About this file

This is a permit modification document issued by the U.S. Army Corps of Engineers (USACE), Jacksonville District, to the Brevard County Natural Resources Management Department regarding authorization for dredging activities in Sykes Creek, Florida. The document reverifies a previously authorized activity involving the removal of 642,000 cubic yards of organic sediments from canals and borrow areas via hydraulic and/or environmental clam shell dredging. The project encompasses 162 acres within the Sykes Creek/Barge Canal waterbody located north of East Merritt Island Causeway in Brevard County, Florida. Associated work includes 0.1 acre of vegetation trimming and clearing and 0.055 acre of fill in wetlands. The activity is authorized under Nationwide Permit (NWP) number 27, and this reverification is valid until March 15, 2031. The project document was issued on March 23, 2026, and references the January 8, 2026 Federal Register (91 FR 768) containing the 2026 NWPs, Jacksonville District regional conditions dated February 13, 2026, and general and special conditions from previous correspondence.

The permit reverification confirms that no changes have been made to the previously authorized activity performed in accordance with attached drawings and established terms and conditions. The authorization permits work to commence provided the relevant NWP remains in effect, with a 12-month completion grace period if work has commenced before any expiration, modification, or revocation of the permit. The permit holder is directed to access the USACE Jacksonville District Regulatory webpage for additional NWP information and supporting documentation. Contact information is provided for project manager Alexi Depp, and copies of the correspondence were sent to Marie Yarbrough at AtkinsRealis, indicating contractor involvement in the project.

Dear Mr. Culver:

You requested reverification of an activity that we previously verified on January 25, 2019 and subsequently reverified on May 10, 2022. The file number is SAJ-2015- 00111. The activity would result in removal of 642,000 cubic yards of organic sediments from canals and borrow areas in Sykes Creek by hydraulic and/or environmental clam shell dredging. Work in the vicinity of the Dredge Material Management Area would result in 0.1 acre vegetation trimming and clearing and 0.055 acre fill in wetlands; no submerged aquatic vegetation would be affected. The project is located within 162 acres within the Sykes Creek / Barge Canal waterbody (HUC 03080202) north of East Merritt Island Causeway, Sections 23, 24, 25, 26, Township 24 South, Range 36 East and Section 30, Township 24 South, Range 37 East, Brevard County, Florida. Your request stated that there are no changes to that activity.

Your activity is authorized by Nationwide Permit (NWP) number 27. This reverification is based on the activity being performed in accordance with the drawings attached to our previous letter; the terms and conditions of the 2026 NWPs found in the January 8, 2026, Federal Register (91 FR 768); the Jacksonville District regional conditions dated February 13, 2026; and the general conditions and special conditions and attachments in our previous letter.

This verification is valid until March 15, 2031. Furthermore, if you commence or are under contract to commence this activity before the date that the relevant NWP expires or is modified or revoked, you will have 12 months from the date of expiration, modification or revocation of the NWP to complete the activity under the present terms and conditions of this NWP.
