About this file
This is a Non-Collusion Affidavit required for bidding on the Upper Makefield Township 2026 Road Program in Pennsylvania. The affidavit is a sworn statement that must be executed by an authorized representative of the bidding contractor, certifying that the bidder has not engaged in any collusion, conspiracy, or anti-competitive practices related to the proposal submission. The document confirms that all statements in the proposal are true and correct, and that Upper Makefield Township may rely upon these representations in awarding the contract. The affidavit also requires disclosure of any convictions or liability findings within the past three years involving conspiracy or collusion with respect to bidding on public contracts, though such history does not automatically prohibit bid acceptance but may result in administrative suspension, debarment, or discretionary contract rejection based on lack of responsibility.
The affidavit further warrants that no intermediaries, sales agencies, or commission-based representatives have been retained to solicit or secure the contract except for bona fide employees or established commercial agencies of the contractor. The document must be signed before a notary public and includes standard certification fields for the notary's seal, commission expiration date, and execution date. This affidavit is a standard requirement for state and local construction contract bidding in Pennsylvania and serves as a compliance mechanism to ensure competitive integrity in the procurement process.

A person's affidavit stating that the person has been convicted or found liable for any act, prohibited by State or Federal law in any jurisdiction, involving conspiracy or collusion with respect to bidding on any public contract within the last three (3) years, does not prohibit a governmental agency from accepting a bid from or awarding a contract to that person, but may be a ground for administrative suspension or debarment at the discretion of a governmental agency under the rules and regulations of that agency, or, in the case of a governmental agency with no administrative suspension or debarment regulations or procedures, may be a ground for consideration on the question whether such agency should decline to award a contract to that person on the basis of a lack of responsibility.
