Request For Information Government Responses Amendment 01:

Q1. GENERAL QUESTION: Of the four technical factors, only Factor 3 Management Approach has a page limitation of 50 pages. Are there page limitations to the other three technical factors: FACTOR 1 EXPERIENCE, FACTOR 2 PAST PERFROMANCE or FACTOR 4 DESIGN CAPABILITY?

A1. In accordance with the solicitation there are no page limitations to technical factors: Factor 1 Experience, Factor 2 Past Performance, and Factor 4 Design Capability. There is a limitation of 50 pages for Factor 3 Management Approach.

Q2. GENERAL QUESTION: Are there any Design or Construction firms which are excluded from participation?

A2. In Accordance with FAR 36.209, the contract will not be awarded to any firm or its subsidiaries or affiliates that prepared the 35% design. Furthermore, award will not be made to any firms that are currently excluded from working with the U.S. Federal Government.

Q3. Paragraph 1.1.1.1.1.1.7 FACTOR 3: MANAGEMENT APPROACH; (page 43 of 161) states: “NOTE:

Maximum allowable page limit for Factor 3 Management Approach is 50 pages. Any additional pages over 50 will not be evaluated by the government.” This paragraph goes on to further require the inclusion of Attachment 4 "Resume Forms" for four (4) identified Specifically Identified Personnel as well as for all key subcontractors signed letters of commitment in this factor.

QUESTION: Do the resume forms and signed letters of commitment count against the 50 page limitation for

MANAGEMENT APPROACH?

A3. Please see Solicitation Amendment 01 SF 1442 Section 00 21 00 Instructions “Instruction to Offerors” under Factor 3 Submission Requirements. The following has been added: “The Organization Chart, Resumes, and Letters of Commitment shall not count towards the 50 page maximum for this Factor.”

Q4. Paragraph 4.1.1.1.3 FACTOR 1: EXPERIENCE: Subparagraph 1 a. (page 50 of 161) states: All projects submitted shall demonstrate work experience performed within Romania or the European Union (EU).

QUESTION: This criteria is overly restrictive and prevents firms with significant US/worldwide DoD/USACE design/build construction management experience from submitting a competitive proposal. It appears this will significantly reduce competition and/or lead to potential proposers' protests? We recommend that this criteria be changed to allow all world-wide DoD/USACE project experience that meets the other criteria requirements.

Subparagraph 4. already states “Projects demonstrating experience in Romania are considered more relevant.” This would seem to appropriately recognize local performance.

A4. Please see Solicitation Amendment 01 SF 1442 Section 00 22 00 Supplementary Instructions “Instruction to Offerors” under Factor 1 Experience. The language has been changed.

Q5. Paragraph 4.1.1.1.3 FACTOR 1: EXPERIENCE: Subparagraph 1. d. (page 51 of 161) states: “Projects consider relevant shall be completed within the last six (6) years from the date of the solicitation or at least 50% complete by the date of the solicitation.” Subparagraph 4. Also states “Projects older than six (6) years may be considered but will be considered less relevant.” Paragraph 4.1.1.1.5 FACTOR 2 : PAST PERFORMANCE states: Past Performance will be evaluated for projects completed in the last five (5) years from the date of the solicitation”

QUESTION: Should the Past Performance statement be "from the last six (6) years before the date of the solicitation" to match the EXPERIENCE statement?

A5. Please see Solicitation Amendment 01 SF 1442 Section 00 22 00 Supplementary Instructions “Instruction to Offerors” under Factor 2 Past Performance. The language has been changed from “…the last six (6) years from the date of this solicitation….” To “…the last five (5) years from the date of this solicitation….”

Q6. Will there be an extension to the due date? Currently, the proposals are due June 9th which is 3 days after the site visit that is schedule on June 6th. The solicitation also requires all questions from the site visit to be submitted in writing. I would like to propose a 4 week extension to the current due date considering the number of questions expected on a RFP of this size, time required for USACE to provide answers/clarifications/updates to the site visit written questions, and the additional time needed for contractors to incorporate those changes/clarifications/updates resulting from the site visit written questions.

