About this file

Summary

This is a Federally-Funded Projects Procurement Compliance Package Checklist and supporting documentation issued by Allegheny County Economic Development for CDBG-funded projects. The document establishes mandatory procurement requirements and compliance procedures that all prime contractors, subcontractors, and suppliers must follow when bidding on and executing federally-funded construction and professional services projects. The checklist requires submission of multiple forms including Notice to Prime Contractors/Subcontractors, Award Verification forms (PL3/PL4 for contractors and PL5 for suppliers/professional services receiving $1,000 or more), Schedule of Subcontractors, Fringe Benefit Letters, certified weekly payrolls, construction stoppage statements when applicable, and Section 3 compliance documentation for projects exceeding $200,000 in federal assistance. All subcontractor documentation must be submitted within ten days of contract award, with final schedules of subcontractors required upon project completion. The prime contractor bears responsibility for collecting and forwarding all subcontractor documentation to the Agency and Project Manager for approval before payment requests are processed.

All contractors and subcontractors must comply with Davis-Bacon prevailing wage requirements, federal labor standards, and equal employment opportunity provisions including Title VI of the Civil Rights Act, Section 504 of the Rehabilitation Act, and the Americans with Disabilities Act. Weekly certified payrolls must be submitted within seven days of each pay period with legally valid electronic signatures and dated timestamps; contractors must maintain all project records for three years following completion. Fringe benefits must be paid either as part of the basic hourly wage or into approved benefit plans at rates specified in applicable wage decisions. The documentation package includes mandatory federal posters regarding worker rights under the Davis-Bacon Act, OSHA job safety and health protections, and Equal Employment Opportunity requirements, which must be displayed prominently at project work sites. Projects receiving federal assistance exceeding $200,000 are subject to Section 3 requirements mandating utilization of lower-income residents for employment and training opportunities and Section 3 business concerns to the greatest extent feasible.

While use of Form WH-347 itself is op. onal, covered contractors and subcontractors performing work on Federal or federally assisted construc on contracts are required by the DBRA regula ons and the contract clauses to submit payroll informa on on a weekly basis. The Copeland Act (40 U.S.C. § 3145) requires contractors and subcontractors performing work on Federal or federally financed construc on contracts to, on a weekly basis, “furnish a statement on the wages paid each employee during the prior week.” U.S. Department of Labor (DOL) Regula ons at 29 C.F.R. § 5.5(a)(3)(ii) require contractors and subcontractors to submit weekly cer fied payrolls to the appropriate Federal agency if the agency is a party to the contract (or, if the agency is not such a party, to the applicant, sponsor, owner, or other en ty, as the case may be, that maintains such records, for transmission to the Federal agency). Each cer fied payroll must be accompanied by a signed “Statement of Compliance” (e.g., page 2 of the WH-347 or another document with iden cal wording) indica ng that the cer fied payrolls are accurate and complete, and that each laborer or mechanic has been paid not less than the required Davis-Bacon prevailing wage rate(s) (including any fringe benefits) for the work performed. DOL and contrac ng agencies receiving this informa on review the informa on to determine whether workers have received legally required wages and fringe benefits.

Public Burden Statement We esti ate that it will take an average of 55 minutes to complete this collecti n, including me for reviewing instructi ns, searching exis ng data sources, gathering and maintaining the data needed, and comple ng and reviewing the collec on of informa on. If you have any comments regarding these es mates or any other aspect of this collec on, including sugges ons for reducing this burden, send them to the Administrator, Wage and Hour Division, U.S. Department of Labor, Room S3502, 200 Cons tu on Avenue, N.W. Washington, D.C. 20210 (over)

OVERTIME You must be paid not less than one and one-half times your basic rate of pay for all hours worked over 40 in a work week. There are few exceptions.

