About this file

This is a Questions and Answers document for a TSA federal contract opportunity (Gold+ 70T05026R5900N005) consisting of three sets of clarifications to the RFP.

Set 3 addresses seven substantive questions covering key contract requirements. The 180-day continuity reserve will be verified during Phase 1 proposal evaluation using Financial Capability & Business Stability information, with potential annual re-certification during contract performance. CRPG (Checkpoint Requirements and Planning Guide) and PGDS (Planning Guidelines and Design Standards) are defined as comprehensive airport security reference tools; contractors will work within these frameworks for system integration and data entry. Small Business Subcontracting Plans are required only at the Task Order level in Phase 2 Track 2, with current goals of 26% small business, 5% WOSB, 5% 8(a)/SDB, 5% SDVOSB, and 3% HubZone. The Machine Availability Service Level Agreement clock begins on Day 1 after transition completion, with equitable adjustment requests considered under the changes clause. FTE monitoring will be based on established performance metrics and requirements. Foreign Ownership, Control, or Influence (FOCI) concerns are evaluated independently under 49 U.S.C. 44920(d)(3) for both prime contractors and major subcontractors. Performance metrics financial incentives and disincentives are applied monthly with invoicing; metrics are not averaged unless specified, with specific guidance provided in Attachment 41 regarding Wait Times calculations.

Sets 2 and 3 contain additional clarifications including transition-out procedures for contractor-owned equipment, insurance requirements determined at the task order level, audit frequency information provided at task order stage, Federal Cost Estimate (FCE) availability without disclosure of development elements, and personnel requirements. Key Personnel status applies at the Task Order level rather than the IDIQ level; Phase 1 proposals require only a program manager resume. TSA will issue task orders and does not restrict subcontractor relationships across competing IDIQ awardees' teams. Offerors are encouraged to submit complete solutions as prime contractors rather than teaming arrangements in Phase 1 proposals.

RFP Question TSA Response

1 Section H H.5 28 How will TSA verify the 180-day continuity reserve during proposal evaluation and contract performance? Will annual re-certification be required?

During Phase 1, TSA will assess each offeror’s ability to establish and sustain the 180‑day continuity reserve using the Financial Capability & Business Stability information provided in Volume VI. At the Task Order level, contractors will be required to identify and certify the specific reserve mechanism during Transition‑In, and TSA may request updated evidence or re‑certification during performance (including on an annual or as‑needed basis) to ensure the reserve remains sufficient and readily accessible.

2 PWS 1.5.2.3 10

Please clarify contractor roles and responsibilities regarding the Credential and Routing Program Guide (CRPG) system integration and data entry requirements.

CRPG is the Checkpoint Requirements and Planning Guide, it is the comprehensive reference for airport planners, architects, and security personnel to design and optimize airport security checkpoints. https://www.tsa.gov/for-industry/capability-acceptance-process.

PWS 1.5.2.3 10

What are contractor requirements for the Property/GFE Database System (PGDS)? Will contractors have direct system access or work through TSA personnel? PGDS is the Planning Guidelines and Design Standards, it is the comprehensive reference for airport planners, architects, and security personnel to design and optimize airport security Checked Baggage Inspection Systems (CBIS). https://www.tsa.gov/for-industry/electronic-baggage-screening.

4 Proposal Format and Submission 1.2.5.1(A) Phase 1 47, 52 If a Small Business Subcontracting Plan is required, how can an Offeror develop a Small Business Plan for Phase 1 when there is no specific subcontractor context or value for Phase I?

Small business plan is only required at the Task Order level in Phase 2 track 2. A small business plan is not required for Phase 2 track 1. The current Total Small Business goals are 26% for small business, 5% WOSB, 5% 8(a)/SDB, 5% SDVOSB and 3% for HubZone.

Does the Machine Availability Service Level Agreement (SLA) clock start Day 1 of transition or contract start of performance? Is there a grace period to achieve SLA requirements for pre-existing defects? What equitable-adjustment applies for pre-existing defects on inherited aged

TSE?

The Machine Availability Service Level Agreement (SLA) clock starts on Day 1 after transition is completed. Any requests for equitable adjustments will be considered under the changes clause.

6 I.2.6.5(c); Track 2 Factor 6

Retaining contractor FTE to support BPA orders; staffing approach must be consistent with technical and price proposal 51; 64

Will FTE be monitored and enforced by pay period or annually? Annual enforcement would permit staffing up for seasonal peaks and reducing staffing during slower periods while meeting annual coverage requirements.

TSA will monitor contractor performance against established performance metrics and requirements.

