About this file

Addendum No. 10 issued August 25, 2026, for SEPTA's Sealed Bid No. 26-00105-AJEB addresses the Traction Power Substation Rehabilitation Program Contract 5 covering Broad, Loudon, Park, and Castor Substations. The addendum maintains the proposal due date of Thursday, August 27, 2026, by 11:00 AM and must be acknowledged on Attachment 4: Addendum Acknowledgement Sheet or the bid may be deemed non-responsive. This addendum responds to three contractor questions (RFI 33-35) regarding delay compensation provisions, work suspension terms, and hazardous waste generator designation.

The addendum revises three critical contract provisions: (1) Section XI Part C now removes the "negligence" requirement for SEPTA-caused delays, allowing equitable adjustment in contract sum and time when the contractor is delayed by SEPTA, its agents, or other contractors under SEPTA's responsibility; (2) Section XI Part D revises suspension language to establish concrete thresholds—any single suspension exceeding 15 calendar days or cumulative suspensions exceeding 30 calendar days entitle the contractor to request equitable adjustment in contract sum for demonstrated cost increases including reasonable profit; (3) SEPTA confirms it is the waste generator for all hazardous materials including those covered in specifications 02080, 02081, 02082, 02083, 02084, and 02085 (beyond just specification 02205-3.03-A-6 for hazardous soils), will provide EPA ID if needed, and will revise all relevant specification sections accordingly, though the contractor remains responsible for removal and associated project costs.
