About this file
This document is a Pre-Proposal Inquiry Responses table addressing questions submitted by potential contractors for a federal construction contract at MCAS Cherry Point involving two projects: P-993 F-35 Sustainment Center and P-995 facility, with a total anticipated magnitude exceeding $500 million and a project duration of 1,461 calendar days.
Key responses include clarifications on Cybersecurity Maturity Model Certification (CMMC) Level 2 requirements: Division 1 Specifications for both P-993 and P-995 have been reissued without the CUI (Controlled Unclassified Information) designation via Amendment 0006, allowing broader subcontractor and supplier access. The minimum small business participation requirement is 20% of total contract value. Specific technical clarifications address material specifications (NCDOT #57 crushed stone versus imported structural fill to be priced per plans and specifications), firestopping contractor qualifications (FM/UL certification or manufacturer-accredited programs), excavation requirements (over-excavation of building footprint is not required), and equipment award timing (FF&E, AV, and collateral equipment to be awarded approximately 24 months in advance). Partial Beneficial Occupancy Dates (BOD) are acceptable for completed work sections. Quality Control Specialist positions may be employed by subcontractors under the QC Manager's control. Submittal reviewers must have 10 years of construction experience and hold Registered Architect or Professional Engineer credentials. Several questions remain marked "PENDING RESPONSE," including those regarding Land Use Control Plans, AIS/BABA requirements applicability, and state/local tax exemption status.

5. PRE-PROPOSAL INQUIRY RESPONSES:

Reference Question Government Response
Page Section Paragraph
Solicitation
Page 13 of
The RFP for the P-993 F-35
Sustainment Center requires all contractors performing work on the project to hold CMMC Level 2 (Self).
Currently, the vast majority of local and regional subcontractors, equipment suppliers, vendors and service providers – particularly those that qualify as SB - do not possess this certification, and estimates indicate it will take most companies 6–18 months to obtain it, with costs ranging from tens of thousands to hundreds of thousands of dollars per vendor. This requirement is especially burdensome on the local small-business community, many of whom do not have the resources necessary to pursue certification. As a result, the mandate is severely hindering the project’s ability to meet the Government’s 40% small-business participation target.
Can the Government reduce the small-business participation target for this Opportunity from 40% to 20%?
PENDING RESPONSE
The documents provided do not appear to have analytical data for the water and soil conditions at either the
P-995 or P-993 sites in terms of contamination. is their analytical data that shows the actual constituents of concern and their concentration levels? type of contamination concentrations will affect what landfills the material can be disposed of and impact the analytical tests that will need to be performed.
Solicitation
, pages 11 and 15
On page 15 of the solicitation it states
“The minimum required small business participation (i.e. work to be performed by small business as the prime contractor and/or work to be performed by small business subcontractors) is 20%. Offerors who are not able to meet the minimum total small business participation requirement of 20% (of the total contract value) shall provide a detailed explanation why the minimum total small business participation requirement cannot be achieved.
The current CMMC Level 2 requirements for all subcontractor involvement create a barrier for the majority of local small businesses, as they have not previously encountered this requirement and do not have this certification. To obtain CMMC Level
2 certification takes approximately 8 months minimum and can be cost-prohibitive for many local small businesses, thereby eliminating them from consideration for subcontracting opportunities on this contract.
On page 11 of the solicitation the anticipated magnitude of construction for this project is identified as “over
$500,000,000”. Considering that the majority of the scope of work is dedicated to P-993, which requires the
CMMC Level 2 certification, the P-
995 facility, which does not require the CMMC Level 2 certification, would need to carry the small business participation. The P-995 facility is significantly smaller in dollar value and will not be able to carry the small business participation requirement to allow Prime contractors to meet the
20% goal. Please revise the small business target goal to a more realistic
10%.
Solicitation
, page 51
On page 51 of the solicitation, paragraph (d) CMMC unique identifiers, states "The Offeror shall provide, in the proposal, the CMMC unique identifier(s) (CMMC UIDs) issued by SPRS for each contractor information system that will process, store, or transmit FCI or CUI during performance of a contract, task order, or delivery order resulting from this solicitation." However, there are no instructions in the submission requirements for where to include this information. Please confirm where this information is to be provided - in our Price Proposal Volume or Non-
Price Proposal volume?

Please confirm which gate should be utilized for delivery for abnormally long materials like the 85' Piles.
Site fill operations for offsite fill can be delivered directly from HWY 101, and so concrete piles can be delivered similarly from HWY 101;
however, the perimeter security fence to the installation must be in place to maintain the security of the installation. Once the temporary security fence is in place, offsite fill and piles can be delivered directly from
HWY 101, subject to approval of the Contracting Officer. If for some reason delivery could not be from HWY 101, the
Cunningham Gate could be used during non-rush hours.

