SECTION J – Attachment 3
Moderate Risk Public Trust Processing Procedures
1. Requirements and Procedures for processing Public Trust Certifications
a. The Bureau of Diplomatic Security shall conduct background investigations on those personnel, US and Third Country Nationals, requiring a Public Trust Certification for contract performance. Prior to contract performance
b. The contractor shall coordinate with the Regional Security Officer for vetting of Local National personnel performing on this contract.
c. Contractor personnel may not perform on contract until a Public Trust certification has been issued by Personnel Security and Suitability.
d. A preliminary background check will be conducted in conjunction with Public Trust certification processing and, if possible, an interim Public Trust certification will be issued. An Interim Public Trust certification is acceptable for initial contract performance.
e. Those contractor personnel whose preliminary background check is deemed unfavorable will not be issued an interim Public Trust certification. He/she will not be approved for initial contract assignment and will not be considered for contract assignment until his/her investigation has been favorably adjudicated. A personal interview may be conducted if deemed necessary by the Bureau of Diplomatic Security.
f. During the conduct of the investigation, if substantive issues are raised, or if the contractor employee does not pass the Public Trust investigation, an interim determination may be withdrawn and he/she shall be removed from the contract at no cost to the government.
g. All contractor personnel performing on this contract must possess, favorable adjudicative determination, either a Security Clearance issued by the Defense Industrial Security Clearance Office (DISCO), Public Trust certification issued by the Bureau of Diplomatic Security or be vetted by the local RSO, prior to contract performance.
h. All requests for Public Trust certifications shall be submitted at least 80 calendar days prior to the start of contract performance.
i. Contractor shall complete screening of all contractor personnel prior to submission to DS/IS/IND in accordance with J below. Contractor shall delete all applicants deemed unacceptable through their contractor screening process.
j. The screening accomplished by the Contractor is intended to determine whether or not the applicant can satisfy the following:
a. Ability to obtain a Public Trust certification.
b. Ability to meet the requirements for experience required for the Labor
Category for which the contractor is performing on the contract as.
2. Third Country Nationals
a. The Contractor shall submit all Third Country National (TCN) for a public trust certification, personnel performing on the contract/task order, utilizing the Electronic Questionnaires for Investigations Processing (e-QIP) to DS/IS/IND and shall be investigated and favorably adjudicated by the Bureau of Diplomatic Security prior to contract performance. TCN’s will not be approved for contract assignment until a minimum of an interim or final Public Trust certification is favorably adjudicated by DS/SI/PSS and the company notified. Note: If Ugandan applicants are to perform on contract, they will not be afforded an interim Public Trust certification. They will be processed but will only be granted a final Public Trust certification.
b. The contractor shall immediately remove TCN personnel from contract performance whose interim certification is withdrawn or final certification is denied, at no cost to the government.
3. Local Nationals
a. Local National (LN) personnel selected to perform on the contract/task order shall be vetted and approved by the local Embassy Regional Security Office (RSO) in accordance with the standards established by the RS. LN’s shall not perform under this contract until approved by the RSO. The contactor shall immediately remove those LN personnel subsequently determined by the RSO as unsuitable to perform under this contract at no cost to the government.
4. Adverse Information
a. The contractor shall reports any adverse information pertaining to contractors assigned to the contract, in any capacity, to the CO, COR, DS/IS/IND, and RSO immediately.
5. OPM portal Access
a. Only US citizens shall be granted OPM portal access.
b. Contractor personnel requiring access to the OPM portal for the purpose of submitting the Standard Forms through the Electronic Questionnaires for Investigation Processing (e-QIP) will require a minimum of a Moderate Risk Public Trust certification prior to the being granted OPM portal access. OPM portal access shall be granted through DS/IS/IND. All training for the OPM portal and e-QIP submissions shall be accomplished by DS/IS/IND.
c. If the contractor chooses to utilize Third Party Data Entry (3PDE) the individual doing the entry must have a favorable SSBI (Single Scope Background Investigation) that can be certified to DS/IS/IND prior to authorization being granted.
6. Standard Form 85P/PS Moderate Risk Public Trust Processing
a. The contractor shall ensure that all personnel requiring a Public Trust certification complete the SF 85P/PS and all related forms necessary to process the public trust certification. The contactor shall use the e-QIP system for all applicants. The paperwork shall be submitted in English and readable.
b. The following forms and documentation are required for submission of a Moderate Risk Public Trust certification packages. DS/IS/IND shall provide guidance and training for the submission of e-QIP and hard copy SF 85P/PS packets. Contractor personnel requiring Public Trust certifications should be initiated for processing as soon as possible
c. The Government reserves the right to require the use of different forms. The contractor will be advised if the use of different forms is required.
i. Standard From 85 P/PS (Questionnaire for Public Trust Positions)
ii. Electronic/Digital Fingerprints (FD 258)
iii. Signed DS-4002 Credit Release form
iv. Proof of citizenship
v. Applicant Itinerary
vi. Bio Approval Notification from Program Office (as applicable)
vii. DD Form 214 Certificate of Release or Discharge from Active Duty and/or
NGB-22 Report of Separation and Record of Service or equivalent (as appropriate)
viii. Family Biographical Sketch (as applicable)
ix. Completed foreign Relatives, Friends and Associates spreadsheet
x. Completed Overseas Activities Contact Data sheet
xi. Kuwaiti Ministry of Foreign Affairs (MFA Civil ID Number (as applicable)
xii. National ID Card (copy of front and back of card (as applicable)
xiii. Other Country Release of Information Forms (as applicable)
xiv. Police Certificate of Good Conduct or Police Clearance Certificate (Ugandan and Kenyan applicants only) (as applicable)
The contractor should submit the required forms the most expeditious manner possible (the forms will be able to be up loaded into eQIP) to:
