About this file
This is a Non-Disclosure of Proprietary Information Agreement template for GSA Solicitation No. 47PB5126R0008, executed between a GSA-retained consultant serving as a non-voting technical advisor to the source selection board and a bidder/offeror. The agreement authorizes the consultant and its employees to access offerors' proprietary information solely to the extent necessary to advise GSA on the solicitation. The consultant is expressly prohibited from competing on the acquisition if the solicitation relates to a construction acquisition, consistent with FAR Part 9.505-4(b) conflict-of-interest requirements.
Under the agreement's key terms, the consultant acknowledges that: (1) GSA may share proprietary information contained in proposals with the consultant; (2) the consultant will protect such information from unauthorized use or disclosure for as long as it remains proprietary; and (3) the consultant will refrain from using proprietary information for any purpose other than that for which it was furnished. The associated solicitation is for Design-Bid-Build (DBB) construction services at the Alburg Springs Land Port of Entry in Alburg, Vermont, involving repair and alteration work and a driveway extension project, with a pre-proposal conference scheduled for May 6, 2026.
