1.0 MISSION OBJECTIVE.

The Department of Defense (DoD) CNTPO is currently being managed by CN&GT Division was established to create worldwide Counter Narcotics (CN) Technology networks, infrastructures, and capabilities that are focused on the detection, identification, and disruption of narcotics activities and organizations. This task effort will support the War Fighter in combating narcotics activities globally.

2.0 SCOPE.

2.1 Objective.

This task order (T/O) objective is to procure various general equipment items for multiple agencies supporting ongoing CN training and operational efforts in the Republic of Tajikistan.

2.2 Basic Contract References.

This T/O Performance Work Statement (PWS) establishes the requirements for the contractor to provide support in the basic contract task area(s) of 4.3.2.7 Logistics Support and Equipment; and 4.3.3.20 Material and Equipment Purchase.

3.0 PERFORMANCE REQUIREMENTS.

3.1 Base Requirement: General CN Equipment.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of the equipment items listed in Appendix B to the Tajikistan Border Guard (BG) and the Tajikistan National Guard (NG) in support of the Tajikistan CN mission. The contractor shall propose to deliver the brand name equipment listed in Appendix B or an equivalent item meeting the salient characteristics captured in the appendix. All items listed in Appendix B shall be delivered in accordance with (IAW) the general delivery details in paragraph Para 3.15. Points of contact (POC) for coordination of delivery for this equipment are listed in paragraph Para 3.15.7. The contractor shall deliver the identified equipment to the corresponding agency/location in paragraph Para 3.15.8.

3.2 Option A – General CN Equipment.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of the equipment items listed in Appendix C to the BG, the NG, the Ministry of Interior OMON (MOI), and the Drug Control Agency (DCA). The contractor shall propose to deliver the brand name equipment listed in Appendix C or an equivalent item meeting the salient characteristics captured in the appendix. All items listed in Appendix C shall be delivered IAW the general delivery details in paragraph 3.15. Points of contact (POC) for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the corresponding agency/location in paragraph 3.15.8.

3.3 Option B – General CN Equipment.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of the equipment items listed in Appendix D to the BG, the NG, the MOI, and the DCA. The contractor shall propose to deliver the brand name equipment listed in Appendix D or an equivalent item meeting the salient characteristics captured in the appendix. All items listed in Appendix D shall be delivered IAW the general delivery details in paragraph 3.15. Points of contact (POC) for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the corresponding agency/location in paragraph 3.15.8.

3.4 Option C – General CN Equipment.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of the equipment items listed in Appendix E to the BG, the NG, the MOI, and the DCA. The contractor shall propose to deliver the Brand Name equipment listed in Appendix E or an equivalent item meeting the salient characteristics captured in the appendix. All items listed in Appendix E shall be IAW the general delivery details in paragraph 3.15. Points of contact (POC) for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the corresponding agency/location in paragraph 3.15.8.

3.5 Option D – SMARTDEC Detector System.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of all brand name equipment listed in Appendix F, Option D and per the requirements in paragraph 3.5.1 thru 3.5.4. All items listed shall be delivered in accordance with (IAW) the general delivery details in paragraph 3.15. POC for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the Tajikistan Border Guard location IAW paragraph 3.15.8.

3.5.1 Brand Name Information.

3.5.1.1 The contractor shall deliver a fully functional SMARTDEC Detector (Sensor System) by DEFENDEC LTD that can be integrated with the current Tajikistan Government Smartdec System and Harris Radio® communication system. The Harris Radio communication system is already installed and shall be available to test the sensor system. All technical information required for integration and communication requirements of the Smartdec System will be provided by the United States Government (USG) for interoperability prior to awarding this option.

3.5.1.2 The SMARTDEC system shall be fully functional and deployable upon delivery. The system shall perform and independently/autonomously collect data on event detection(s) of activities in border areas. This activities shall include, time, location, and automatic visual identification of the nature of activity, independent of light conditions.

3.5.2 Communication Requirements.

3.5.2.1 The procured SMARTDEC system sensors shall enable communication to current Tajikistan Harris® radio equipment (control, detection, data transfer, alarms, etc.) using 869MHz communication channels.

3.5.2.2 The system shall be wireless. Wired/cabled communication shall not be allowed.

3.5.2.3 The system shall be capable of retransmission from one communication system to another for up to 5km range.

3.5.2.4 The system shall communicate using the following communication channels:

· Bandwidth: 250 kilohertz;

· Frequency range: 863.000 - 869.000 MHz;

· Effective Isotropic Radiated Power: 40 decibel-milliwatts;

· Modulation: 2-Frequency Shift Keying;

· Data Rate: Up to 200 kilobits per second; and,

· End-to-end encryption and authentication of application messages using AES-128 (Advanced Encryption Standard), equivalent or better. Device keys must be established using public key mechanisms using the public key cryptography algorithm 1024-bit cryptosystem (RSA), equivalent or better.

