About this file

This is an Environmental Resource Permit Modification issued by the Florida Department of Environmental Protection (FDEP) Central District Office to Brevard County for the Sykes Creek Muck Removal Dredge Material Management Area (DMMA) project. The modification extends the construction expiration date of the original permit (331649-002-EI) from September 9, 2027 to September 9, 2029, pursuant to Florida Statutes Section 252.363 emergency extension provisions related to Hurricane Helene and Tropical Storm Milton. The original permit, issued September 9, 2016, authorized the removal of 661,000 cubic yards of muck from Sykes Creek and associated canals with mitigation consisting of 0.58 acres of shoreline enhancement through Brazilian Pepper removal, 0.01 acres of mangrove impact restoration, and 0.04 acres of mangrove creation. The project is located north of Merritt Island Causeway (SR 520) in Section 25, Township 24 South, Range 36 East, Merritt Island, Brevard County, with coordinates approximately 28°21'53.4974" North and 80°40'45.4089" West. The permit modification was filed and executed on December 17, 2024.

The permit modification does not alter any other terms, conditions, or monitoring requirements of the original permit or previous modifications. All dates pertaining to deadlines for commencing or completing construction, completing mitigation, and submitting required reports have been extended relative to the new expiration date. The modification does not affect the expiration dates of associated state-owned submerged lands leases or easements, water quality certifications, coastal zone consistency determinations, or any related state, federal, or local permits. Specific conditions require the permittee to submit a Construction Commencement Notice at least 48 hours prior to beginning work, implement best management practices for erosion control, and obtain necessary generic permits for dewatering and water use permits if withdrawal capacity exceeds 1 million gallons per day.

NOTICE OF PERMIT MODIFICATION

Brevard County Attention: Matt C. Culver, Boating & Waterways Program Coordinator Matt.Culver@BrevardFL.gov 2725 Judge Fran Jamieson Way, Building A, Room 219 Viera, Florida 32940

Permit Modification No.: 331649-006-EM Permittee: Brevard County Project: Sykes Creek Muck Removal DMMA Time Extension

Dear Mr. Culver:

We are in receipt of your notice to use the provisions of Section 252.363 of the Florida Statutes to extend the duration of the above permit, which authorized activities and works within the geographic area affected by the Governor’s declaration of a state of emergency, established by Executive Order #2024-213 Emergency Management Re: Hurricane Helene and Executive Order #2024-215 Emergency Management Re: Tropical Storm Milton, issued on October 3, 2024 and October 6, 2024, respectively. In accordance with the provisions of that legislation, the expiration date of the permit is changed as follows:

Expiration Date: September 9, 2027

New Expiration Date: September 9, 2029

All dates contained in the terms and conditions of the permit pertaining to deadlines, such as for commencing or completing construction, completing any mitigation, and submitting reports for the activity authorized by the permit are modified in recognition of, and relative to, the new expiration date. You are advised that s. 252.363, F.S., requires that, “If the permit or other authorization for a phased construction project is extended, the commencement and completion dates for any required mitigation are extended such that the mitigation activities occur in the same timeframe relative to the phase as originally permitted.”

In accordance with s. 252.363, F.S., the permitted activity will continue to be governed by the rules in effect at the time the permit was issued. However, any future request to modify the permit, except where the modification lessens the environmental impact, will be governed by the rules in effect at the time of the modification.

This extension does not:

1. Alter any other terms or conditions of the permit.

2. Affect the expiration date of any associated state-owned submerged lands lease or easement that was executed for the activities authorized in the permit. It also does not