When is the cut off to submit RFI’s to USACE on this solicitation?

A6. Please see Amendment 01 SF 1442 Block 13A Proposal Due Date is Extended to no later than 15:00 Central European Summer Time (CEST) 15 June 2017. Please see Solicitation Amendment 01 SF 1442 Section 00 21 16

Instructions to Proposers RFI Amendment 01 – Establishes a Request for Information due date of no later than 08 June 2017 at 1400hrs Central European Summer Time (CEST).

Q7. We will have a rental vehicle for the site visit, so the vehicle details are unknown to complete the Commercial Vehicle Access Form. Will there be transportation options provided by the base/USACE onto MK Airbase for the site visit, or can we submit the Commercial Vehicle Access Form to MK Airbase security on the day of the site visit?

A7. The Commercial Vehicle Access form is not required. Site Visit Attendees will meet at the designated location illustrated on Attachment 7 Camp MK Location provided in the solicitation. Transportation will be provided from the meeting point to the site.

Q8. Solicitation, SF1442, Block 10. Block 10, Item 3, states, “Proposals are due on 09 June 2017 by 15:00 Hours Central European Summer Time (CEST).” However, as the Pre-proposal Site Visit and Briefing is to be held on 06 June 2017 additional time will be needed to fully review the information provided at the site visit and to prepare reasonable technical and cost proposals. Please advise if an extension to the proposal due date can be granted.

A8. Please see Amendment 01 SF 1442 Block 13A Proposal Due Date is Extended to no later than 15:00 Central European Summer Time (CEST) 15 June 2017.

Q9. Is there a deadline for questions and what should we expect as the turn-around time for responses to questions submitted?

A9. Please see Solicitation Amendment 01 SF 1442 Section 00 21 16 Instructions to Proposers RFI Amendment 01

– Establishes a Request for Information due date of no later than 08 June 2017 at 1400hrs Central European Summer Time (CEST).

Q10. Section 00 21 00, 4.1.1.1.3 FACTOR 1: EXPERIENCE, Item 1, paragraph d (page 51), states that projects considered relevant shall be completed within the last six (6) years from the date of the solicitation; 4.1.1.1.5 FACTOR 2: PAST PERFORMANCE (page 53) states that past performance will be evaluated for projects completed in the last five (5) years from the date of the solicitation. Please clarify if relevancy is five years or six as this impacts both Factors 1 and 2.

A10. Please see Solicitation Amendment 01 SF 1442 Section 00 22 00 Supplementary Instructions “Instruction to Offerors” under Factor 2 Past Performance. The language has been changed from “…the last five (5) years from the date of this solicitation….” To “…the last six (6) years from the date of this solicitation….”

Q11. Section 00 21 00, FACTOR 5: PRICE, Item 6 (page 47) states “Executed Bid Bond or Bank Letter of Assurance (to be submitted hard copy, notarized original); and a copy of the agent’s authority to sign bonds/BLA for the surety company shall accompany the bid bond/BLA.” Since submission is to occur via AMRDEC, please provide instructions on submitting the required hard copy of the Bid Bond or Bank Letter of Assurance.

A11. Please see Solicitation Amendment 01 SF 1442 Section 00 21 00 Factor 5: Price Item 6. Line six has been updated to read:

Executed Bid Bond or Bank Letter of Assurance (to be submitted hard copy, notarized original via delivery service to the address below); and a copy of the agent’s authority to sign bonds/BLA for the surety company shall accompany the bid bond/BLA. The Executed Bid Bond or BLA shall also be provided as a copy along with the electronic proposal. The hardcopy must be delivered prior to the proposal due date.

Various Base Improvements Mihail Kogalniceanu Air Base, Romania Amendment 02

Q13. Page 15 of 34 mentions “The DELTA Taxiway should be provided to permit the safe and expeditious surface movement of aircrafts. Thus, the taxiway will have L = 200.00 m W = 22.50m (according to UFC 3-260-01 Airport planning design and B1-SC-85-5 page 40 – width of Taxiway” Drawings (and all calculations) show:

W = 18.00 m Please clarify.