Question 1: Given the project's firestopping scope (penetration types, quantities, and assembly ratings), does the Government / DFPE consider this project eligible for the Option (b) qualification pathway with AHJ approval, rather than the full Option
(a) FM 4991 / UL Certified Firestop
Contractor requirement?
Question 2: If Option (a) remains required, can the Government confirm whether a waiver or substitution process is available given the regional unavailability of FM 4991- or UL-certified firestopping contractors?
Question 3: For Option (b) eligibility, please confirm: (a) who serves as the
AHJ for this Navy project for purposes of approving Option (b) qualifications, and (b) what documentation of manufacturer training and experience will be required for submission.
For questions 1 and 2: The firestopping contractor must either receive the FM/UL certification (a) or be certified by the firestopping manufacturer once they completed the manufacturer’s accredited firestop specialty contractor program (b). One example of a program is “Hilti
Accredited Firestop Specialty
Contractor (HAFSC)”. The contractor is to submit the manufacturer’s certification they completed the program.
For question 3: (a) AHJ -

(b) See 07 84 00 - 1.5.1.b.
"Certified, licensed, or otherwise qualified by the firestopping manufacturer as having the necessary staff, training, and a minimum of
3 years’ experience in the installation of manufacturer's products in accordance with specified requirements.
Submit documentation of this experience. A manufacturer's willingness to sell its firestopping products to the
Contractor or to an installer engaged by the Contractor does not in itself confer installer qualifications on the buyer. The Installer must be a trained representative of the manufacturer (not distributor or agent) in the proper selection and installation procedures. Obtain and submit installer's written certification of training and retain proof of certification for duration of firestop installation."

General
The RFP includes multiple delegated design requirements.
Please confirm that the Contractor’s delegated design responsibility is limited to developing systems consistent with the performance requirements identified in the contract documents.
Further, if the delegated design process identifies additional system requirements, coordination items, or infrastructure upgrades (e.g., structural, electrical, mechanical, or architectural) beyond those indicated in the contract documents, please confirm that such impacts will be addressed as changes to the contract.
The Contractor's delegated design responsibility is to develop systems meeting all requirements identified in the contract documents. The delegated design should endeavor to fit the conditions in the contract documents. If the design cannot fit the requirements in the contract documents, submit an RFI to the Contracting Officer.

Because this Contract appears to be the first project in the region requiring
CMMC Level 2 (Self), the added burden is expected to increase vendor costs significantly and may extend the schedule as trade partners work through the certification process. This will present an extreme challenge for the SubK’s in the Region and will drive up overall pricing due to limited competition, or only large business
SubK’s and/or non-regional, or only far away SubK’s being able to work it.
To reduce these impacts, it is recommended that the Government and DOR identify which drawings and scope elements truly require CMMC
Level 2 (Self) and package them separately, allowing broader vendor participation on remaining work. As written, the requirement is expected to drive pricing above budgeted levels and may jeopardize the proposed
Period of Performance.

Spec 31 00 00 - 3.4.5 Structural
Excavation calls for excavating the entire building footprint area and at least 5 feet beyond, to the deeper of 4 feet below existing grade or 2 feet below bottom of footings. Please remove this requirement as the building footprint is a very large area that is all in a fill area, also being loaded with a surcharge, and deep foundation piling is being installed under the foundation. By excavating an additional 4 feet below the existing grade for the building footprint, this is an additional ~50,000+ CY's of excavation. Please confirm that this over excavation is not required.
Over-excavation of the entire building footprint as indicated in the referenced specification section is not required.
Partial BOD P993 - Duration is noted to be 1,461 calendar days. Is there any requirement to complete the tie-in to Runway 05R, taxiway to bridge and the bridge in advance? If not, will
NAVFAC accept a partial BOD for this completed work since it may support other projects like the Scuff &
Refresh, and will also be very difficult to maintain the landscaping around an active runway?
Yes, a partial BOD for the taxiway and bridge will be entertained and will be required as soon as practical.

If the contractor would like to consider a batch plant per the 32 13 14 specs, it would require an area of not less than 3 acres, with adequate access to power, water, and drainage. Can the Gov't confirm if power and water could be made available during construction?
There is a location at the south end of DELTA Taxiway normally used for both asphalt and concrete batching operations. That location has sufficient area and utility infrastructure, available at prevailing rates, for such operations. This site has both water service (via a well) and three phase electrical feeder connections provided by
Carteret Craven Electric
Cooperative (local CoOp NOT
Base Power). KTR would need to set up account with
CCEC. This site has been used before for both concrete and asphalt batching operations. It has not been used for multiple batch plants simultaneously.
The space exists for concurrent batching operations, but electrical load capacity would be dependent on the batch plant’s simultaneous draw if more than one plant were operational.
Please consider reducing the CUI label on drawings and specifications to the absolute minimum. A complete label of all drawings and specifications requires all subcontractors working on this project to obtain a CMMC Level 2 (self) certification. Currently there are only a few subcontractors that have this certification and the impacts to the project will be extensive if not adjusted.
