Amendment 0008 to Solicitation N4008526R0005
This is Amendment 0008 to the Design-Bid-Build (DBB) solicitation N4008526R0005 for P1112 B72 Resiliency Improvements at Portsmouth Naval Shipyard (PNSY), Kittery, Maine. The amendment extends the proposal due date from 04 June 2026 to 16 June 2026, with the Preliminary Proposal Inquiry (PPI) cutoff date remaining unchanged at 23 April 2026. The amendment incorporates a revised wage determination (General Decision Number ME20260053, dated 05/18/2026), specification and drawing revisions, responses to 29 prior PPIs, and a revised Attachment H price proposal form that includes new unit pricing for micropiles (SLIN 0001Q).
Key scope revisions include modifications to drawing and specification details for chain link fencing, utility plans, fire lane closure procedures, and bulkhead construction. Notable changes address construction coordination requirements with adjacent overlapping projects via new Drawing GC100A, clarification of bid option scopes (particularly Bid Option 6 regarding one-year plant operations), and addition of historical drawing references for saltwater tunnels and Building 72. The prevailing wage rates for Maine counties of York include Carpenter ($30.56/hr), Electrician ($38.74/hr), Elevator Mechanic ($74.17/hr), Ironworker ($33.65/hr), Laborer ($21.90-$22.15/hr), Pipefitter ($43.76/hr), Plumber ($40.00/hr), and equipment operators/concrete finishers as specified. The contract requires performance bonds per FAR Clause 52.228-15 within 10 days of award and includes minimum insurance requirements for workers' compensation, general liability ($500,000), automobile liability ($200,000-$500,000), and aircraft/vessel liability where applicable.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.
Note: Executive Order 13658 generally applies to contracts subject to the Davis-Bacon Act that were awarded on or between January 1, 2015 and January 29, 2022, and that have not been renewed or extended on or after January 30, 2022. Executive Order 13658 does not apply to contracts subject only to the Davis-Bacon Related Acts regardless of when they were awarded. If a contract is subject to Executive Order 13658, the contractor must pay all covered workers at least $13.65 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract from May 11, 2026, through December 31, 2026. The applicable Executive Order minimum wage rate will be adjusted annually.
Additional information on contractor requirements and worker protections under Executive Order 13658 is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).
The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.
Union Rate Identifiers
A four-letter identifier beginning with characters other than SU , UAVG , SA , or SC denotes that a union rate was prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.
0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.
Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.
Union Average Rate Identifiers
The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:
UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.
The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.
A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.
Survey Rate Identifiers
The SU identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.
SU wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).
State Adopted Rate Identifiers
The SA identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.
The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the SA identifier took effect under state law in the state from which the rates were adopted.
WAGE DETERMINATION APPEALS PROCESS

Please confirm which CLIN the structural work associated with existing B242 and existing B242 wet well should be carried under.
Most Rooms appear to have their own CLIN shy of this location.
Structural work in B242 and piping between the berth and B242 should be listed in CLIN 0001P. Refer to revised bid sheet.

H
Price schedule bid items 001F and
001G seem to overlap. Item 001F includes "structural features" in
Pump Room S, item 001G includes
"all structural work associated with
Pump Room S". Please clarify what structural feature items should be included in 001F that are not included in 001G.
001G should reflect slab & below floor structural work associated with
Pump Room S. 001F should reflect above slab work including any structural repairs identified.
C-107, C-303
Detail of HDPE pipe on drawing
C-303 calls out 12" HDPE, the utility plan on C-107 calls out 15"
HDPE, please clarify the pipe size.
Utility plan C-107 has been corrected to be 12" HDPE
97 GC-100
Drawing GC-100 indicates
"Potential Material Laydown
Area". Areas indicated are exceedingly small for a project of this size. Even the area immediately adjacent to Building
72 is considered "Coordinated
Closure", indicating no equipment, scaffolding, material or fencing can be left in place for any length of time as currently shown. Are there other laydown areas NAVFAC has available to facilitate this project?
Bid per plans and specifications.
99 GC-100
GC-100 indicates all trenches must be backfilled or plated at the end of every day. Is this true for even areas considered a "coordinated closure"? Some excavation areas are 10+ feet deep and it is assumed the vast majority of this excavation work will be tidal impacted and be inundated twice daily. Covering these trenches could add significant time and cost.
Replace GC100 General Sheet Notes
"2. ALL WORK MUST BE
BACKFILLED AND PLATED AT
THE END OF EACH DAY." with "2.
KTR MUST PROVIDE AND
MAINTAIN PERIMETER
PROTECTION AROUND
EXCAVATIONS."

