About this file
This is a draft contract template issued by Brevard County, Florida for the Sykes Creek Phase II Muck Removal Project, establishing the terms between the County and a private landowner for the disposal and long-term containment of dredged material and muck generated from Indian River Lagoon projects. The contract is associated with RFP 8-26-01, through which the County competitively selected properties meeting project requirements. The selected landowner will provide property access and work with the County's separately contracted dredging and hauling services provider to place and maintain dredged material on the landowner's property. The contract term is five years from the date of final execution, with no renewal options specified in the document.
Compensation for the use of the landowner's property will be determined through a separate agreement between the landowner and the County's contractor, with payment calculated on a per-cubic-yard basis for muck disposed. The County's contractor is responsible for remitting payment to the landowner within thirty days of disposal. The landowner bears all costs associated with site maintenance and long-term containment of the dredged material. The County retains broad termination rights, requiring only fourteen calendar days' written notice for termination for convenience, while the landowner must provide sixty calendar days' notice. The contract includes standard provisions requiring compliance with Florida Public Records Act, E-Verify employment verification if applicable, indemnification protecting the County from the landowner's negligence, and provisions for audit rights and records retention for five years post-termination. All disputes are governed by Florida law with venue in Brevard County courts on a non-jury trial basis.