3.5.3 Physical Characteristics.

The devices shall be camouflaged in a manner that fits the environment of the locations stated in Appendix F.

3.5.4 Language.

The user interface of the system shall be in Russian and English.

3.6 Option E – SMARTDEC Detector System.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of all brand name equipment listed in Appendix F, Option E and per the requirements in paragraph 3.5.1 thru 3.5.4. All items listed shall be delivered in accordance with (IAW) the general delivery details in paragraph 3.15. POC for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the Tajikistan Border Guard location IAW paragraph 3.15.8.

3.7 Option F – SMARTDEC Detector System.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of all brand name equipment listed in Appendix F, Option F and per the requirements in paragraph 3.5.1 thru 3.5.4. All items listed shall be delivered in accordance with (IAW) the general delivery details in paragraph 3.15. POC for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the Tajikistan Border Guard location IAW paragraph 3.15.8.

3.8 Option G – SMARTDEC Detector System.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of all brand name equipment listed in Appendix F, Option G and per the requirements in paragraph 3.5.1 thru 3.5.4. All items listed shall be delivered in accordance with (IAW) the general delivery details in paragraph 3.15. POC for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the Tajikistan Border Guard location IAW paragraph 3.15.8.

3.9 Option H – SMARTDEC Detector System.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of all brand name equipment listed in Appendix F, Option H and per the requirements in paragraph 3.5.1 thru 3.5.4. All items listed shall be delivered in accordance with (IAW) the general delivery details in paragraph 3.15. POC for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the Tajikistan Border Guard location IAW paragraph 3.15.8.

3.10 Option I – SMARTDEC Detector System.

The contractor shall procure, deliver and ensure receipt and turn-over acceptance of all brand name equipment listed in Appendix F, Option I and per the requirements in paragraph 3.5.1 thru 3.5.4. All items listed shall be delivered in accordance with (IAW) the general delivery details in paragraph 3.15. POC for coordination of delivery for this equipment are listed in paragraph 3.15.7. The contractor shall deliver the identified equipment to the Tajikistan Border Guard location IAW paragraph 3.15.8.

3.11 Option J – SMARTDEC Original Equipment Manufacturer (OEM) Led Training.

The contractor shall provide one (1) three-day training class for up to 20 students. The class shall be a minimum of eight (8) hours per day and include a combination of classroom and field based training by no less then (2) instructors. The location of the training shall be at one of the sites located in Appendix F. Actual locations will be provided at the kick-off meeting. Training cost will be funded on a cost-reimbursable basis.

3.11.1 The contractor shall conduct and document training classes to operationally certify students from the Tajikistan Border Guard. For the purpose of the proposal, the contractor shall assume there will be five (5) or more working days between classes. Copies of training materials (slides and handouts) shall be provided in English for review and approval by the USG IAW paragraph 10.8.

3.11.2 On-site training materials shall be provided in Russian and delivered in hard copy form for each of the participants, and at least one (each) Russian and English Microsoft Office compatible CD ROM shall be provided at the end of the class for future reference.

3.11.3 Upon completion of training, the contractor shall issue a training certificate to each attendee stating that they received the basic operator and maintenance, training IAW paragraph 10.9.

3.12 Option K – SMARTDEC Original Equipment Manufacturer (OEM) Led Training.

The contractor shall provide one (1) three-day training class for up to 20 students as outlined in paragraphs 3.11.1 thru 3.11.3. The class shall be a minimum of eight (8) hours per day and include a combination of classroom and field based training by no less then (2) instructors. The location of the training shall be at one of the sites located in Appendix F. Actual locations will be provided at the kick-off meeting. Training cost will be funded on a cost-reimbursable basis.

3.13 Option L – SMARTDEC Original Equipment Manufacturer (OEM) Led Training.

The contractor shall provide one (1) three-day training class for up to 20 students as outlined in paragraphs 3.11.1 thru 3.11.3. The class shall be a minimum of eight (8) hours per day and include a combination of classroom and field based training by no less then (2) instructors. The location of the training shall be at one of the sites located in Appendix F. Actual locations will be provided at the kick-off meeting. Training cost will be funded on a cost-reimbursable basis.

