About this file

This is an Environmental Resource Permit Modification issued by the Florida Department of Environmental Protection (FDEP) Central District Office to Brevard County for the Sykes Creek Muck Removal Project. The permit modification, designated as 331649-005-EM, extends the construction expiration date of the original permit (331649-002-EI) from September 9, 2026, to September 9, 2027, allowing an additional year for project completion. The project involves the removal of 661,000 cubic yards of muck from Sykes Creek and associated canals, with dredge material management occurring in a designated Dredge Material Management Area (DMMA) located north of Merritt Island Causeway in Merritt Island, Brevard County. The original permit was issued on September 9, 2016, and has been modified twice previously: once in September 2021 to extend the construction phase to September 9, 2023, and again in July 2022 to authorize the addition of polymers for dewatering assistance. The project includes environmental mitigation measures consisting of 0.58 acres of shoreline enhancement through Brazilian Pepper removal, 0.01 acres of mangrove impact restoration, and 0.04 acres of mangrove creation.

The permit modification does not alter the specific or general conditions or monitoring requirements of the original permits and modifications. The FDEP determined that the proposed modification is not expected to result in any adverse environmental impact or water quality degradation. The modification was filed with the Department Clerk on January 20, 2023, and is final and effective on that date unless a timely petition for administrative hearing is filed within 21 days. Key contacts include Matt C. Culver as Brevard County's Boating & Waterways Program Coordinator and Taylor Engineering, Inc., represented by David Stites, Ph.D., as the authorized agent. Other parties receiving service of the permit include Gator Dredging and Gator Aquatic Tech, which appear to be involved in project implementation.