7 K.1 d

Can TSA provide additional guidance on acceptable Foreign Ownership, Control or Influence (FOCI) mitigation structures for U.S. subsidiaries of foreign-owned firms under this acquisition?

How would this apply if the company is a subcontractor, does that change anything?

TSA evaluates each waiver request independently under 49 U.S.C. 44920(d)(3). TSA reserves the right to evaluate any major subcontractors under 49 U.S.C. 44920(d)(3) and other applicable statute or regulations.

Attachment 1 (PWS); Attachment 41 (Gold Performance Metrics); cf.

Att B & Att E

Performance Metrics - 3.2 Financial incentives

22-23

(PWS)

TSA has indicated that the successful Offeror will be subject to incentive and disincentives on a monthly basis in conjunction with their monthly invoice; however TSA has not provided an explanation of how the metrics listed in Attachment 41 will be calculated so that Offerors may fully understand the requirement. As an example Passenger Wait Times, both Standard and PreCheck are measured Twice Hourly or real time. How will TSA average those measurements into a Monthly Score to determine incentive or disincentive? Will the Government please provide guidance similar to Attachments B and E that clearly lay out the math for each metric.

Given the significant financial impact of these metrics it is critical that Offerors clearly understand how their performance is being scored.

While the incentives and disincentives will be financially enforced on a monthly basis the performance based on each metric type is captured on ongoing basis. Unless otherwise specified the metrics are not averaged. As specifically related to the Wait times please see Attachment 41.

9 Performance Work Statement 1.7.1.2 Transition Out 18 How will the Transition Out of Contractor owned EDS be performed, as a replacement Inline EDS units typically take multiple years to procure, build, install, integrate, and test?

TSA will review transition out plans between the outgoing and incoming parties to insure they address timing, coordination, and collaboration to prevent any disruption to ongoing operations. If key screening equipment is owned by the Offeror, TSA may require a phased transition and close coordination between all parties to maintain continuous security screening services throughout the equipment removal and replacement process.

10 SF 1449 Section C 7 of 84 What are the insurance requirements for the Phase I Track 1 pricing purposes ?

Insurance levels are determined at the task order level per airport. There are no insurance requirements for Phase 1, Track 1.

11 SF 1449 Section E.2 14 of 84 Will the Government provide their anticipated frequency and duration of Audits in the Task Order RFP in order to price support for these activities effectively ?

TSA will provide information at the task order level regarding frequency and duration of audits. Information is also provided in Attachment 41 Gold+ Performance Metrics.

12 SF 1449 Section H.6 28 of 84

Will TSA provide a planning factor or a general timeline for fitness determination for Contractor personnel requiring access to TSA Facilities, information systems, and or CUI to be utilized in the preparation of pricing models for Track 2 and future TOs ?

See Section H.6, “CONTRACTOR PERSONNEL ACCESS TO TSA FACILITIES, INFORMATION OR

SYSTEMS,”

13 SF 1449 I.2.7.2 59 of 84 based on TSA's interpretation of this statute, screening companies are required to provide compensation (direct wages and other benefits) to all private security screeners that is not less than the compensation afforded to federal security screeners by TSA." "ATSA also requires that the offered contract price be equal to or less than the cost to the Federal Government to provide screening services at the airport. The Federal Cost Estimate (FCE) is specific to each individual airport and developed just prior to solicitation release for the entire potential period of performance for the upcoming task order. A proposed total price that is higher than the FCE will receive an unacceptable rating for the Price factor and will be ineligible for award. " Given these conflicting requirements will the Government share the elements they will utilize in addition to labor costs to build up their FCE so we can understand what areas we can focus on in order to deliver the desired savings from this effort ?

TSA will provide the FCE however it does not intend to share elements used to develop the

FCE.

14 Section B B.2 5 Can airports initiate Task Orders for specific capability areas only (e.g., testing only, technology only) without requiring a full turnkey solution?

No, airports cannot initiate task orders. TSA reserves the right to issue task orders for less than a full turnkey solution.

15 Section I 52.212-2 44 Is TSA expecting or encouraging offerors to identify teaming partners in their Phase 1 proposals, and will teaming arrangements be evaluated as part of any factor?

Offerors are encouraged to offer a complete solution in the Phase 1 proposals. Offers should be submitted by the prime contractor entity.

16 Section I 52.212-2 44 Can a company that is a subcontractor on one IDIQ awardee's team also be a subcontractor on a competing IDIQ awardee's team for the same Task Order? Yes. TSA does not intend to dictate subcontractor or partnership relationships.
