About this file

This document is a Federal Acquisition Regulation (FAR) provision, specifically 52.204-24, addressing representations regarding certain telecommunications and video surveillance services or equipment. The provision implements Section 889 of the John S. McCain National Defense Authorization Act, which prohibits federal agencies from procuring or using telecommunications equipment or services from specific vendors. The key restrictions include: (1) agencies cannot procure equipment, systems, or services that use covered telecommunications equipment as a substantial component or critical technology after August 13, 2019, and (2) agencies cannot enter into contracts with entities that use such equipment or services after August 13, 2020. Offerors must represent whether they will provide or use covered telecommunications equipment, and if so, must disclose detailed information about the equipment or services, including the producing entity, equipment descriptions, and proposed usage.

The provision requires offerors to conduct a reasonable inquiry and check the System for Award Management (SAM) for excluded parties. They must complete checkboxes indicating whether they will provide or use covered telecommunications equipment or services, and if they respond affirmatively, they must provide extensive additional disclosure information. This includes details such as the producing entity's name, unique identifier, CAGE code, equipment brand and model numbers, and explanations of proposed equipment or service usage. The goal is to ensure that federal contracts do not involve telecommunications equipment or services from vendors deemed to pose potential security risks.
