About this file
This is a permit modification letter from the Florida Department of Environmental Protection (FDEP) Central District Office to Brevard County regarding the Sykes Creek Phase II Muck Removal Project. The document approves a modification to permit file number 0331649-003-EM, which extends the construction phase of the original permit (0331649-001-EI issued in 2015) by two years. The permit expiration date has been modified from September 9, 2021 to September 9, 2023, allowing Brevard County additional time to complete the muck removal project. The modification was processed by FDEP staff and determined to pose no adverse environmental impact or water quality degradation. The approval does not alter any specific or general conditions or monitoring requirements of the original permit, with the exception of the stated expiration date extension.
The modification letter was issued on September 22, 2021 and filed with the Department Clerk on the same date. All specific and general permit conditions remain in effect through the new expiration date of September 9, 2023. The document includes standard administrative hearing petition procedures allowing interested parties 14 days from receipt to petition the Department for administrative proceedings under Florida Statutes Section 120.57, and outlines judicial review procedures for filing a Notice of Appeal within 30 days of the permit modification filing date. Copies of the approval letter and accompanying drawings were distributed to project stakeholders including Brevard County contacts, Taylor Engineering representatives, and FDEP staff.