1.2.2.c
Specification indicates construction sequencing and phasing plans are within the drawing set. Please clarify as no clear overall phasing plans are apparent within the drawings, aside from general maintenance of operations within active portions of Building 72 and
Building 242.
Refer to Drawings G006 and GC100 for Mechanical, electrical, and site phasing restrictions. Drawing
GC100A has also been added (initial issue via Amendment #08) describing milestones and coordination with planned adjacent and partially overlapping projects. Refer also to revised 01 11 00.00 20 Summary of
Work (Revised via Amendment 08) for additional requirements.
102 GC-100
Fire lane on GC-100 is indicated for the vast majority of the exterior work areas with utility work, etc.
Please confirm expectation of how fast lane must be opened to traffic?
Previous experience is often within
2 hours.
Fire lanes with approved outages must be reopened to address emergency situations within 2 hours after the contractor is notified.
105 46 82 00 3.2.4
Under this paragraph, for Bid
Option 7, the manufacturer is to provide a full-time Lead Plant
Operator, for 40-hours per week for one year.
Please clarify expectations relative to holidays, vacation time, and sick time. Is the manufacturer required to provide alternate coverage for any of these typical planned and unplanned absences?`
Provide a lead plant operator and alternate operator(s) for periods of time when the lead operator is unavailable to be on-site fulltime.
The plant requires an operator full-time 40/hrs per week.
106 46 82 00 3.2.4
Please confirm that Bid Option 7 operations apply only to the equipment supplied under Section
46 82 00.
The operator’s role under Bid Option
7 (renumbered to Bid Option 6) covers overall plant operation, not just the equipment supplied under
Section 46 82 00. The scope includes overseeing the operation of the new desalination plant, training and supervising the plant team, managing all equipment operation, process control, record-keeping, reporting, troubleshooting, and maintenance.
107 46 82 00 3.2.4
Please confirm any specific responsibilities of the Contractor, relative to Bid Option 7, other than providing for the services of the manufacturer as explicitly noted in
46 82 00, 3.2.4.
Under Bid Option 7 (renumbered to
Bid Option 6), the contractor’s responsibilities are limited to providing for the services of the manufacturer as explicitly stated in
Section 46 82 00, 3.2.4 and Division
01 Specifications.
108 46 82 00 3.2.4
Please clarify how the Period of
Performance and Contract
Completion Date will be addressed if the Government exercises Bid
Option 7.
Refer to Attachment H – Price
Proposal Form Revision 2 Bid Notes describing the award window and construction completion date extension for subject Bid Option 7
(subsequently renumbered to Option
6). The redzone/closeout requirements for the base contract and all other awarded bid options must track in the required timely manner for their relevant to their completion dates. Award of subject bid option will not provide an acceptable cause for delay in these required timely submittals.
111 46 82 00 3.2.4
Given the 1-year duration and the nature of these services, it is recommended that in lieu of including Bid Option 7 in this construction contract, that the
Government issue a separate solicitation for these non-construction services. This will be more cost-effective for the
Government, so as not to incur
Contractor costs associated with carrying this effort for a year after construction completion.
Note Bid Option 7 has since been renumbered to Bid Option 6. Include pricing for this bid option scope.