3.14 Option M – SMARTDEC Original Equipment Manufacturer (OEM) Led Training.

The contractor shall provide one (1) three-day training class for up to 20 students as outlined in paragraphs 3.11.1 thru 3.11.3. The class shall be a minimum of eight (8) hours per day and include a combination of classroom and field based training by no less then (2) instructors. The location of the training shall be at one of the sites located in Appendix F. Actual locations will be provided at the kick-off meeting. Training cost will be funded on a cost-reimbursable basis.

3.15 General Delivery.

3.15.1 All items as described and specified within each appendix shall be delivered in a single shipment to the respective delivery location unless the contractor can demonstrate significant value to the USG for a multiple delivery approach. Partial shipments of ordered items are not authorized unless preapproved by the Contracting Officer (KO). Any change to the POD address shall be approved by the KO via a modification to the T/O.

3.15.2 Final delivery of equipment and material shall be Free on Board destination. All equipment and material shall clear customs prior to delivery. Use of an in-country broker is highly encouraged to aide in proper customs clearance and delivery.

3.15.3 The contractor shall procure, deliver and ensure receipt and turn-over acceptance of all equipment and materials required by this T/O no later than 365 days after T/O award.

3.15.4 Option D thru Option I Requirements by Location. The contractor shall prepare one shipment containing segregated packages for each location as required in Appendix F to be delivered to the BG POD location highlighted in paragraph 3.6.8.

3.15.5 Brand Name. When brand name equipment or material is identified, equivalent items are not acceptable due to the need for seamless interoperability with other equipment in use. In all other cases, equivalent items are acceptable as long as they meet form, fit and function equal to salient characteristics associated with the item (supporting documentation must be submitted with preapproval by the KO.

3.15.6 Warranty Information. The contractor shall ensure all electronic items are provided with standard OEM warranties as stated in Paragraph 10.2.

3.15.7 Points of Contact. The following personnel are points of contact POC for delivery coordination:

3.15.9 Life Support during Delivery. The contractor shall be responsible for its own life support services (lodging and air/ground transportation) while in country for delivery, subject to the terms and conditions of this contract

3.15.10 Diplomatic Notice (DIP Note). To coordinate with Tajikistan agencies, the CN PM/Program Advisor must deliver the coordination in a DIP Note. The process requires 30 days. For instruction on the process see paragraph 10.7.

4.0 WORK HOURS AND LOCATION.

The principal places of performance shall be at the contractor’s discretion for successful performance and delivery to the Republic of Tajikistan. Training will be conducted at various sites to be identified at the kick-off meeting. The Contractor will not be required to provide labor hours in excess of 40 hours per work week.

5.0 OTHER PERFORMANCE REQUIREMENTS.

5.1 Defense Base Act (DBA) Insurance. The contractor shall provide DBA insurance for all personnel performing duties outside the continental United States (OCONUS).

5.2 Medical Evacuation Insurance. All personnel performing duties in Tajikistan shall be included in and insured with a policy covering medical and/or emergency evacuation from Tajikistan. Proof of Medical Evacuation insurance is required for all personnel performing work in Tajikistan. As of 8 July 2013, Embassy policy MI 13-06 requires all TDY personnel to provide proof of $150,000 of MEDEVAC insurance prior to travel approval (relevant excerpt is attached). This is based on the historical cost of urgent MEDEVAC from Dushanbe (typically by International SOS). This policy has been vetted by Department of State and DOD, and is clearly outlined (with a link to the Post Policy) in the Foreign Clearance Guide -- Section III, Para A-1 (Country Clearance Requirements) for Tajikistan.

5.3 Taxes, Fees, Agreements.

5.8.1 Value Added Tax (VAT), Customs, Duties. The contractor shall be responsible for all associated taxes (e.g. Value Added Tax (VAT)), duties and customs fees, and other related charges for Tajikistan (if waiver or exemption is no longer available). Historically Tajikistan has had very high (est. 18%) customs fees and taxes for the importation and delivery of material that is not accepted as locally or regionally produced. At this time, waivers or exemptions are available to preclude the payment of the VAT tax, customs fees, duties and other related charges. The Counter Narcotics office works closely with the Tajikistan Government to sign agreements to waive these fees. The contractor shall first attempt to obtain a waiver or exemption before exploring any other avenues to satisfy this requirement. The USG is available for coordination and assistance during the waiver or exemption process as needed. Waivers or exemptions shall be documented prior to shipment. If a waiver is granted the contractor shall propose reasonable consideration to the KO for the waiver of awarded customs fees and VAT costs.

