Offeror's proposal should represent its best efforts to respond to the solicitation. Any inconsistency between promised performance, the technical capability and experience in the proposal, identified personnel resources, and price must be explained in the proposal. For example, if the intended use of new and innovative techniques is the basis for an abnormally low estimate, the nature of these techniques and their impact on price shall be explained; or, if a corporate policy decision has been made to absorb a portion of the estimated price, that must be stated in the proposal. Any inconsistency, if unexplained, may raise a fundamental question of the Offeror’s understanding of the nature and scope of the work required and may adversely impact the evaluation of the Offeror’s proposal. The burden of proof as to price credibility rests with the Offeror. Unrealistically low prices may indicate an inability to understand requirements and a high-risk approach to contract performance. It is the intention of the Government to make a single award Firm Fixed Price Indefinite Delivery Indefinite Quantity contract through the Small Business Association 8(a) Business Development Program. Contract will include one (1) year base period plus four (4) one-year option periods, to provide a responsive, efficient, and reliable means of obtaining temporary contract labor support on an as-needed basis to meet the needs of SRF-JRMC Yokosuka and Sasebo, Japan and also supports various other outlying tenant commands located in Japan A single award(s) will be made to the Offeror(s) whose proposal is the most advantageous to the Government under the selection criteria set forth in this Section M.

The Government intends to evaluate proposals and award the task order(s) upon initial proposals. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a cost or price and technical standpoint. However, the Government may contact any, all, or a limited number of Offerors with questions concerning their responses as permitted under FAR Part 15.

The Government reserves the right to issue an award or not, depending on the quality of the proposals received and the availability of funds. The Government also reserves the right to make an award without discussions.

Proposals will be evaluated in accordance with the instructions set forth in Section L as well as the evaluation criteria contained in this section. The Government intends to make an award resulting from this solicitation to the responsible Offeror whose proposal represents the best value after evaluation in accordance with the factors (and subfactors, if any) in the solicitation. The Offeror’s responses to the “Instructions to Offerors” in Section L of the solicitation will form the basis of the evaluation of proposals as follows: A rating that is less than “Acceptable” in any non-price evaluation factor and/or less than a “Satisfactory Confidence” rating in the Past Performance evaluation factor will render a proposal ineligible for award consideration as submitted. The evaluation of proposals will consider the non-price proposal for Technical Capabilities/Experience and Past Performance when combined to be significantly more important than price.

B. Evaluation Factors. All evaluation factors other than price, when combined, are significantly more important than price. The evaluation factors that will be used in evaluating and determining the offer which represents the best value to the Government are listed in order of importance as stated below:

NON-PRICE FACTOR 1- Technical Capabilities/Experience [More important than Factor 2]-

Sub-factors are listed in no order of preference:

SUBFACTOR - Key Personnel Resumes SUBFACTOR - Management Approach & Staffing Plan

NON-PRICE FACTOR 2- Past Performance

FACTOR 3: Price

In order to select the successful Offeror, the Government will compare Offeror proposals. The comparison will trade off differences in the non-price factors and proposed price. Technical Capabilities /Experience is more important than subfactor Past Performance. Past performance is more important than price. As proposals become more equal in past performance, price becomes more important. It is in the best interest of the government to acquire services of the technically acceptable offeror who shows the highest capability of meeting requirements. The evaluation factors that will be used in evaluating and determining the offer which represents the best value to the Government are listed above.

Note 1: Awards will only be made to an Offeror that has no organizational conflict of interest as defined in FAR 9.5 or that the Government determines has provided a satisfactory mitigation plan.

C. Evaluation of Offers. All responsible (in accordance with FAR 9.104) and certified 8(a) small businesses who meet the following will be evaluated on the following 3 Factors:

A rating of ‘Fail’ on the SUBFACTOR – Key Personnel Resumes portion of the proposal will result in an overall Technical Capabilities/Experience rating of ‘Unacceptable” and result in a proposal that is ineligible for award and not considered further.

