About this file
This is Amendment 0007 to solicitation N4008524R2862 for the P909 SOF SDVT2 Operations Support Facility at JEB Little Creek-Fort Story, Virginia Beach, VA. The amendment extends the proposal due date from December 6, 2024 to January 7, 2025 at 2:00PM EST.
The amendment provides numerous technical clarifications and responses to contractor questions regarding: specifications updates, PPI responses, general requirements revisions, building requirements changes, sustainability checklist goals, site analysis updates, and room requirements modifications. Key changes include confirmation that the building is outside the blast arc, clarification that floor-mounted fixtures are required instead of wall-hung fixtures, updates to the laydown area requirements to 3239 SY on the east side of the building, confirmation of a medium level of protection for antiterrorism criteria, and clarification that ICD/ICS-705 accredited consultant is required. The amendment also provides updated information about demolition requirements, steam piping removal, communications requirements, and various building systems specifications.

This project will require trade contractors for site work, site utilities, demolition, deep foundations, concrete, structural steel, roofing, doors, windows, framing, interiors, mechanical, electrical, and communications, along with many others. The competition for these trades will come from union and non-union (open shop) contractors. With this PLA being mandated, there is high probability that the

non-union trade contractors will not participate because PLAs change the way they do business and in turn places an unfair hardship on their business. Please consider removing this PLA mandate as to not detrimentally impact this crucial project for the government.

52.222-34 shall be considered nonresponsive and ineligible for award. According to the U.S. Bureau of
Labor and Statistics, union affiliation of employed wage and salary workers was
4.3% in the state of Virginia (derived from
Union Membership (Annual) News Release
- 2023 A01 Results (bls.gov)). As most of the local and regional labor force is non-union, mandating the use of a PLA between contractors and the unions will strain current labor availability. Excluding several key non-union trade contractors, who will not be able to comply with union stipulations within a mandated PLA, will place immense undo stress on an already struggling labor force in the mid-Atlantic region. The use of a PLA on this project will also have a negative effect on the global project cost, schedule, quality, and safety. There is significant local interest in participating in this project by both union and non-union trade contractors, however, mandating a PLA will significantly diminish that interest. We are unaware of any national interest in this project;
however, we are aware of significant local interest that will be negated by a PLA requirement. Please consider removing this
PLA mandate as to not detrimentally impact this crucial project for the government.

52.222-34 shall be considered nonresponsive and ineligible for award. There is a small and declining union presence in the Hampton Roads region and limiting labor resource availability will significantly increase the cost of labor on this project. Additionally, the unions/halls that would be serving this project in the designated region are already strained. Open-shop non-union contractors will be forced to change the way they do business to participate in the PLA, which many will refuse to do. With the currently robust non-federal construction project market in the region, many non-union trade contractors will simply focus their resources on non-PLA projects and will refuse to participate. This will decrease competition and exacerbate the already strained skilled labor force, all resulting in significant cost increases. Please consider removing this
PLA mandate as to not detrimentally impact this crucial project for the government.
The PLA requirement remains unchanged at this time, bid per RFP.

52.222-34 shall be considered nonresponsive and ineligible for award. 95.7% of the construction labor force in the state of Virginia is hired by non-union contractors who are unwilling to change their way of doing business due to the negative costly effects of PLAs. This will lead to lack of competition, significant cost increases, skilled labor shortages, schedule issues, quality issues, safety concerns and potential non-bids from prime contractors who cannot find adequate qualified subcontractors to bid the work. Please consider removing this PLA mandate as to not detrimentally impact this crucial project for the government.

IDIQ MACC for Large General
Construction Projects Primarily in the
Hampton Roads Area of Responsibility did not include any provisions for Project Labor
Agreements. The original Seed project nor any of the first several issued Task Orders contained provisions for PLAs as well. The unilateral implementation of a PLA on this project in the middle years of this MACC will negatively impact participation from current MACC Contract Holders limiting competition for the government and likely increasing proposed costs potentially beyond the awardable range. Please consider removing this PLA mandate as to not detrimentally impact this crucial project for the government.
The PLA requirement remains unchanged at this time, bid per RFP.
94% of the Virginia workforce is non-union. The Project Labor Agreement requirements preclude the vast majority of the workforce from participating in this project which will severely limit subcontractor participation, increase the cost of the project for the Government, and add unreasonable risk to the contractors.
Would the Government consider waving the
PLA reequipments for this MACC?
The PLA requirement remains unchanged at this time, bid per RFP.
During the seed project for this MACC there were no Project Labor Agreement requirements, PLAs constitute a significant changed condition to the requirements of the MACC. Contractor's on this MACC have all made a significant financial investment into the MACC where now responsive trade partner bids are unavailable. Would the Government consider eliminating the PLA requirements for this project?
The PLA requirement remains unchanged at this time, bid per RFP.
Due to the overwhelmingly open-shop and small-business market present in Virginia and the Carolinas, Project Labor
Agreements disproportionately effect small, minority, and disadvantaged businesses.
Would the Government consider eliminating PLAs when a Small, Minority, Service Disabled, DBE, or otherwise disadvantaged business can in used in lieu of a union subcontractor?
Given the amount of time and effort necessary to negotiate a PLA with multiple unions, would the Government consider allowing PLAs to be submitted 30 days post award?
The PLA requirement remains unchanged at this time, bid per RFP.
Many Project Labor Agreements require non-union companies to contribute to the health and welfare accounts of non-participating union companies in order to secure the Labor Agreement for a project.
That means that the employees of non-union companies do not benefit from these financial contributions in any way. Said another way, non- union members of the
PLA are paying for the benefits of workers who are not participating in the project, while workers who are participating in the project are not receiving benefits of the cost paid by the Government. Can Project Labor
Agreement requirements be waived for this project?
The PLA requirement remains unchanged at this time, bid per RFP.

2.3.5
Section 2.3.5 (Antiterrorism) does not say what the minimum required standoff distance is. However, on the concept site plans it looks like there is a 33-foot standoff delineated around the building. Is 33-feet the required standoff? Is this just a zone of unobstructed space, or does there need to be barriers in place, such as curbing, bollards, or gates?
No, the 33 feet is the unobstructed space/clear zone. The standoff distance will be as per SEPA level of protection.

CHAP 4-4.0
C101, C102, X203, C205, and C207
Building Requirements lists 5 Telecom
Rooms (C101, C102, X203, C205, and
C207). Part 3 – Chapter 5 – 5.0 Room
Requirements only includes 4 Telecom
Rooms (C101, C102, C205, and C207). It appears that Comm Room X203 was not included in the room requirements. The reason we are asking the question, is to better identify any special Telecom Room requirements for which rooms are dedicated to serve which areas. C101 and C102 are assumed to be General Purpose Telecom
Rooms for the first floor. Each of these rooms provides identical services and each feed half of the first floor. On the second floor, between the Chapter 4 requirements and Chapter 5 requirements we have X203, C205, and C207. Within the Room
Requirements, C205 specifically says its located “within the N6 Group’s Office Suite to support the telecommunications systems for the second floor of the facility.” C207’s description appears more general in nature and serves the second floor (assumed to be the other half of the second floor that C205 will not reach). Please provide confirm that even though C205 is located within the N6 suite, it can serve areas outside of the N6 suite. Please confirm the purpose of X203 and provide a room requirements data sheet for this room. Is the X203 room meant to be physically located within the SCI area and can it ONLY provide services to the outlets within the SCI area?
