1.0 EXECUTIVE SUMMARY

1.1 Purpose

The purpose of this Program Development Study (PDS) is to describe the scope, schedule and budget for the

Edward R. Roybal Federal Building and Courthouse Renovation and Alteration Project (Roybal FBCT R&A

Project). Design directives shall identify work items that will allow for the consolidation of court operations currently housed in Roybal, 312 North Spring Street (312 NSS), and 300 North Los Angeles (NLA).

The renovated building will provide safe, efficient and appropriate housing for occupancy of the Courts and other building occupants. The PDS serves as the technical foundation for the project’s scope of work for the

Design Build award. The PDS further serves as an information gathering and documenting effort, facilitating the Design/Build team’s early mobilization.

The PDS is a GSA-led effort prepared with the input from the various stakeholders, including the United

States Bankruptcy Court, the United States District Court, Circuit Library, Pretrial, and the United States

Marshals.

Edward R. Roybal Federal Building and U.S. Courthouse 3.0 PROJECT OBJECTIVES

3.0 PROJECT OBJECTIVES

Joseph Chow & Associates, Inc. 3.0 - 1 PROPERTY OF THE UNITED STATES GOVERNMENT – FOR OFFICE USE ONLY

3.0 PROJECT OBJECTIVES

3.1 Introduction and History

Since the early 1990s, the General Services Administration (GSA) and the federal judiciary have been carrying out a multibillion dollar courthouse construction initiative to address the judiciary's spatial needs. To plan for and make funding decisions on projects, Congress, the Office of Management and Budget, and GSA have relied on a rolling 5-year plan prepared annually by the judiciary that prioritizes new courthouse projects based on an urgency score. The urgency score is based on the year a courthouse runs out of space, the number of judges without courtrooms, security concerns, and operational inefficiencies.

The Los Angeles Courthouse was the number one priority of any project in the 5 year plan in 1996 due to the space, security, and operational inefficiencies presented by the 312 NSS and was declared a judicial space emergency in 2003. To address these concerns, GSA and the judiciary prepared a series of feasibility studies looking at different options for accommodating the Court's long-term needs. One option involved constructing a stand-alone building that would consolidate all of the court operations into a single building. GSA and the judiciary also considered constructing a companion building physically connected to the Roybal building. A third alternative that was studied involved the partial or complete demolition of an existing federal building to provide a site for a new courthouse.

After years of study and debate, these options were not selected because of cost or space limitations. GSA has selected to construct a new 24-courtroom building to house district court judges and related operations at a location approximately 6/10 of a mile from the Roybal building. Under this proposal, the judiciary would use the Roybal building for all senior district judges, magistrate judges, bankruptcy judges, and all related operations which cannot be housed in the new courthouse.

In partnership with the Ninth Circuit, Central District of California, and the AOUSC, GSA proposes to complete this design-build project. The project is required to consolidate the Court’s operations that will not be housed in the new Los Angeles Courthouse (LACH). The project scope includes only the minimum tenant improvements (TI) in Roybal that are required for this consolidation. These alterations of Roybal must be undertaken at this time to enable two concurrent projects. The reconfiguration of space is required to accommodate the consolidation to occur concurrently with the occupancy of the new LACH.

Joseph Chow & Associates, Inc. 3.0 - 2 PROPERTY OF THE UNITED STATES GOVERNMENT – FOR OFFICE USE ONLY

3.2 Project Drivers and Justification

When the new LACH is complete in 2016, the active District judges and a portion of the senior District judges and their support functions will be consolidated in the new LACH. The remaining Bankruptcy Court operations will be consolidated in the Roybal, thereby justifying the need for this project. The proposed

Roybal alteration project provides only the minimum tenant improvements required for this consolidation.

Roybal alterations are also required so court functions currently located in 312 NSS can be relocated to

Roybal. Prior to the start of construction for this project, the Court, with the assistance from AO/GSA, will vacate sufficient space to repurpose existing court spaces and provide space for the consolidation of ancillary functions. The vacation of space will be accomplished through consolidation using advanced workplace strategies including optimizing their workplace, courtroom sharing, hoteling and teleworking. Efforts shall be made to prevent disruption of official Court business, and shall require the worksite to be subject to shut-down, should activities become disruptive.

3.3 Building Operations Impacts

Impacted Client Agencies

The impacted agencies are as follows:

United States Bankruptcy Courts (USBC)

The United States Bankruptcy Courts are courts created under Article I of the United States

Constitution. They function as units of the district courts and have subject matter jurisdiction over bankruptcy cases. The federal districts have original and exclusive jurisdiction over all cases arising under the bankruptcy code and bankruptcy cases cannot be filed in state court.

