About this file
This is Addendum 3 to the Sykes Creek Phase II Muck Removal Project bid package issued by Brevard County Purchasing Services on August 7, 2026. The addendum provides clarifications and modifications to the original contract specifications regarding dredging tolerances, payment terms, and project timeline adjustments. The base project involves approximately 223,600 cubic yards of muck removal from Zones 3A-North and 3B-South in Sykes Creek, with four optional zones totaling approximately 128,800 additional cubic yards. The revised questions deadline has been extended to Wednesday, August 12, 2026 at 5:00 PM. The bid opening date and time have been changed to Friday, August 21, 2026 at 9:00 AM. A mandatory pre-bid meeting was scheduled for July 16, 2026 at 10:00 a.m. at Kiwanis Island Park in Merritt Island. The contractor must provide all labor, materials, tools, equipment, and trucking to perform hydraulic dredging, design and implement a dewatering facility, and secure permanent upland disposal locations, with work divided into three Notice to Proceed phases totaling approximately 1,460 calendar days to final completion.
The addendum establishes a 0.5-foot vertical construction tolerance from the Required Depth for acceptance purposes only, clarifying that this tolerance does not expand the payable volume, alter the design dredge template, or authorize work beyond permit authorizations. Material removed below the Required Depth or outside the authorized lateral dredging limits will not be measured or paid for, and contractors must account for costs associated with incidental nonpayable material in applicable unit prices. The Owner will conduct post-dredge bathymetric survey reviews within ten business days, with isolated deviations within the construction tolerance not serving as grounds for rejection; however, any field verification survey required due to contractor failure to satisfy acceptance requirements shall be borne by the contractor at full cost. No separate or additional payment will be made for handling, dewatering, transporting, or disposing of material removed outside the design dredge template. The contractor must submit a signed and sealed preliminary Dredge Material Management Area design prepared by a Florida-licensed professional engineer with the bid, and must comply with comprehensive federal and state environmental permits including USACE Nationwide Permit 27 and FDEP Environmental Resource Permits with conditions requiring manatee and sea turtle protection measures, turbidity monitoring, and seagrass buffer setbacks of minimum 15 feet.

ADDENDUM 3
TO ALL PROSPECTIVE BIDDERS
This is an Addendum to and shall be considered as part of the original bid package for the above-mentioned bid. Please acknowledge receipt of Addendum 3 in space provided on Price Sheet.
Bidders are requested to acknowledge receipt of this addendum with their bid.
CLARIFICATION TO QUESTIONS RECEIVED
Question 1: Section 35 20 23 (Quantity of Material / Allowable Over-depth) and Addendum 1, Question 15 state that no under-depth or over-depth tolerance is provided, and that the Contractor will not receive payment for any material removed below the Required Depth. Given the highly irregular dredge limits and depths referenced in Section 35 20 23.D, achieving exact design grade with hydraulic dredging equipment without incidental over-cut is not achievable in practice. For reference, Brevard County's Eau Gallie Muck Removal Project (B-6-24-29), included the following provision in its specifications: "A 0.5-foot construction tolerance is permitted within the proposed dredge limits and is considered payable." This is standard industry practice on comparable dredge projects, distinguishing a reasonable construction tolerance from unauthorized over-dredging. Will the Owner consider incorporating a similar 0.5-foot payable construction tolerance for this Project? If not, please clarify how the Owner expects the Contractor to achieve exact design grade using hydraulic dredging equipment without incurring unrecoverable costs for incidental, unavoidable over-cut.
Answer: A payable over-depth tolerance will not be established. However, the Owner recognizes that hydraulic dredging equipment cannot consistently achieve the exact design dredge template and that incidental over- or under-dredging may occur. Accordingly, a construction tolerance of ±0.5 foot from the Required Depth (Bottom-of-Muck) will be used for determining acceptance of the completed dredging work.
The Contractor shall use appropriate methods and controls to remove the muck while minimizing incidental over-excavation and avoiding removal of underlying native material. Nothing in this response expands the permitted dredging template or relieves the Contractor from compliance with the applicable permit authorizations.
