The solicitation requests bids for seven liquid asphalt products: MC 70 Road Oil, Tac-Kote E-1, E-1 Prime Emulsion, E-3 Emulsion (Cationic Polymer), E-3M Emulsion (Cationic Polymer), 2000 Tack & Prime, and Crafco Roadsaver 221 in Plexi Melt Meltable Packaging. Bids for the 2026 Spring Commodities Bid, which includes liquid asphalt among multiple commodities, were due by 10:00 A.M. on April 9, 2026, via the PennBid electronic bidding platform. All products except Crafco Roadsaver 221 must comply with specifications in PennDOT Publication 408 (current edition) and amendments thereto. The Crafco Roadsaver 221 product is supplied in 30-pound blocks wrapped in meltable packaging, packaged on 2,100-pound pallets containing 70 blocks each, and is used for sealing and filling pavement cracks and joints. Delivery to participating municipalities must occur within five working days of order placement and include unloading at the directed location.

Bid prices shall include delivery and unloading costs, with bidders required to identify any applicable distributor rental charges that will be added to the unit price. Each participating municipality retains the right to accept or reject materials and may conduct independent testing through approved laboratories at the vendor's expense if materials fail to meet PennDOT specifications; costs of failed testing shall be deducted from amounts due to the bidder or reimbursed by the bidder if no funds are owed. Vendors must provide all equipment and containers for sampling and ensure each distributor is equipped with sampling equipment. The contract includes price escalator provisions allowing the contractor to increase or decrease unit prices based on documented cost changes after the bid opening date, with municipalities retaining the right to withdraw or reduce quantities if unit costs increase more than 10 percent above the base price or if total contract costs exceed a 10 percent increase. The successful vendor must report to the Purchasing Alliance at contract conclusion regarding participating municipalities' purchases, product types, and volumes purchased upon request. Each bid must be accompanied by a one thousand dollar bid bond made payable to "SHACOG Purchasing Alliance and Its Participating Municipalities."

PRICE ESCALATOR PROVISIONS

The contractor/supplier will have the right to increase or decrease the contract unit price of the item(s) specified in an amount equal to the contractor's/supplier's increase or decrease in cost of such item(s) occurring subsequent to the date of the bid opening (hereinafter referred to as 'Base Date'). Any increase or decrease in the contractor's/supplier's cost of such item(s) after the Base Date will be verified by proper documentation furnished to the participating municipality, including proof of price to the contractor/supplier from the contractor's/supplier's source of supply.

Should the contractor's/supplier's allocation of any item(s) be materially reduced by the contractor's/supplier's source of supply, the contractor/supplier may reduce proportionately the quantity of such item(s) to be delivered in accordance with the contract.

The participating municipality may withdraw or reduce the quantity of any item(s) or terminate or reduce the scope of the contract:

a. If the unit cost of any item(s) covered by these escalator provisions is increased more than 10% above the base price, or;

b. If, because of an increase in the unit cost of one or more item(s) covered by these escalator provisions, the total estimated cost of the contract is increased more than 10% above the base price.

The contractor/supplier will be required to provide current rack price listing with each billing to insure escalator clause validity.
