TOTAL PRICE (CLINS 0001 THROUGH 0026) $____________________
1.1 General Bid Notes:
1. Award will be made on the total sum of Contract Line Item (CLIN) 0001. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.
2. The Government reserves the unilateral right to award CLINs 0004 and 0008 to the Contractor at the proposed price within 120 calendar days after the contract award. The Government reserves the unilateral right to award CLINs 0002 through 0003, CLINs 0005 through 0007, and CLINs 0008 through 0013 to the Contractor at the proposed price within 365 calendar days after the contract award. A firm fixed proposed price is required for CLINs 0002 through 0013. No provision is made for economic price adjustment. If any of these Options are exercised, the contract completion date remains 1,461 calendar days after award of the contract or any accepted proposed shorter duration.
3. Evaluation of Options (Jul 1990) - Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for CLIN 0001 (base bid). In accordance with FAR 52.217-5, Evaluation of Options, the evaluation of options will not obligate the Government to exercise the option(s).
4. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
5. If any of the CLIN(s) 0002 through 0013 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all Items.
1.2 FF&E, AV & Collateral Equipment Bid Notes
These notes apply to CLINs 0014 through 0026
1. The estimated amount for FF&E, A/V and Collateral Equipment has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E, A/V and Collateral Equipment including freight and installation charges. The Government FF&E, A/V and Collateral Equipment Estimate is only an estimated amount.
2. If awarded, line items will be funded separately after completion of FF&E, A/V and Collateral Equipment design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details for FF&E are provided in Specification 12 00 01.00 20 Furniture, Fixtures and Equipment (FF&E) Package. Requirements and details for A/V are provided in Specification 01 30 02.00 22 Design, Procurement, and Installation of Audiovisual Equipment.
3. Bonding
i. No Bonding is required for FFE, A/V and Collateral Equipment at Time of Construction Contract Award
FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the FF&E is not part of the original contract award, the Construction Contractor must not be required to secure bond for the FF&E at the time the basic contract is awarded
ii. Additional Bond at FF&E, A/V and Collateral Equipment Option Item Award
FAR 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the FF&E Option Items award, to protect the Government against the Construction Contractor not providing FF&E ordered and to ensure that the vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the FF&E funding source and is not a part of the Construction Contractor’s HAR.
iii. Bonds Required by the Construction Contractor
If the Construction Contractor requires bonding from the FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.
4. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E, A/V and Collateral Equipment not to exceed five percent (5%). This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E. The Contractor’s proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E. The proposed HAR is a fixed rate.
5. The Government is not obligated to award the FF&E, A/V or Collateral Equipment line items (CLINS 0014 through 0026). Should the Government choose to award the FF&E and A/V and Collateral Equipment options, the line items will be awarded as a negotiated modification to the contract. The contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and A/V and Collateral Equipment.
6. The FF&E and A/V and Collateral Equipment modifications will be awarded at least six (6) months prior to the contract completion date. A minimum of six (6) months is required for the contractor to purchase, deliver and install the FF&E and A/V and Collateral Equipment without impacting the overall completion date of the project. The contractor’s schedule should assume the award of the FF&E and A/V and Collateral Equipment as a modification. No schedule extensions will be granted if the modification is awarded at least six (6) months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six (6) months prior to the contract completion date, the contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the prime contractor demonstrates that accepted Final FF&E,A/V and Collateral Equipment packages were submitted within the approved schedule deadlines and sufficient lead time for the FF&E, A/V and Collateral Equipment is not available and the Government’s award of the modification is in the last six months of the contract.
7. The Contractor and the Contractor's Designers must strictly adhere to the A/V and FF&E submittal schedule to ensure that the final FF&E package endorsement is completed at least nine (9) months prior to Beneficial Occupancy Date (BOD). If projected final FF&E package endorsement date falls between 15 July and 15 November, then endorsement must occur no later than 10 July for any given calendar year.