A13. Please refer to article 2.4 CA-2: Fixed Wing Taxiway, 2.4.1 Fixed Wing DELTA Taxiway – Taxiway pavement design input, from Design Analyses document page 17 from 33, where at paragraph 2 has been specified the characteristics of the pavement grades and geometrics that should be in accordance with ETL 97-9, Bi-SC D 85-5, NATO Approved Criteria and Standards for Airfield, meaning that the width of the Taxiway DELTA should be 18m.

Q14. Page 15 of 34 mentions “The site will be cleared and prepared to the point of rough grading by the Romanian government in advance of construction” that means decontaminations too. Do the MOD will provide a report for decontamination?

A14. The SOW states the following, "The Contractor is required to notify of critical issues that may affect the contract performance and/or human health and the environment. The types of issues that require notification include, but are not limited to, health risks, spills, changes in critical personnel, and finding unexploded ordnance (UXO)."

Q15. If the MOD will not provide a report for decontamination, must the contractor to estimate the cost for site investigations and soil contamination report?

A15. The DB contractor must provide an estimate for an environmental and geotechnical survey at the proposed construction sites. This will be part of the design effort and the Host Nation approval process to obtain an Urbanism Certificate.

Q16. Is the area dedicated for construction of the Multimodal Improvement Ready building area (≈14000 m2) cleared and decontaminated?

A16. The area is cleared of unexploded ordinance and graded. No environmental remediation was applied.

Q17. Are there equipped spare cells (switchgears) in the existing 20 kV electrical substations located on TFOS and

PFOS?

A17. There are no spare cells installed in the existing 20 kV network.

Q18. What is the distance from the existing 20 kV electrical substation located on TFOS/PFOS to the new 20/0.4 kV Transformer Station?

A18.Please refer to the General Electrical Installations Layout GE001, W912GB-15-D-0011-0002, 03/04/2017, in the General Notes table is an approximate length of the MV lines from the last manhole in the southwest of the roundabout to ETS1 (approx.. 320m) and to ETS2 (approx. 600m) respectively.

Q19. Should the local norm I7-2011 be used for the grounding system of the Fuel Storage Capacity? I7-2011 has specific requirements for hazardous areas?

A19. Where applicable and not contrary to U.S. norms and standards local norms can be applied. It must be checked which is the more stringent one and required to obtain the Host Nation approval for the Urbanism Certificate.

Q20. In the RFP specification section 01 45 01 Quality Control Part 3.2.1.a states that Construction Quality Control (CQC) system manager reports to the project superintendent. CQC system manager usually reports to an officer in the headquarter office not to a site personnel. Please confirm who CQC will report to.

A20. This is our internal construction spec so the language should be left as stated in the spec. The spec states the CQC manager should report to the superintendent.

Q21. In the Price schedule document, in item 2001CB, it is written that there are 2 Tanks 1,419M Liters / 375.000 Gallon each, whereas in Attachment A-Design Analysis report in FSC part item 2.2.1 Fuel Tanks Storage, fuel tanks are given as 2x1.893M Liters / 500.000 Gallon each. Please confirm the required fuel tank volume.

A21. The capacity of the Fuel Tanks will be 1.893M Liters / 500.000 Gallon each. Please see revised Price Schedule dated 24 May 2017 that is attached with this solicitation amendment 02.

Q22. Section 00 70 00, FAR 52.236-1, states that the Contractor shall perform on the site, and with its own organization, work equivalent to at least 25% of the total amount of work to be performed under the contract. How is the 25% to be calculated? Is it based on the total overall cost of execution (including field office overhead) minus home office overhead, profit and bonding cost?

A22. Contract clause 52.236-1 has been included in the contract to assure adequate interest in and supervision of all work involved in the completion of this project by the Prime contractor. The contracting officer has discretion in calculating the percentage performed by the Prime contractor, however, generally speaking the calculations will be based on the number and value of activities assigned to the Prime contractor in the schedule submissions and updates.

Q23. Section 00 70 00, FAR 52.236-1. This clause states that the Contractor shall perform on the site, and with its own organization, work equivalent to at least 25% of the total amount of work to be performed under the contract.

