About this file

This is a Justification and Approval (J&A) document from the Department of the Navy authorizing the use of brand name specifications for a single-source procurement.

The Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) is procuring an Allen-Bradley CompactLogix 5069 L3 Series controller for Solicitation N40085-26-R-0005 to support P1112 B72 Resiliency Improvements at Portsmouth Naval Shipyard, Kittery, Maine. The project involves a desalination facility with non-potable process water production capacity of 400,000 gallons per day, with expected average daily needs between 250,000 to 300,000 gallons. The controller will integrate pumping and control systems to manage produced water to existing condensate receiver tanks and interconnected cooling tower piping. Authority for this single-source procurement derives from 10 U.S.C. 3204(a)(1), which permits limited supplier acquisitions when essential to government requirements. The justification is based on compatibility with the existing Allen Bradley Control Logix power plant control system; procuring alternative brand controllers would require expensive third-party hardware adapters with increased integration complexity and documented reliability issues stemming from language translation between brand systems. The government's research identified additional project costs of approximately $[redacted] for hardware conversions. A Sources Sought Notice was published February 26, 2026, closing March 12, 2026, with zero responses. The anticipated contract completion is 900 days after award. The Contracting Officer will determine fair and reasonable pricing through comparison of proposed prices, Independent Government Cost Estimate, historical information, and market survey results. The approved J&A will be made publicly available per FAR 6.301.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C.

3204(a)(1) which permits the use of limited suppliers when it is essential to the Government’s requirements, as implemented by Federal Acquisition Regulation (FAR) 6.103-1 (DEVIATION 2026- O0017), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The Allen Bradley Programmable Logic Controllers will be used to control the desalination system and the new Balance of Plant system which acts as an extension of the existing power plant control system.

The existing control system in the power plant is an Allen Bradley Control Logix based system. Matching the control system reduces project risk and unnecessary hardware conversions If the Government did not procure the Allen Bradley Programmable Logic Controller Series, the Government would need to procure a third-party hardware adapter for a different brand name controller series to work with the existing equipment. The Government researched feasibility of hardware conversions for various brands of controllers which results in additional cost to the project of approximately . Furthermore, these hardware conversion devices are more complex to integrate to existing systems. Conversion devices also have a history of failure as a result of having to translate one brand name’s language to another brand name’s language. If the equipment fails, this can result in the entire system being offline which poses considerable risk for the Shipyard. By matching the existing controllers, the project will experience cost savings by not having to purchase a converter in addition to the controllers and provide greater reliability.

Authority to name Allen-Bradley Compact Logix 5069 L3 Series as a required source is necessary because the product enables the controller series to match existing equipment at a lesser cost and with much greater chance of continued functionality.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Sources Sought Notice was published on the Government Point of Entry (GPE), SAM.gov, on 26 February 2026. The notice closed on 12 March 2026 and yielded zero (0) responses. A pre-solicitation notice and solicitation will both be publicized on Contract Opportunities/SAM.gov in accordance with the requirements of FAR Part 5 (DEVIATION 2026-O0003). The approved J&A will also be made publicly available as required by FAR 6.301 (DEVIATION 2026-O0017).

7. Determination of Fair and Reasonable Cost.

The Contracting Officer will determine that the price for this acquisition is fair and reasonable in accordance with FAR Part 15 (DEVIATION 2026-O0017) prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results. The fair and reasonable determination will be made based on the total price of the project. This proprietary item is not an individual line-item price in the solicitation.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid- Atlantic will assess whether competition for future requirements is feasible.
