About this file

This is a Design-Build Standard Form Agreement between the Town of Palm Beach, Florida, and a Design-Builder for the Mid-Town Seawall Replacement Project. The project involves the design and construction of a new seawall approximately 2,700 linear feet along South Ocean Boulevard between Gulfstream Road and Royal Palm Way. The seawall will be constructed east (seaward) of the existing structure, which dates to the early 1900s and has reached the end of its useful life. The scope includes work within the Town's right-of-way, Town-owned property, and areas seaward of the coastal construction control line. A mandatory pre-proposal meeting and site visit were held on March 31, 2026, at 10:00 AM EST at the Public Works Building, with the site visit meeting point at the Worth Avenue Clock Tower. Substantial completion is required within 335 days from the Notice to Proceed, with final completion required within 30 days thereafter.

The contract is structured as a stipulated sum agreement with a contract sum of $2,369,876.34, subject to additions and deductions as provided in the Design-Build Documents. Progress payments are made monthly based on applications for payment, with a five percent retainage on work excluding design professional services, payable within 45 days of application submission. Liquidated damages of $500 per day apply for each day the Design-Builder fails to meet the Substantial Completion date and Final Completion date. The Design-Builder must provide performance and payment bonds and comprehensive insurance as detailed in Exhibit C. Key consultants include Ohlson Lavoie Corporation (Architect), RGD Consulting Engineers (Structural and MEP Engineers), and Greenbuilt Solutions LLC (Sustainability Consultant). The Town's Design Criteria Professional is Synalovski Romanik Saye, LLC. Dispute resolution is through litigation in Palm Beach County, Florida, with each party bearing its own attorney's fees and costs. The agreement is subject to fiscal funding appropriation under Florida law.