5.8.2 Arms Export Control Act and International Traffic in Arms Regulations (ITAR).

5.8.2.1 The contractor shall also be responsible for all aspects of export compliance, including compliance with the Arms Export Control Act and ITAR. Designated ITAR controlled articles shall be controlled by the Contractor and marked at the vendor level and shipped to POD with all documentation ready for USG review.

5.8.2.2 Night Vision Goggles (NVG) ITAR Compliance. The contractor shall ensure that NVGs are compliant with the minimum salient characteristics and fully ITAR compliant and exportable with minimum USG assistance. The contractor shall be responsible for the verification of the Figure of Merit (FOM) of the NVGs listed in the requirements by way of 100% inspection. The contractor shall provide to the PM and or the COR the verification of the 100% inspection for ITAR compliance prior to shipment to the POD. These documents shall be provided five (5) business days prior to final delivery unless otherwise directed by the KO. All commercially provided OEM material shall be accompanied by items quality documentation for review purposes at time of final inspection as requested by CN&GT.

5.8.3 Technical Assistance Agreements (TAA). The contractor shall ensure the appropriate Technical Assistance Agreements (TAAs) and applicable export licenses are in place before conducting any activity under this task order that requires such approval and documentation.

5.9 Equipment.

5.9.1 All equipment and materials shall be new (current year model) and of good quality and durability according to commercially accepted quality standards for similar products. All electrical components shall be able to be fully functional using 220 volt (V)/50 Hertz (Hz) power system.

5.10 Kick-off Meeting. The contractor shall participate in a kick-off meeting to be coordinated by the USG after contract award.

5.11 Human Rights Vetting. Before any services are provided to foreign counterdrug personnel, the contractor shall ensure that any personnel who will or may interact with USG personnel as follows:

5.11.1 Personnel shall be vetted for human rights violations through the Department of State (DoS) IAW the Leahy Vetting Process;

5.11.2 Documentation shall be maintained by the contractor and made available to the USG upon request.

6.0 TEMPORARY DUTY TRAVEL (TDY).

The contractor shall coordinate all travel with PM/COR per CN&GT procedures. Only travel pre-approved by the PM/COR will be reimbursed under this T/O. See Appendix H. All travel required and approved under this T/O will be paid IAW the Basic Contract by reimbursement to the contractor. The contractor shall ensure that all OCONUS travelers have a country approval to enter the country for this mission as well as a Letter of Authorization (LOA) approved by the KO prior to travel. Only required travel approved by the KO/COR/PM will be reimbursed under this T/O.

7.0 GOVERNMENT FURNISHED EQUIPMENT, MATERIAL OR SERVICES (GFE/GFM/GFS).

The Government will not provide equipment, information, material or services in support of this effort.

8.0 SECURITY.

All work performed under this T/O shall be Unclassified.

9.0 T/O CONTRACT DATA REQUIREMENTS LIST (CDRL).

3. Unless specified otherwise, calendar days will be used.

9.1 Contractor’s Progress, Status and Management Report (CDRL A002). The contractor shall provide a monthly report summarizing all tasks performed, projected tasks scheduled (to include procurement and delivery) and any issues encountered. The report shall, at a minimum, contain an overall schedule, the current status of funding on the T/O, accomplishments completed, any potential problems, and any lessons learned. These reports shall be delivered IAW CDRL A002 Expenditure Report of the basic contract and Data Item Description DI-MGMT-80227.

9.2 Licenses, Export Agreements & Certifications. (CDRL A00H). The contractor shall provide licenses, export agreements and certifications in response to the TORP. These documents shall be provided prior to final delivery unless otherwise directed by the KO. At a minimum, the licenses, export agreements and certifications shall include the following:

· Cover letter describing purpose or submission, POC, contract/TORP number; description of each attachment/enclosure; Original Documents(s) Nomenclature (if revision);

· Attachment should be originals or certified originals and be dated, signed by cognizant authority, and indicate specific agreement terms;

· English translation of foreign language documents is required; and,

· Russian (as specified in PWS).

10.1 T/O Quality Control Plan (QCP) (CDRL A00G). The contractor shall provide a draft T/O QCP with their response to the TORP. The final plan delivery as stated in the above table. At a minimum, the T/O QCP shall address the following:

· Quality Control (QC) Execution: The plan shall not be cursory, but discuss specifically how the prime contractor shall execute its QC responsibilities with respect to this T/O. The T/O QCP shall include a clearly defined QC process, key performance indicators, QC schedules, and QC personnel (by name), to include those that shall be performing sub-contractor oversight and oversight of activities in-theater. The plan shall address how QC trend analysis and tracking of corrective actions shall be accomplished. The T/O QCP shall discuss the prime contractor’s management activity that shall provide oversight and involvement in the QC process. QC personnel should not be buried in the organization, but should have a direct line to upper management.

