (FM) Global. The purpose of the UL listing or FM Global approval requirements is to ensure quality, suitability, and reliability of the equipment. The UL listing states that either the equipment or material meet appropriate standards or has been tested and found suitable for use in a specified manner. New manufacturers of fire alarm systems require a minimum of two years to be UL listed and offer no assurance that their transmitters will be compatible with a Monaco receiver. FM Global approval is based on testing a complete fire alarm system, which includes a fire alarm receiver and transmitter. A fire alarm system of mixed manufacturer’s equipment is unacceptable because no mixed system has been approved to date. Only Monaco fire alarm components in a Monaco fire alarm system are FM approved and therefore, Monaco transmitters are required to operate with a Monaco receiver. The possibility of using non-Monaco transmitters with a Monaco receiver may diminish fire protection capabilities, and therefore, endanger life and property. The requirement for a Monaco radio fire alarm transmitter ensures reliable, FM Global approved fire alarm protection for the new building.
Installation of a non-Monaco radio fire alarm transmitter will result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency’s requirements. If a non- Monaco radio fire alarm transmitter was procured for this project, Joint Region Marianas Emergency Management Center and AAFB would need to procure a new non-Monaco emergency management center console, non-Monaco receiver and infrastructure. These new non-Monaco fire alarm components and infrastructure would cost approximately which is more than times the cost of procuring a Monaco transmitter for the new Command Center. This does not include the cost and time to include relocation of existing equipment, upgrade of existing supporting utilities, obtaining Authority to Operate and training of personnel on the non-Monaco system, which would be required
FY25 MCON P-693 PDI: GUAM DEFENSE SYSTEM, COMMAND CENTER
to accommodate the new non-Monaco radio fire alarm receiver. Federal Fire Department (FFD) dispatchers are the operators of the Monaco receivers. The dispatchers are required to perform two years of on-the-job training to be fully qualified, and current dispatchers have only been trained to use Monaco receivers. A fully qualified operator on a non- Monaco transmitter and receiver will not be possible at the time of installation. AAFB Alarm Shop maintenance workers are factory trained to maintain and repair existing Monaco transmitters and receivers. Trained Alarm Shop workers would not be available to maintain a non-Monaco transmitter at the time of installation. Having to re-train FFD dispatchers and Alarm Shop workers to use and maintain non-Monaco transmitters would result in unacceptable delays. Installation of a non-Monaco transmitter would also result in two different fire alarm receivers being used simultaneously at AAFB. This may endanger life and property and is an unacceptable risk. In summary, a non-Monaco radio fire alarm system will have cost, operator training, cybersecurity and maintenance implications that outweighs intended benefits.
6. Description Of Efforts Made To Solicit Offers From As Many Offerors As Possible.
On 1 March 2024, an announcement was published on the System for Award Management (SAM) website, in accordance with DFARS 206.302-1 to identify other potential responsible sources of supply that can provide fire alarm transmitters with equal performance and listing/approval requirements compatible to the Monaco Radio Fire Alarm Transmitter. The announcement closed on 15 March 2024, and no responses were received. Although there are similar fire alarm transmitters in the market, the cost to obtain non Monaco brand transmitters would not be advantageous to the Government, as identified in paragraph 5 above. Therefore, there are currently no other responsible sources of supply, other than Monaco, that can meet the Government’s requirements for Fiscal Year 2025 Military Construction, MDA Project 693 PDI:
Guam Defense System, Command Center, AAFB, Guam. Therefore, the Monaco Radio Fire Alarm Transmitter and antenna is the only fire alarm transmitter that meets the Government’s requirements.
7. Determination Of Fair And Reasonable Cost.
As stated in Paragraph 5, the new non-Monaco fire alarm components and infrastructure would cost approximately which is more than times the cost of procuring a Monaco transmitter for the new Command Center. This does not include the cost and time to include relocation of existing equipment, upgrade of existing supporting utilities, getting Authority to Operation and training of personnel on the non-Monaco system, which would be required to accommodate the new non-Monaco radio fire alarm receiver. Therefore, the Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions To Remove Barriers To Future Competition.
This is a one-time procurement. This J&A applies to the design and construction of Fiscal Year 2025 Military Construction, MDA P-693 PDI: Guam Defense System, Command Center, AAFB, Guam; for which a market survey to ascertain the availability of new technology that may provide for other sources to meet the Government’s needs has been conducted as referenced above.
