About this file
This is a Maintenance Bond document for the Borough of Doylestown, Pennsylvania, related to Contract 2400754 for Fanny Chapman Memorial Pool Main Pool Repairs. The bond guarantees that the selected contractor will faithfully perform maintenance obligations and repair any defects in materials or workmanship that develop during an eighteen-month maintenance period following final completion and acceptance of the work. The maintenance bond must equal 15% of the agreement price and indemnifies the Borough against defects that may arise during the specified maintenance period. Any legal action related to this bond must be filed in either Bucks County Court of Common Pleas or the United States District Court for the Eastern District of Pennsylvania.
The bond document requires signatures from both the Principal (contractor) and the Surety (bonding company), along with their respective business addresses and corporate seals. If the Surety is represented by any person other than the President or Vice President of the Surety Company, a current certificate of authority must accompany the execution. The bond serves as a critical risk mitigation mechanism for the Borough, ensuring that the contractor assumes financial responsibility for any defects discovered during the eighteen-month post-completion maintenance period and obligates the contractor to repair or compensate the Borough for any losses sustained due to failure or default in meeting these maintenance obligations.