We interpret "work" to mean physical work activities, involving any of the trades required to directly place the construction required by the contract. It also includes physical activities that directly support the work, such as: (1) warehousing; (2) maintenance of equipment; (3) procurement and transportation of supplies or construction materials to the site for use by the contractor; (4) procuring, transporting and providing equipment for use by the contractor; (5) logistical activities that directly support the contractor's employees; and (6) similar activities. Please confirm our interpretation.

A23. Please see Question 22.

Q24. Section 00 70 00, FAR 52.236-1. This clause states that the Contractor shall perform on the site, and with its own organization, work equivalent to at least 25% of the total amount of work to be performed under the contract.

We interpret "on site" to mean the area within the construction limits depicted or described in the contract drawings or specifications. Activities such as transportation, maintenance and logistics that take place outside of the construction limits depicted or described are still "on the site," if in direct support of activities within the construction limits. Please confirm our interpretation.

A24. This interpretation is correct.

Q25. Section 00 70 00, FAR 52.236-1. This clause states that the Contractor shall perform on the site, and with its own organization, work equivalent to at least 25% of the total amount of work to be performed under the contract.

We interpret "its own organization" to include, consistent with the definition of "contractor" in FAR 44.101, work performed by an affiliate to the prime contractor. Please confirm our interpretation.

A25. The work must be performed by the prime contractor, not an affiliate.

Section 00 70 00; Due to time constraints, we have not been able to obtain commitments from subcontractors to attain competition to the maximum practical extent as required by the conditions of the contract reference FAR 52.244-5 Competition In Subcontracting, therefore, it is requested that the proposal due date be extended to 30 June 2017.

A31. Proposal Due Date is extended to 13 July 2017. See this Amendment 04 for details (Note: Proposals due time has also changed from 15:00 hours to 10:00 hours Central European Summer Time).

Q32. An Entrance Gate was shown on the key plans, and it was coded as M1.8, however we could not locate any explanation in the Design Analysis Report and other related documents. Is it only a gate, or will there be an Access Control Facility. More information is required about the gate and suggested control activities.

A32. The proposed gate has to fulfill AT/FP and UFC requirements as outlined in the scope. It is a gate only, not an Access Control Facility. In addition coordination with the Command Safety Officer from the Romanian MOD is needed to ensure site specific operating accessories, warning devices, and safety systems. Gate operation guidance is provided in UFC 4-022-01.

Q33. In paragraph 2.2 of the Design Analysis Report of the Cargo Apron, it states that the site will be cleared and prepared to the point of rough grading by Romanian Government. Under these circumstances the topographical survey works should be conducted after the completion of the clearing and grading works. What is the estimated period of works that will be conducted by the Romanian Government? Their schedule may have an impact on the schedule of the topographical survey, consequently on the design and the construction works.

A33. We are currently working with the local representative to get a schedule for the completion of this work by the Romanian Government. Some site preparation by the Romanians have already been completed.

Q34. On sheets GP003 thru GP005, the sanitary sewer network was shown to run under the road. This solution may lead to future maintenance and traffic flow problems. Is it possible to relocate it to clear the road and run it in native soil after the shoulder?

A34. The design is based on the current site layout and available space. If the relocation of the sewer lines is feasible and in accordance with related UFC and Host Nation requirements, the future D/B Contractor may propose such a modification in the design.

Q35. The suggested roof solution and roof structure of the building may make it hard to get the LEED credits. Is it possible to suggested different systems that would be more convenient for the climate and architectural solutions?

A35. The general concept and the geometry of the roof will not be altered in any way. The only acceptable change for improvement refers to possibly superior insulating materials and their performances, an improved solution/material for the translucent area of the roof (and the associated hatch) as well as the joints and connection details.

Q39. We understand that, as requested by the Design Analysis for the Ready Building, Anti-terrorism and Force Protection (AT/FP) requirements referring to UFC 4-010-01 will be applicable for the curtain wall. Please confirm.

A39. Yes this is correct

Q40. For the new apron and taxiway, Airfield Lighting Vault (ALV) location and SOW requirements are not clear.

