INSTRUCTIONS TO OFFERORS

SECTION II

SOLICITATION PROVISIONS

A. PROPOSAL SUBMISSION REQUIREMENTS, EVALUATION CRITERIA AND BASIS FOR

AWARD (Section 00 22 00)

The requirements for the preparation and submission of proposals and the requirements for the evaluation of proposals in response to this solicitation are contained in the Request for Proposal. This acquisition will be procured in accordance with 10 U.S. Code § 2862 - Turn-key selection procedures. Subject to the provisions contained herein, the award will be made to one (1) Offeror in accordance with who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, represents the Best Value to the Government as judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation,. This source selection approach, called Best-Value Tradeoff, includes an evaluation of five (5) factors: Experience, Past Performance, Management Approach, Design Capability and Price.

Experience contains a pass/fail element. The Offerors must submit at least three (3) projects that they (the offeror) performed as the prime contractor. In case of a Joint Venture (JV) proposal, the work must have been performed by at least one of the JV partners. Offerors who do not meet that minimum requirement are not eligible for award.

Once a proposal is rated “Pass” for this aspect, the relative weight of the evaluation factors is as follows: Experience is significantly more important than Past Performance, Past Performance is significantly more important than Management Approach, and Management Approach is significantly more important than Design Capability. When the four (4) non-price factors are combined, they are approximately equal to Price.

The Government reserves the right to award to other than the lowest proposed price. The greater the equality of technical proposals, the more important price shall become in selecting the Best Value to the Government.

Unreasonably high proposed prices may be grounds for eliminating a proposal from the competitive range. The awarded contract will incorporate the successful offerors proposal to the extent it does not conflict with the solicitation requirements.

B. FACTORS TO BE EVALUATED

The following evaluation factors will be used to evaluate each proposal: Award will be made to the Offerors whose proposals are the best value to the Government based upon an integrated assessment of the evaluation factors. IAW FAR 15.304, the following factors will be considered in evaluating the proposals:

Factor 1 – Experience Factor 2 – Past Performance Factor 3 – Management Approach Factor 4 – Design Capabilty Factor 5 - Price

C. EVALUATION APPROACH

The overarching evaluation approach for all factors is as follows:

Adequacy of Response. The proposal will be evaluated to determine whether the Offeror’s methods and approach have been adequately and completely considered, defined, and satisfied the requirements specified in the solicitation. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the solicitation.

Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which the Offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

D. DISCUSSIONS

1. GENERAL INFORMATION: The Government does not intend to hold discussions. However, in accordance with FAR 15.306(d), discussion sessions with each Offeror may be held. Should discussions take place, all Offerors in the competitive range will be allowed to submit Final Proposal Revisions.

2. DISCUSSION SCHEDULING: If discussions are conducted, the Contracting Officer may conduct discussions orally, in writing, etc. The method for discussions will be at the discretion of the Contracting Officer. The Contracting Officer will provide additional instructions with the notification.

E. CRITERIA FOR EVALUATION FACTORS

FACTOR 1: EXPERIENCE

1. The Government will evaluate the depth and the relevancy of the experience as submitted in the offeror’s proposal in accordance with the following criteria:

a. All Projects submitted shall should demonstrate work experience performed within Romania or the European Union (EU).

b. Experience managing multiple projects performed simultaneously with phased deliverables scheduled within a contiguous site.

c. Projects with minimum cost of €5,000,000 and a maximum cost of €40,000,000. Offerors may submit higher valued projects if there is a scope of work with a measurable performance period and measureable monetary value within a larger project that is relevant to this procurement, including a clear breakdown of all project costs, especially the portion being submitted for consideration. Offerors shall clearly describe this project and how it related to the overall contract.

d. Projects considered relevant shall be completed within the last six (6) years from the date of the solicitation or at least 50% complete by the date of this solicitation. If a project is not yet complete, the Offeror shall list the scheduled completion date as well as the project’s current completed percentage.

2. Projects submitted for consideration, which meet the above parameters, shall include experience in the following areas:

a. Airfield runway, airfield taxiway and/or aircraft parking apron new construction

b. Construction of a rail spur with railhead and supporting infrastructure

c. Installation of above ground aviation fuel storage and delivery systems minimum capacity 500,000 gallons and supporting infrastructure (Fuel delivery and collection)

d. New Construction of facilities (buildings) of size ranging between 1000 SM and 2000 SM, including major building systems such as electrical, mechanical, structural, storm drainage, sanitary sewer, and other supporting facilities. Facilities constructed within an active airfield shall be considered more relevant than other facilities.

3. The Offeror must have directly performed at least three (3) of the five (5) projects submitted for experience as the Prime Contractor. In case of a JV, the work must have been performed by at least one of the JV partners.

Offerors who do not meet this requirement are not eligible for award.

4. The Offeror must have directly performed at least two (2) of the five (5) projects submitted for experience as Design Build. The Offeror must describe the nature of the Design-Build element of the project. For example:

The project was awarded as a 35% design package, and the Offeror demonstrates that they were responsible for completing the 100% design of the project as well as the construction. Offerors who do not meet this requirement are not eligible for award.

The following characteristics will impact relevancy (in no order of importance):

Offerors demonstrating experience with multiple projects in multiple trades are considered more relevant.

Offerors demonstrating experience with USACE and/or DoD are considered more relevant.

Project examples that demonstrate experience by the Offeror working with proposed Key Subcontractors are considered more relevant than projects performed by Key Subcontractors in which the Offeror did not participate. In the case of experience through JV partnerships, experience in which the JV partners worked together is considered more relevant than experience in which only one of the JV partners performed without the other JV partners.

Projects outside the cost range will be considered less relevant. Smaller projects bundled into a larger project in order to meet the cost element are not considered relevant.

Projects older than six (6) years may be considered but will be considered less relevant.

Projects demonstrating experience in Romania are considered more relevant.

Projects demonstrating experience in EU are considered more relevant.

Projects completed outside of Romania or the EU may be considered less relevant.

The adjectival ratings for FACTOR 1: EXPERIENCE are listed and defined below:

Technical Ratings

ADJECTIVE DEFINITION

OUTSTANDING Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

GOOD Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

ACCEPTABLE Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

MARGINAL Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

UNACCEPTABLE Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable.

Proposal is unawardable.

The adjectival ratings, defined below, are not separate ratings, but will be used to define the levels of risk in the aforementioned table.

Technical Risk Ratings

Adjectival Rating Definition
