N0017822R2501 - DRAFT Questions

SectionQuestionResponse
Section C.4.3.6, Section L.1.4.(c), & Section L.2.6These sections state that "all personnel performing any portion of the work under this requirement will possess a personnel clearance at the SECRET level or higher." However, there is no classified hardware to be built on this contract and personnel engaged in activities such as purchasing, material handling, and production will not have access to classified material or information. Personnel engaged in test, software development, and shipboard installation and support may be exposed to classified information. Section C.3.2.6 Data Management states, "The routine use and generation of classified information is not anticipated in this contract." Rather than a blanket requirement for all personnel to hold a Secret clearance, the Government should stipulate which, if any, tasks require a clearance. The following was received from our Defense Counterintelligence and Security Agency Industrial Security Representative: "Eligibility (clearance) requirement is based off of two things, need to know and the individuals access to classified information and or classified spaces. So, you’ll need to reach out either to your company POC for the program OR the customer technical representative for the contract to determine which positions will require a clearance and what access level is required. What I don’t want to happen is you clear all individuals working on a contract, and I come to interview them and they say I’ve never accessed classified information or classified spaces. This would prove there really isn’t a need."These sections will be updated to state that "All personnel performing engineering, logistics or installation services shall be required to have a minimum DoD "Secret" clearance.
Section L.2.7 Subfactor 8 Tab H - Proposed Configuration ChangesThis section as written slants the playing field directly to the incumbent and eliminates the possibility of fair and open competition. Only the incumbent with the intimate knowledge of the AN/SPQ-15 can effectively answer this requirement to the level of detail specified. Additionally, this requirement rewards the incumbent financially. The costs associated with performing the effort required to meet the requirements of Tab H will be significant and obviously come out of the Offerors pocket. The incumbent will have to spend much less effort & resources meeting the Tab H requirements due to their “insider” knowledge. We recommend the deletion of this section as a solicitation requirement in total. This requirement is intended to show the Government how the offeror will implement Engineering, Hardware and Software changes.
Section M.3.3Section states that "evaluation factors are listed in descending order of importance." Does this same criteria apply to the subfactors under Factor 1: Technical?Yes. This is stated under the chart in M.3.3.
Section L.2.2.(11)Section states minimum font size shall be 10-point but does not specify a font type. Recommend the Government specify a font type for standardization of responses. Additionally, request clarification if the minimum font size applies to both text and graphics? This section will be updated to state the font type shall be Times New Roman and that the font size also applies to both text and graphics.
Section L.2.3Instructions state, "Proposals must be submitted electronically, via Procurement Integrated Enterprise Environment (PIEE) Contracting Communications Module to the Contract Specialist at the e-mail address listed in Block 10.C of the SF 33 in order to be considered for award." Will the Government consider changing this requirement to "Proposals must be submitted electronically, via DoD SAFE."?DoD SAFE states that it is NOT to be used for contract solicitation or proposal submission.
Section L.2.1The total page count for the Technical volume (Vol II) is 64 pages. As a non-imcumbant our proposal must address every requirement in sufficient detail assure the Government there is minimal risk in awarding the Best Value contract to a non-incumbant. This will be a significant challange to accomplish in 64 pages. Request the Government increase the Volume II page out to 100 pages. This section will be updated to 100 pages.

Section B, Pages 171 - 174There appears to be a typo in the RVC part number. Part number for the RVC should be 456012-2 not 456102-2. It’s on CLINs 1002, 2002AA-AG, 3002AA-Ag, 4002AA-AJ, 5002AA-AH, 6002AA-AG.The RVC part number is 456012-2. The solicitation will be updated.
Section B, Pages 10 - 12Should CLINs 0016-0020 read Hardware Engineering/Development instead of Software Engineering/Development? These look like duplicate CLINs (0006-0010). There are already a Software Engineering/Development CLINs 0006-0010.CLINs 0006 - 0010 are LOE Term, CLINs 0016-0020 are Completion and will also be renamed to Future Capabilities to avoid any confusion.
General QuestionWhat CLINs will be used for Travel/ODC cost reimbursements? The solicitation will be updated to include CLINs for Travel/ODC.
To what degree did the Agency consider 41 U.S.C Section 3304 and 10 U.S.C. Section 3204 when deciding to make this procurement competitive, and what was the rationale for doing so?The use of full and open competition was approved in the program’s acquisition plan after full consideration of the circumstances permitting exceptions to full and open competition cited in 10 U.S.C. 2304(c) and FAR 6.302. None of the exceptions were determined to be applicable. The agency is not required to justify its use of full and open competition pursuant to FAR 6.303-1
Has the Government taken into consideration the unnecessary cost to the taxpayer of bringing on a new contractor for this equipment (DDS TI-16 Mod 0 and Mod 1/ASDS) which is clearly called-out in 10 U.S.C. Section 3204 (b)(B)(i)?The use of full and open competition was approved in the program’s acquisition plan after full consideration of the circumstances permitting exceptions to full and open competition cited in 10 U.S.C. 2304(c) and FAR 6.302. None of the exceptions were determined to be applicable. The agency is not required to justify its use of full and open competition pursuant to FAR 6.303-1
Has the Government taken into consideration the additional risk (schedule/cost/performance) of bringing on a new contractor for this equipment (DDS TI-16 Mod 0 and Mod 1/ASDS) which is also clearly called-out in 10 U.S.C. Section 3204 (b)(B)(ii)? The use of full and open competition was approved in the program’s acquisition plan after full consideration of the circumstances permitting exceptions to full and open competition cited in 10 U.S.C. 2304(c) and FAR 6.302.