Equal Employment Opportunity is

THE LAW

Private Employers, State and Local Governments, Educational Institutions, Employment Agencies and Labor Organizations

Applicants to and employees of most private employers, state and local governments, educational institutions, employment agencies and labor organizations are protected under Federal law from discrimination on the following bases:

RACE, COLOR, RELIGION, SEX, NATIONAL ORIGIN

Title VII of the Civil Rights Act of 1964, as amended, protects applicants and employees from discrimination in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment, on the basis of race, color, religion, sex (including pregnancy), or national origin. Religious discrimination includes failing to reasonably accommodate an employee’s religious practices where the accommodation does not impose undue hardship.

DISABILITY

Title I and Title V of the Americans with Disabilities Act of 1990, as amended, protect qualified individuals from discrimination on the basis of disability in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. Disability discrimination includes not making reasonable accommodation to the known physical or mental limitations of an otherwise qualified individual with a disability who is an applicant or employee, barring undue hardship.

AGE

The Age Discrimination in Employment Act of 1967, as amended, protects applicants and employees 40 years of age or older from discrimination based on age in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment.

SEX (WAGES)

In addition to sex discrimination prohibited by Title VII of the Civil Rights Act, as amended, the Equal Pay Act of 1963, as amended, prohibits sex discrimination in the payment of wages to women and men performing substantially equal work, in jobs that require equal skill, effort, and responsibility, under similar working conditions, in the same establishment.

GENETICS

Title II of the Genetic Information Nondiscrimination Act of 2008 protects applicants and employees from discrimination based on genetic information in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. GINA also restricts employers’ acquisition of genetic information and strictly limits disclosure of genetic information. Genetic information includes information about genetic tests of applicants, employees, or their family members; the manifestation of diseases or disorders in family members (family medical history); and requests for or receipt of genetic services by applicants, employees, or their family members.

RETALIATION

All of these Federal laws prohibit covered entities from retaliating against a person who files a charge of discrimination, participates in a discrimination proceeding, or otherwise opposes an unlawful employment practice.

WHAT TO DO IF YOU BELIEVE DISCRIMINATION HAS OCCURRED

There are strict time limits for filing charges of employment discrimination. To preserve the ability of EEOC to act on your behalf and to protect your right to file a private lawsuit, should you ultimately need to, you should contact EEOC promptly when discrimination is suspected:

The U.S. Equal Employment Opportunity Commission (EEOC), 1-800-669-4000 (toll-free) or 1-800-669-6820 (toll-free TTY number for individuals with hearing impairments). Employers Holding Federal Contracts or Subcontracts

Applicants to and employees of companies with a Federal government contract or subcontract are protected under Federal law from discrimination on the following bases:

RACE, COLOR, RELIGION, SEX, NATIONAL ORIGIN

Executive Order 11246, as amended, prohibits job discrimination on the basis of race, color, religion, sex or national origin, and requires affirmative action to ensure equality of opportunity in all aspects of employment.

INDIVIDUALS WITH DISABILITIES

Section 503 of the Rehabilitation Act of 1973, as amended, protects qualified individuals from discrimination on the basis of disability in hiring, promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. Disability discrimination includes not making reasonable accommodation to the known physical or mental limitations of an otherwise qualified individual with a disability who is an applicant or employee, barring undue hardship. Section 503 also requires that Federal contractors take affirmative action to employ and advance in employment qualified individuals with disabilities at all levels of employment, including the executive level.

DISABLED, RECENTLY SEPARATED, OTHER PROTECTED,

AND ARMED FORCES SERVICE MEDAL VETERANS

The Vietnam Era Veterans’ Readjustment Assistance Act of 1974, as amended, 38 U.S.C. 4212, prohibits job discrimination and requires affirmative action to employ and advance in employment disabled veterans, recently separated veterans (within three years of discharge or release from active duty), other protected veterans (veterans who served during a war or in a campaign or expedition for which a campaign badge has been authorized), and Armed Forces service medal veterans (veterans who, while on active duty, participated in a U.S. military operation for which an Armed Forces service medal was awarded).

Retaliation is prohibited against a person who files a complaint of discrimination, participates in an OFCCP proceeding, or otherwise opposes discrimination under these Federal laws.