ALV would normally require control connections to the existing Air Traffic Control Tower (ATCT) . Please clarify the SOW intent for ALV and interconnection to ATCT.

A40.The proposed tap in point is located at the Ops Building situated at the Helipad. The successful offeror needs to verify the location of the connectivity.

Q41. Electric Utility Connection of this project to an existing MK-FOS 20kV ring system substation would require a 20kV feeder breaker cubicle to be available as spare at the existing substation MV Switchgear Lineup. Please verify the existence of this spare cubicle.

A41. A spare cubicle is not situated at this location.

Q42. For the Ready Building (Drwg A009 and A010): Can we change the structural solution: From: In situ RC foundation pads + steel cross columns with foam in-situ Core to: Precast concrete solution for foundation pad & column, with the similar external dimension for the column and keeping the same structural grid of 10x10m?

A42. The proposed solution is acceptable for the foundation pad (required that all applicable norms are respected), but not for the columns. The columns, beams and other superstructure elements shall be designed and executed according to the tender design released.

Q43. For the Ready Building (Drwg A007)- Can we change the ground laid slab reinforcement: From: Upper and lower reinforcement on both directions as per the drawings To: Steel Fiber Reinforcements. – This is a generally used solution on ground laid concrete slabs in industrial and commercial applications in Romania and Europe.

A43. The solution is acceptable provided that the norms and regulations for floating slabs (with deepened and reinforced perimeters) are respected.

Q44. For the Ready Building – Can we change the structural type of the roof however keeping the same idea and geometry?

A44. The roof structure (concept and geometry) will not be altered excepting for minor adjustments resulting from the detail design process/calculation in order to comply with all norms and regulations in force.

Q45. For the Ready Building - Buried Fire Water Tank together with the pumping station: - Can the Tank be moved to above ground and can they be relocated on the site?

A45. The Fire Tank has been buried due to AT/FP restrictions (set back required from the building, visibility and accessibility constraints etc.) AT/FP requirements described in the UFC regulations are to be followed and the technical solutions must be designed accordingly in order to meet antiterrorism standards for buildings.

Q46. Foam extinguishing is required for Fuel Tank storage and Airplanes. Since a foam system is not in the contract documents can we assume we only provide the water hydrants and tank and foam is provided by firefighting trucks with foaming agents that connect to the hydrants or use their own water reserves?

A46. Firefighting measures are currently provided by the Romanian MoD and the Civilian Airport. An additional foam system is not part of this contract.

Q47. Is it allowed to use precast RC elements for the retention wall (Drwg CX200) of the railway unloading platforms?

A47. Due to the expected weights and dynamics at the loading platform pre-cast elements are not feasible.

Q48. What level (if any) of a LEED certification is required for the Ready Building?

A48. The target is LEED Silver.

Q49. Can we have an alternative heating and cooling solution for the Ready Building – replacing the VRVs (M-drawings) with a different type of system?

A49. The VRV solution has been chosen due to the following:

- It is a compact integrated solution (provides heating and cooling in the same time), not requiring extensive technical space dedicated to it as other solutions are likely to need;

- The electric supply was considered the most viable solution since other potential sourcing (gas/water) is not available.

The VRV solution will therefore be kept.

Q50. Can Performance Bond requirements be changed to 30% of the awarded Contract Amount similar to the BLG percentage amount?

A50. No.

Q51. Can the BLG amount be reduce to 10%? That is usually the maximum percentage for BLGs required in Romania.

A51. No.

Q52. Due to difficulties in obtaining the BLA/Bid Bond a few days before the Proposal Due date in time to mail it to Europe District by the Proposal due date, I request that the BLA/Bid bond be uploaded with the proposal by the due date and the hard copy be received in the USACE Office by 3 business days AFTER the proposal due date.

A52. See Amendment 04 the BLA hardcopy requirement of submitting the no later than proposal due date has been changed to BLA hardcopy must be submitted and received in the government office no later than 5 calendar days after the proposal due date. Furthermore, firms are reminded that they shall also include a digital copy of the BLA in their electronic proposal submission.