SUBFACTOR - Management Approach & Staffing Plan. The Government will evaluate the Offeror’s Management Approach and Staffing Plan on the following:

(a) The degree to which the plan demonstrates how the proposed key personnel shall support task areas in the PWS with their labor allocation, and the degree to which they demonstrate that the proposed key personnel have the capability to perform the proposed approach;

(b) The degree to which the plan demonstrates how the Offeror will utilize subcontracting/teaming/consulting agreements in contract performance;

(c) The degree to which the plan describes how the Offeror intends to manage and coordinate the task efforts of this contract, including planning, assigning responsibility, controlling personnel, controlling utilization of resources, tracking deliveries, and periodically monitoring performance and obtaining feedback;

(d) The degree to which the plan demonstrates overall daily supervision, safety monitoring, coordination, and management of each functional area to include liaison between Government personnel and contracting personnel for daily tasking;

(e) The degree to which the plan describes procedures in place for monitoring and controlling costs and demonstrating that the procedures are successful;

(f) The degree to which the plan demonstrates how the Offeror will utilize a recruitment/retention plan to ensure proper staffing throughout the performance of the contract; and

(g) The degree to which the plan describes any techniques and actions to mitigate risks and explain whether the techniques and actions identified for risk mitigation have been successfully used by the Offeror.

(2) NON-PRICE FACTOR 2: The Government will evaluate an Offeror’s Past Performance based on its relevancy and confidence.

For the Past Performance factor, the rating tables identified in the tables further below entitled “Past Performance Relevancy Ratings Table” and “Past Performance Confidence Assessment Ratings Table” will be utilized for the assignment of ratings for relevancy and past performance assessment. Past performance will be evaluated for confidence based on the relevance of the submitted contracts.

Past Performance will be assessed as follows:

Evaluation will focus only on work experience already performed. Work yet-to-be performed, and work prior to the last 5 fiscal years, will not be considered. In addition, performance data will only be assessed for those references demonstrating at least 1 year of completed performance prior to the closing date of the solicitation.

Past Performance Relevancy Ratings – Regarding relevancy, each past performance reference under each offeror’s Past Performance submission will be evaluated to determine its individual scope, complexity, and magnitude relative to the instant requirement. Scope will be evaluated on experience in the areas defined in the PWS. Complexity will be evaluated on the required coordination, technical and managerial intricacy of efforts and their similarity to the solicitation. Magnitude will be evaluated on the dollar amount of work actually performed under the contract or contracts, during the relevant period established by the solicitation.

Past Performance Confidence Assessment Ratings – The overall assigned rating for Past Performance will be the Past Performance Confidence Assessment rating. The assignment of this rating will be based on the quality of the relevant past performance. The quality of performance under a past performance reference that that has no relevance to the instant requirement will not be considered in the overall assessment of Past Performance Confidence.

This consideration is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s past performance will be used as a means of evaluating the relative capability of the offeror and other competitors to successfully meet the requirements of the RFP. In determining the rating for the past performance evaluation factor, the Government will give greater consideration to the contracts which the Government feels are most relevant to the RFP. Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance. However, the proposal of an offeror with no relevant past performance history, while not rated favorably or unfavorably for past performance, may not represent the most advantageous proposal to the Government. In this instance, the offeror will receive a rating of “Neutral” in the past performance factor.

Evaluation of past performance may include, but not be limited to, relevance and extent of previous contracts, quality and conformance of supplies/services to contract requirements, timely delivery/performance, business relations, cost control and small business utilization.

Past Performance Information (PPI) utilized in the evaluation will be obtained from the contractor performance data sheets, and past performance questionnaires from the offeror’s references. Contractor references that cannot be contacted will not be considered.

Government evaluators may avail themselves of various federal, state, and local past performance databases including, but not limited to, Past Performance Information Retrieval System (PPIRS), Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontracting Reporting System (eSRS), and Defense Logistic Agency’s (DLA’s) Mechanization of Contract Administration Services (MOCAS) system. The Government may research offeror performance on any federal, state, local, and commercial contract that is known to the Government, but not included on a submitted “Contractor Performance Data Sheet.” Additionally, interviews with Program Managers, Contracting Officers, and the Defense Contract Management Agency may be utilized.

(3) FACTOR 3: Price

The offeror’s proposed price will be evaluated for reasonableness based on price analysis in accordance with FAR 15.404-1(b). Offers will also be evaluated based on the following:

_X_Single Award evaluation per Section A. General.

_X_Evaluation of Options per FAR 52.217-5.

Price will not be scored or rated. Evaluation of price will be performed using one (1) or more of the price analysis techniques in FAR 15.404-1(b). Unbalanced pricing may be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices. Through these techniques, the Government will determine whether prices are reasonable, complete, and balanced. The total evaluated price will include a summation of all CLIN total pricing contained in the price schedule plus the evaluation of FAR Clause 52.217-8, described below.

As part of the price evaluation, the Government will evaluate its option to extend services (see FAR clause 52.217-8) by adding six (6) months of the offeror’s final option period price to the offeror’s total price. Offerors are required only to price the base and option periods. Offerors shall not submit a price for the potential six (6) month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period (base or option periods), utilizing rates of that performance period.
