About this file
This technical specification document establishes the contract requirements for the Sykes Creek Phase II Muck Removal Project administered by Brevard County Board of County Commissioners in Florida, with engineering oversight by Taylor Engineering, Inc. The project entails the removal of up to 352,400 cubic yards of muck material from Sykes Creek via hydraulic cutter suction dredge or hydraulic suction dredge. The work is divided into a base bid comprising approximately 223,600 cubic yards from Zones 3A-North and 3B-South, with four optional dredge zones containing 17,200 to 38,800 cubic yards each. The project includes separate Notice to Proceed (NTP) phases: NTP 1 covers permit modifications and site preparation, NTP 2 addresses Dredged Material Management Area (DMMA) preparation and mobilization, and NTP 3 initiates dredging construction services. The contractor is responsible for designing and implementing the dewatering facility at the Nandivada DMMA site, obtaining all environmental permits and modifications, and transporting dewatered material to an approved permanent upland disposal location. Three pre-construction meetings are required before each NTP issuance, with construction progress meetings generally occurring biweekly during execution.
The contract operates on a lump sum and unit price basis, with payment made upon completion of work items as verified by the engineer. The base bid and optional dredge zones will be awarded to the lowest responsive and responsible bidder, with the owner retaining discretion to award optional zones based on budget availability and project priorities. The contractor must submit a signed and sealed preliminary DMMA site design and dewatering plan prepared by a Florida-licensed professional engineer as part of pre-qualification requirements. Operations are restricted to Monday through Friday 7:00 a.m. to 6:00 p.m., Saturday 8:00 a.m. to 5:00 p.m., with no noise-generating activities on Sundays or county-recognized holidays without written owner approval. The owner has identified two optional disposal sites (Rock Solid Rock, LLC in Titusville and C.G. Reed Land Clearing, Inc. in Cocoa), though the contractor remains solely responsible for securing and permitting its selected final disposal location. The project includes comprehensive environmental protection requirements, turbidity and water quality monitoring, manatee protection compliance, and an 18-inch utility pipe for dredge effluent discharge to ambient waters.

PAYMENT ITEMS
A. Basis of Payment for Lump Sum Items
1. Payment for lump sum items — denoted as LS in the units column of the Bid Pricing Form — for this Project will be made at the lump sum price named in the Contract.
The Contract price shall constitute full compensation for each item, including all required labor, products, tools, equipment, plant, transportation, services and incidentals, erection, application, or installation of an item of the Work, overhead and profit as required to complete the item as indicated in the Construction Drawings and Specifications.
B. Basis of Payment for Unit Price Items
1. Quantities indicated in the Bid Pricing Form are for bidding and Contract purposes only. Quantities and measurements supplied or placed in the Work and verified by the Engineer determine payment.
2. If the actual Work requires more or fewer quantities than those quantities indicated, the Contractor will provide the required quantities at the unit prices agreed to.
3. If the actual Work requires a twenty-five percent (25%) or greater change in a unit price quantity than those quantities indicated on the Bid Pricing Form, the Owner or Contractor may claim for and negotiate a unit price adjustment for that item.
C. Progress Payments
1. One progress payment will be made upon completion of mobilization to the site.
2. For lump sum items, subsequent progress payments will be made based upon the estimated percentage of completion for each pay item requested by the Contractor and field verified by the Engineer or Owner, unless otherwise indicated in paragraph
1.09 of this Section.
3. For unit price items, subsequent progress payments will be made upon receipt and acceptance of surveys used for progress payments. Surveys will be evaluated based on the linear, aerial, or volumetric change for each specific payment item.
The Contractor is required to have all surveys performed by or under direct responsible charge of a Professional Surveyor and Mapper licensed in the State of Florida.
4. Final payment for Work governed by unit prices will be made on the basis of the actual measurements and quantities accepted by the Engineer multiplied by a unit price of the item. Final payment for unit price Work will be accomplished by reconciliation change orders to adjust quantities at the end of the Project.
5. No payment, partial or complete, will be made for defective or rejected Work.
6. No separate payment will be made for additional labor and materials required for accomplishing the Project in its entirety. All labor, materials, and incidental costs
Section 01 29 00 Page 5 of 11 shall be included for payment as part of the proposal and the Contract, under the several scheduled items of the Project.