The following revisions to the Contract Documents apply:
Section 01 29 00 Measurement and Payment, Paragraph 1.09.H.3.e., Bid Item 18.X: Muck Removal Dredging, is supplemented by adding the following at the end of the payment provision:
For purposes of calculating payment, the payable volume shall be limited to the actual accepted in-situ volume removed within the design dredge template (pay prism). Material removed below the
Required Depth or outside the authorized lateral dredging limits will not be measured or paid for.
Acceptance of post-dredge elevations within the construction tolerance established in Section 35 20 23 does not expand the payable volume.
Section 35 20 23 Dredging, Paragraph 1.03.C., is deleted in its entirety and replaced with the following:
C. Construction Tolerance: For purposes of Contract acceptance, a vertical construction tolerance of ±0.5 foot from the Required Depth will be applied. The Required Depth remains the target dredging elevation. Deviations within the tolerance shall be incidental and shall not result from systematic under-dredging or intentional over-excavation. The tolerance does not establish an alternative dredging template, expand the limits of payment, or authorize Work beyond the applicable permit authorizations.
Section 35 20 23 Dredging, Paragraph 3.05.A.1., is deleted in its entirety and replaced with the
1. As soon as practicable, and no later than ten (10) business days after receipt of the post-dredge bathymetric surveys, the Engineer will review the surveys and/or conduct a field verification of the Work sites. Methods of verification may include, but are not limited to, review of survey data or requests that the Contractor’s surveyor conduct additional bathymetric surveys at no additional cost to the Owner. Isolated deviations within the construction tolerance established in Paragraph 1.03.C of this Section will not, by themselves, be grounds for rejection. The Owner, based on the Engineer’s recommendation, may require additional dredging where remaining muck exceeds the construction tolerance, results from systematic under-dredging, or forms a substantial or continuous residual muck layer.
Section 35 20 23 Dredging, Paragraph 3.05.A.3., is deleted in its entirety and replaced with the
3. Any field verification survey required due to the Contractor’s failure to satisfy the acceptance requirements established in Paragraph 3.05.A.1 of this Section, as determined by the Engineer, shall be borne by the Contractor. Such costs shall include, without limitation, survey crew time, mobilization, demobilization, travel, and data processing associated with the verification survey.
CONSTRUCTION DRAWINGS:
Sheet C-2 – Project Notes: Delete DREDGING Note 5 in its entirety and replace with the following:
5. No quantity adjustment or additional payment will be made for material removed outside the specified dredge limits or below the Required Depth (Bottom-of-Muck). The ±0.5-foot construction tolerance specified in Section 35 20 23 is for acceptance of the Work only and does not alter the design dredge template or limits of payment.
Sheet C-3 – Project Overview: The note “ALLOWABLE OVERDREDGE DEPTH FOR PAYMENT: 0.0 FT” remains unchanged and applies to payment only.
The construction acceptance tolerance does not modify the Required Depth (Bottom-of-Muck), design dredge template, dredge limits, or allowable over-depth for payment shown on the Construction Drawings.
This response supersedes the response to Question 15 of Addendum No. 1 to the extent of any conflict.
Question 2: In addition to non-payment for dredging and dewatering this would also likely result in un-reimbursable costs related to transportation and disposal of the material. If the spec remains as is the contractors will likely have to assume worst case scenario and include that cost in our estimate thus raising the overall price of the project
Answer: No separate or additional payment will be made for handling, dewatering, transporting, or disposing of material removed below the design dredge template or outside the authorized dredging limits. The Contractor shall account for costs associated with incidental nonpayable material in its applicable unit prices. The construction tolerance established in the response to Question 1 above is intended to reduce the need for repeated dredging solely to address isolated deviations within the acceptance tolerance and does not expand the limits of payment.
The questions deadline has been extended to Wednesday, August 12, 2026 @ 5:00 PM.
Please note that the bid opening date and time have changed to Friday, August 21, 2026 @ 9:00
AM.
All other terms and conditions remain unchanged.
Sincerely, Mary Bowers Purchasing Manager
