About this file

This file is a Price Proposal Form for the P909 SOF SDVT-2 Operations Support Facility project located at Joint Expeditionary Base Little Creek-Fort Story, Virginia. The document outlines a detailed bid price schedule with 15 line items, including a base price and multiple option items covering site preparation, soil management, demolition, dewatering, specialized facility components, and equipment procurement. The project is specifically restricted to Multiple Award Construction Contract (MACC) holders under the Naval Facilities Engineering Command, with a government estimated price for Furniture, Fixtures, and Equipment (FF&E) of $1,866,596.23 and additional estimated prices of $600,000 for Audio Visual systems and $800,000 for Electronic Security Systems.

The pricing structure allows the government unilateral rights to award various line items within 60-180 calendar days after contract award, with option line items covering medical suites, storage rooms, staging areas, drive lanes, access floors, training rooms, perimeter fencing, and specialized technology infrastructure. Contractors can propose a Handling and Administration Rate (HAR) not to exceed 5% for equipment-related line items, which will cover administrative costs, overhead, bonding, and profit. The solicitation emphasizes that additional bonding and surety will be required if option line items are exercised, and the final equipment modifications are intended to be awarded at least nine months prior to the contract completion date.

GENERAL BID NOTES

a. Award will be evaluated on the total proposed price for Line Items 0001-0015; base price and the sum of all options.

b. The Government reserves the unilateral right to award Line Items 0002-0005 to the Contractor at the proposed price within 180 calendar days after the contract award and in accordance with all bid notes. The Government reserves the unilateral right to award Line Items 0006-0012 to the Contractor at the proposed price within 60 calendar days after the contract award and in accordance with all bid notes.

c. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.206 (b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the Option(s), Line Items 0002 - 0015 to the total price for the Base Bid, Line Item 0001. Evaluation of options will not obligate the Government to exercise the Option(s). (FAR 52.217-5).

d. In accordance with FAR 52.217-7; Option for Increased Quantity-Separately Priced Line Item (Mar 1989), the Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

e. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

f. Failure to enter a price for any Line Item will result in a proposal being rejected.

g. If Line Items 0002-0015 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all items.

BID NOTES FOR ESS, FF&E and A/V (LIne Items 0013 -0015)

a. The estimated amount for ESS, FF&E, and A/V has been supplied by the Government, to provide Offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the ESS, FF&E and A/V including freight and installation charges. The Government ESS, FF&E and A/V Estimate is only an estimated amount.

b. If awarded, line items will be funded separately after completion of ESS, FF&E, and A/V design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in E20, FURNISHINGS and E10, EQUIPMENT.

c. Bonding

1. Bonding is not required for the design, procurement and installation of ESS, FF&E and A/V equipment at time of Construction Contract Award.

FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the ESS, FF&E Option Item is not part of the original contract award, the Construction Contractor must not be required to secure bond for the FF&E at the time the basic contract is awarded.

2. Additional Bond at ESS, FF&E and A/V Option Item Award

FAR 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the FF&E Option Item award, to protect the Government against the Construction Contractor not providing FF&E ordered and to ensure that the FF&E vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the FF&E funding source and is not a part of the Construction Contractor’s HAR.

3. Bonds Required by the Construction Contractor

If the Construction Contractor requires bonding from the ESS, FF&E and A/V subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.

d. Offerors may propose a Handling and Administration Rate (HAR) for the ESS, FF&E and A/V not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of ESS, FF&E, and A/V. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the ESS, FF&E and A/V. The proposed HAR is a fixed rate.

e. The Government is not obligated to award the Option line item(s). Should the Government choose to award the ESS, FFE and AV, the line item will be awarded as a negotiated option to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the ESS, FF&E and AV.

f. If awarded, the ESS, FF&E and AV modification will be awarded at least nine months prior to the contract completion date. A minimum of nine months is required for the Contractor to purchase, deliver and install the ESS, FF&E and AV without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the ESS, FF&E and AV as an option. No schedule extensions will be granted if the option is awarded at least nine months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than nine months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final ESS, FF&E and AV packages were submitted within the approved schedule deadlines and sufficient lead time for the ESS, FF&E and AV is not available and the Government's award of the option is in the last nine months of the contract.