Q53. RFP Solicitation page 150 of 161. The RFP states: “The Romanian MOD will review both the 65% and 100% design submittals with a review time of 120 Calendar Days for EACH review.” Should the 100% submittal be the 95% submittal in this sentence? Can the MOD review time be shortened to 45 calendar days?

A53. The Romanians will review at the 100%. Their review will be 120 days.

Q54. Will USACE have site offices located at the laydown area? If so, please clarify the details of the site offices.

A54. As per specification 00 73 15.01 the contractor is to provide trailers for the government.

Q55. Q23 / A23 Section 00 73 00; The Government's response to Q23 states that "work" is defined as labor to meet the 25% performance of work requirement. To maintain compliance with host nation labor regulations and legislation, please clarify if the use of temporary labor agencies providing workers to perform on-site activities, under the direct supervision of the Prime Contractor, qualifies to meet the 25% performance of work requirement.

A55. No.

Q56. Is it possible to mail the hardcopy of the bank letter of assurance at the proposal due date (June 15)? USACE would probably receive the letter next day. We can e-mail the WAYBILL document for proofing.

A56. See RFI Answer 52.

Q57. Since Romania is not a DBA exempt country, will we need to purchase DBA Insurance for every Romanian worker on the construction site, even if they have Romanian Worker’s Insurance through their company.

A57. Yes.

Q58. With the combination of all three projects into one solicitation resulting in an estimated range of $25-$100 million, this presents a bid guarantee / bond difficulty. With a 30% bid guarantee/bond requirement and a maximum $100 million requirement, this means a company must come up with the $30 million bid bond or letter of credit which is very difficult for any company. Since the purpose of a bid guarantee as to ensure either the signing of the resultant contract and receipt of payment and performance bonds, or cover the cost of securing a follow-on contract if the selected proposer is not able to provide the required bonding, it appears that the amount of the bid guarantee could be reduced to the range of 1 to 5% which would still be $1-$5 million and would probably cover any re-solicitation / contract execution costs. Please consider reducing the amount of the bid guarantee from the now stated 30% of the bid price to 1 to 5%?

A58. The BLA and BLG percentages remain unchanged.

Q59. As the actual Site Visit scheduled for the 6th of June was not able to be carried out and potential Offerors were not able to access the Base and observe the site conditions due to circumstances not in the control of the Offerors, will a subsequent Site Visit be scheduled? If so when?

A59. Yes, see solicitation Amendment 03.

Q60. Will the time period for questions be extended in light of the inability to visit the as originally scheduled on June 6th to at least two days following a subsequent scheduled Site Visit?

A60. Yes, see solicitation Amendment 03.

Q61. Will a list of those attempting to visit the site on June 6th and attending the Proposal Conference Meeting that was held at the meeting point be released?

A61. Yes, see solicitation Amendment 03.

Q62. Is experience in Romania considered more relevant than experience in the European Union?

A62. In accordance with the evaluation criteria under Factor 1 Experience Projects demonstrating experience in EU and/or Romania are considered more relevant. These characteristics do impact relevancy; however, in no order of importance.

Q63. If the Bidder is a Joint Venture, the Bank Letter of Assurance/Bid Bond has to be in the name of the JV or can be divided between the partners of the Joint Venture?

A63. It must be in the name of the Joint Venture.

Q64. Section 00 21 00 – INSTRUCTION TO OFFERORS Criteria for evaluation factors 4.1.1.1.3 Factor 1:

Please clarify if each project presented should be within the range of 5,000,000 Euro and 40,000,000 Euro, or all projects together can be in this range?

A64. Each project shall be in the range of €5,000,000.00 and €40,000,000.00.

Q65. According with point 1.1.1.1.1.1.5 Submission Requirements from Factor 2: Past experience : „Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.”

From our understanding, you will consider these reference projects without being necessary to present PPQs previously submitted for other RFPs. Please confirm if our understandig is correct and please clarify how you will evaluate these projects?

A65. All offerors shall submit a PPQ for each project submitted under factor 1 Experience for this solicitation. The Government reserves the right to review PPQs submitted for other solicitations to help with its past performance evaluation.