United States District Courts (USDC)

The United States District Courts are the trial courts of the federal court system. Within limits set by

Congress and the Constitution, the district courts have jurisdictions to hear nearly all categories of federal cases, including both civil and criminal matters.

United States Pretrial (Pretrial)

The United States Pretrial Services System carry out pretrial services functions in the U.S. District

Courts. Through its officers and other employees, the system works to make the criminal justice process effective and the public safe.

Joseph Chow & Associates, Inc. 3.0 - 3 PROPERTY OF THE UNITED STATES GOVERNMENT – FOR OFFICE USE ONLY

Circuit Library

The United States Ninth Circuit Library serves the information needs of the circuit, district, bankruptcy, and magistrate judges. In addition, they provide assistance with legal research which is available on a limited basis to other government personnel, members of the local bar, and public patrons. Circuit libraries include work space for library staff, photocopy equipment, and study areas and computer access for judges and staff.

Owner’s Agreements

GSA owns, operates, and maintains Roybal. When planning and programming the design of the tenant relocation, a programming and planning analysis is required to determine the proposed building area provided for all tenants and adjacencies. The Design/Build Contractor shall provide building area information and coordinate the information with GSA. Once GSA and the tenants have agreed upon the agency’s square footage, GSA will issue a draft Owner’s Agreement to obtain Tenant’s Agreement upon their likely rent in the renovated building.

Tenant Relocations

During the different construction phases, displaced tenants will be located on various floors and within 300

NLA. Where feasible, the goal is to move each tenant only once. The phasing of the project shall minimize operational impacts as much as possible. The contractor shall be aware that they will be required to coordinate in advance all tenant interruptions with GSA Property Managers and the affected tenants. Some tenant spaces must remain in continuous operation such as USBC. The USBC and USDC plan court hearings

60 days or more in advance. For this project, the contractor notification period shall be a minimum 60 days.

The USBC and USDC will require a written schedule before any work can be performed, and a minimum of

60 days’ notice should there be any deviations from the agreed upon schedule.

Other Impacted Projects

The Courts will concurrently upgrade the existing telephone/data and cabling during this construction project.

The Design/Build Contractor is required to provide all infrastructure for all new telephone/data and security work as part of this project. The Design/Build Contractor is also required to coordinate the scope and construction work with the USBC and USDC contractor(s) and the USMS. The Design/Build Contractor shall provide access and schedule time to accommodate the USBC and USDC contracted contractor(s).

Joseph Chow & Associates, Inc. 3.0 - 4 PROPERTY OF THE UNITED STATES GOVERNMENT – FOR OFFICE USE ONLY

Need for Project Phasing and Off Hours Work

The building provides an important service to its constituents and must remain operational during construction; therefore, phased construction scheduling is required and all work must be done during Off

Hours so that construction does not interfere nor disrupt the normal and sensitive operations of the building.

See Section 8.0, Implementation Plan for more information.

3.4 Project Goals

The Roybal project scope is limited to the minimum work required to house the consolidated Court functions

(that are not housed in the new LACH). The courts project goals are the following:

Consolidate space using advanced workplace strategies including optimizing the workplace, sharing, hoteling, teleworking and optimizing their utilization rate.

Create new space for the Circuit Library.

Provide space for 5 senior judges, 17 magistrate judges, and 11 bankruptcy judges.

There will be efforts to create needed program space through courtroom sharing and by remodeling space previously used as courtrooms into office areas, grand jury, and assembly space. The extent of reconfiguration and alteration work will vary by courtroom and will take into account initial costs, the need for long-term suitability and operational efficiency for the repurposed uses, and will preserve the possibility that such spaces could one day be remodeled back into courtrooms should the housing requirements beyond the time frame of the renovation project support such a need. Refer to Section

10.0 Existing and Proposed New Floor Plans for additional information.

The General Services Administration (GSA) leverages the buying power of the Federal government to acquire best value for taxpayers and their Federal customers. GSA exercises responsible asset management and they deliver superior workplaces, quality acquisition services, and expert business solutions. GSA also develops innovative and effective management policies.

3.5 Pre-Design Field Investigation and Survey

The existing as built drawing information on Roybal may be insufficient or obsolete at the time of award.

There are original construction documents available for Roybal. However, not all documents are updated to the current conditions of the Building. The existing physical condition of the building requires a thorough investigation and survey by the Design/Build Contractor. The Design/Build Contractor must determine the actual condition and make sure that the design and construction submittals are based on fact. The Drawings included in this PDS are for reference only and are not for construction.