· Reporting: Monthly status reports shall specifically discuss QC activities over the reporting period and planned activities for the next period. Information shall specifically address WHO conducted the QC, WHEN was the QC executed, HOW was the QC executed and WHAT the findings and corrective actions were. Trends over time shall be identified and discussed thoroughly.

· Invoice Quality Control and Review: The contractor shall discuss how invoice reviews shall be conducted, to include discussion on how the prime contractor, sub-contractor, and supporting data will be reviewed for consistency with T/O requirements and the contractor’s approach to execute the T/O.

10.2 Warranty Plans (CDRL A00G). The contractor shall provide a Warranty Plan (IAW paragraph 3.6.6) for each delivery to each End User (EU) and as stated below:

· All items normally provided with a warranty shall be provided with standard OEM warranties. The terms of the warranties shall be clearly presented in the name of EU. The effective start date of the warranty shall coincide with date of acceptance of the equipment and materials by the USG.

· As prescribed in FAR 12.404, the contractor agrees that the supplies or services furnished under this contract shall be covered by the most favorable commercial warranties the contractor gives to any customer for such supplies or services and that the rights and remedies provided herein are in addition to and do not limit any rights afforded to the Government by any other clause of this contract;

· All utilization of commercially available OEM warranties associated with the equipment shall be the responsibility of the EU upon receipt of the material from the USG;

· All Warranty Plans shall be in Russian, English, and the OEM’s language for clarity;

· Warranty Plan shall contain (as a minimum):

· OEM POC’S;

· List of items by OEM with part numbers, registration/serial numbers, and their warranty terms (i.e., length of warranty, start date, type (limited, extended, standard);

· Instructions for product registration with each OEM;

· Requirements to keep the warranty valid; and,

· How to execute a warrant call.

10.3 OEM Use and Maintenance Manuals. The contractor shall provide OEM use and maintenance manuals for all equipment when available. Manuals shall be delivered in the Russian language.

10.4 Inventory Listings (CDRL A00E). The contractor shall provide an inventory listing, per example sheet in Appendix G, to PM/COR for each delivery. The inventory sheet shall contain detailed item descriptions, quantities, model numbers, serial numbers, and costs in Tajikistan currency per item and by total cost per item. These documents shall be provided in both Russian and English.

10.5 Quality Inspection Sheets (CDRL A00E). All commercially procured OEM items shall be accompanied by quality documentation, in English, for review by the PM/COR prior to final inspection.

10.6 Technical Interchange Meetings (CDRL A003). The contractor shall plan to participate in technical interchange meetings, to be scheduled upon request of the responsible Contracting Officer or written designee, to discuss and to informally evaluate the contractor’s efforts and accomplishments in direct relation to specific T/O requirements. During the meetings, the contractor shall present necessary data to enable a joint review of its various assigned tasks, attendant schedules, and resource expenditures. The contractor shall attend and participate in technical discussions and shall inform, in a timely fashion, the COR and PM, as applicable, of any problems with contract execution and any proposed solutions. The contractor shall attend and participate in other meetings, as scheduled by the responsible KO or written designee. Unless noted elsewhere, all meetings will be scheduled as teleconferences normally not to exceed one hour. For planning purposes, the contractor shall plan to participate in teleconferences on a monthly basis until all requirements have been satisfied. The frequency shall be adjusted based on the current status and issues of this requirement.

10.7DIP Note. The contractor shall provide delivery coordination notices (IAW paragraph 3.6.9), for each delivery if not available as one notice, to the PM/COR to be used to execute a DIP note for the Republic of Kazakhstan. All official coordination must be executed with a DIP Note in the timeline listed in the above table.
10.8Training Plan (CDRL A00G). The contractor shall provide an initial training schedule and Programs of Instruction (POI) (IAW paragraph 3.11) within the timeline established in table 2 above. Training materials shall be provided to the PM/COR in English for review and approval. Final training schedule and materials shall be provided within timeline established in table above. Electronic copies of training materials shall be in Russian for instruction and provided to the EU upon delivery.

10.9 Training Progress Report (CDRL A00E). The contractor shall provide a training progress report (IAW paragraph 3.5.5.4) at the completion of a training class. The contractor shall provide proof of qualified certification for all trainees. Records indicating the successful completion of the training shall be provided to the COR and at a minimum shall include:

· Location where training was provided;

· Dates training was provided;

· Names of personnel trained;

· Number of personnel who successfully completed the training; and,

· Certificate provided to personnel and their management upon successful completion.
