About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition in federal contracting.
Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) seeks authorization to use brand name specifications for stormwater management equipment manufactured by Contech Engineered Solutions in solicitation N4008526R0004, a Design Bid Build project for the Weapons Magazine & Ordnance Operations Facility at Naval Submarine Base, New London, Connecticut. The required products include three Underground Stormwater Quality (SWQ) Chambers, one Underground Detention Chamber, three Diversion Manholes, and three Hydrodynamic Separators. The broader construction project encompasses six Containerized Long Weapons Storage (CLWS) units, two Box C and one Box D earth-covered high-explosive magazines with overhead cranes, a new Ordnance Operations building, Truck Inspection and Sentry buildings, and demolition of 18 existing magazines and two buildings. The estimated total project value is redacted, with a portion designated for the brand name stormwater supplies. Work must be completed within 1,587 days after contract award and will be funded by FY24, FY26, and FY27 Military Construction, Navy (MCON) funds.
The justification cites statutory authority under 10 U.S.C. 3204(a)(1) for limited supplier use, based on the requirement that these specific Contech products are necessary to meet Connecticut Department of Environmental Protection (DEEP) stormwater management regulatory requirements within the site's space constraints. A sources sought notice was published on Sam.gov on October 1, 2025, with a response deadline of October 8, 2025, which resulted in no responses. The Contracting Officer will determine fair and reasonable pricing using techniques including RFP price comparisons, Independent Government Cost Estimates, historical data, and market surveys. The acquisition will be solicited as an unrestricted full and open construction solicitation as authorized by an approved DD2579 dated November 21, 2025.
