The presurvey will be scheduled by contacting the Natural Resources contractor no less than 3 working days and no more than 5 working days before work begins. If project activities cannot be completed within two (2) consecutive days, notify Natural Resources contractor at (661) 275-1417 before work resumes for additional desert tortoise surveys.

21. The desert tortoise is a federally-listed threatened species under the Endangered Species Act of 1973 (ESA). The ESA prohibits “take” of threatened species. The term “takes” means to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect or to attempt to engage in any such conduct.

22. Open excavations of any kind created during project activities shall be secured at the end of each day by backfilling, placing a cover over the excavation, installing a temporary 412

CEG/CEVA-approved desert tortoise fence, and/or ramping excavations at a 3:1 slope.

23. Desert tortoises and their burrows shall be avoided. All project personnel shall inspect under all vehicles and equipment for desert tortoises prior to operation. Any sightings of desert tortoise within the project site must be reported immediately to the monitoring biologist or

Environmental Management at (661) 277-1417.

24. Project personnel shall use existing access roads and staging areas, and follow flagged access routes that have been surveyed or cleared of desert tortoises.

25. Habitat disturbance shall be contained to pre-disturbed areas as much as possible. No new habitat disturbance shall be conducted unless pre-coordinated with 412 CEG/CEVA.

26. Any pipes stored within the area shall be capped on open ends or elevated at least 12 inches off the ground to prevent entry by desert tortoise or other wildlife.

27. Speed limits on dirt roads within the project area shall be less than 20 mph unless otherwise posted.

28. All trash shall be contained within raven-proof (covered) containers and removed from the project site.

29. No pets or fire arms shall be allowed on the project site.

30. All project personnel shall immediately report sightings of desert tortoises or desert tortoise burrows found within the project area to 412 CEG/CEVA at (661) 277-1418.

31. Stage vehicles within previously disturbed areas. Grading shall only occur within previously graded areas. For example, no new construction of roads or widening of graded road shoulders may occur. If grading activities cannot be completed within 2 consecutive days, notify Natural Resources contractor at (661) 275-1417 at no less than 3 working days and no more than 5 working days before work resumes.

32. Personnel on site should be aware of the potential presence and dangers of coyotes, bobcats, Mojave green rattlesnakes, and other wildlife that might be living in the abandoned houses. If wildlife is inhibiting the project activities contact 412 CEG/CEVA’s J-TECH contractor for assistance.

33. Avoid creating ponding water in or near project area, so that it minimizes the attraction of wildlife, such as desert tortoise and birds, and create aircraft collision hazards or increase the potential for accidental takes.

34. Additional natural resource requirements may apply as additional information becomes available or if the scope of the project changes.

35. All drainage recontouring will be limited to the greatest extent possible to reduce habitat fragmentation, where practicable.

36. Maintenance of drainage ditches will not be altered to change the direction of stormwater runoff from existing conditions to avoid potential flooding of desert tortoise burrows downslope of maintenance activities to the greatest extent possible.
