About this file

This is a Negotiated Request for Proposal (RFP) for a construction project issued by the Department of Veterans Affairs.

The solicitation seeks a Service-Disabled Veteran-Owned Small Business (SDVOSB) contractor to complete EHRM Infrastructure Upgrades at Clement J. Zablocki VA Medical Center in Milwaukee, Wisconsin. The project is valued between $50,000,000 and $100,000,000 and is classified under NAICS Code 236220 with PSC Y1DZ. The contractor must provide all labor, equipment, materials, supervision, and personnel necessary to complete the construction work in accordance with attached specifications and drawings. The contract performance period is 1,460 calendar days from the Notice to Proceed, with a mandatory 10-calendar-day beginning performance window. Proposals are due by 12:00 PM EST on June 17, 2026, with a 90-calendar-day government acceptance period. A bid guarantee of 20 percent of the proposal price (not exceeding $3,000,000) is required, along with performance and payment bonds upon award. The solicitation is a 100 percent set-aside for certified SDVOSBs, and only contractors certified by the SBA and listed in the SBA certification database are eligible. Evaluation criteria include past performance, Experience Modification Rate (EMR), proposed project team qualifications, phasing narrative, and price, with technical factors weighted significantly more heavily than price. The contracting officer is Megan Dohm, and inquiries should be directed to Bailey E. Donato at (216) 447-8300 x49664.

The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose proposal represents the best value to the Government. A responsibility determination will be made in accordance with FAR 9.1, Responsible Prospective Contractors.

Each offeror’s phasing narrative must address the following:

1. Their understanding of the phasing requirements as outlined in the Specifications, particularly to the differentiation between day shift and night shift work.

2. The difference between the work tasks (new electrical installations, TR construction, civil/site work for new fiber) and how they may be performed in conjunction with each other depending on the General Contractor’s teaming and superintendence abilities.

3. Clear building-by-building work restrictions, with particular emphasis on the difference between patient care and administrative spaces.

4. A description of how submittals (and their approvals) tie into an accurate phasing plan.

5. For Building 111, an estimate of how much new work (routing of new Category 6A cable) can be accomplished per day for evening “punch-down” by VA OIT personnel.

6. How the General Contractor will work in concert with the following team players: The Construction Period Services Architect/Engineer (AE) for construction inspections;

the Commissioning Agent (CxA) for start-up and commissioning requirements; VA Shops staff for coordination of outages and in the investigation of these outages; VA OIT personnel for the coordination of night work “punch-down” of new work (patch panel to switch) as well as the coordination of the leap-frogging of VA OIT-provided switches; the VA COR for overall construction administration (CA), safety, and infection control; and the VA COR’s third-party CA representative.

7. How to manage impacts due to working in and around a functioning hospital. How the General Contractor will schedule disruptive type work (noise, dust generating, or material deliveries). How the contractor will manage utility outages and how they will not impact daily operations.

8. How they will address Infection Control and Life Safety requirements as the work progresses, with specific ways the General Contractor will ensure the requirements in VA-issued ICRA permits are adhered to.

Factor 5 - Price Proposal The proposal must include the following for Factor 2 Price.

The Offeror shall provide their price for Line Item 0001 in the Price Schedule included in the solicitation. In addition to the Price Schedule, Offerors shall submit a complete Breakdown of the Division Pricing for Line Item 0001 (See Attachment 3 - Division Cost Breakdown). The Division Pricing will be used to determine price reasonableness. The Government also reserves the right to use this Division Pricing breakdown as part of discussions during the competitive range, if they are required.

The price must be Firm Fixed Price. The Offeror must take care not to include remarks that take exception to the Government’s Specifications/Drawings or pricing requirements or otherwise preclude the Government from evaluating the offer, which will result in the offeror’s proposal being rejected.

D. Evaluation Methodology:

The Technical proposal shall address the following evaluation factors, which are cited below.

Factor 1, Past Performance: Past Performance will be evaluated on the basis of recency and relevancy to arrive at an overall Confidence Rating.

Recency and Relevancy Evaluation: The Government will evaluate each project submitted to ensure the project is recent, meaning projects must have been completed within the last five years, and at least 75% complete. Projects older than five years or not at least 75% completed will not be evaluated. The Government will evaluate each recent project to determine the relevancy of the project to the solicitation requirements.

The relevancy determination will be based on the CPARS/PPQs provided by the Offeror.

Performance Quality Assessment: The Government will consider the performance quality of any submitted project determined to be recent and rated somewhat relevant, relevant, or very relevant. In addition to evaluating the extent to which the Offeror’s performance meets contract specification requirements, the assessment will also consider aspects such as: the Offeror’s adhering to schedules (including the administrative aspects of performance); reasonable and cooperative behavior and commitment to customer satisfaction; controlling project cost; the timeliness of contract completion and submission of deliverables; the contractor’s compliance with the terms and conditions of the contract; the overall quality of the work performed on the contract;

the Offeror’s managerial performance (to include use and control of subcontractors); and whether or not the reference would enter into a contract with the contractor again.

The Government reserves the right to conduct a past performance assessment using information obtained from CPARS and any other sources deemed appropriate by the CO. Other sources may include, but are not limited to, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. While the Government may elect to consider data obtained from other sources, the burden of providing current, accurate and complete past performance information rests with the Offeror.

Overall Performance Confidence Rating: The purpose of the past performance evaluation is to assess the degree of confidence the Government has in the Offeror’s ability to meet the solicitation requirements based on the Offeror’s demonstrated record of performance. The Government will combine the recency, relevancy, and performance quality assessment considered for the Offeror to assign a single Past Performance Confidence Rating of Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence or No Confidence.

Per FAR 15.202(c)(1), offerors without a record of relevant past performance or for whom information on past performance is not available may not be evaluated favorably or unfavorably on past performance. Offerors with no recent and relevant performance history or whose performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned shall receive the “Neutral Confidence” rating, meaning the rating is treated neither favorably nor unfavorably.

Factor 2, EMR: The EMR is used as an indicator of a contractor's safety performance and associated risk. A lower EMR is considered more favorable as it reflects, a safer workplace and aligns with the Government's interest in mitigating risk, reducing liability, and ensuring project continuity.

Under the trade-off process, the Contracting Officer may determine that a higher price is justified for an Offeror with a demonstrably superior safety record (lower EMR), or conversely, accept a lower price from an Offeror with a less favorable EMR, if it represents the overall best value to the Government.

Evaluation Thresholds:

Outstanding: EMR < 0.80 Acceptable: EMR ≥ 0.80 and ≤ 1.00 Unacceptable: EMR > 1.00

Factor 3, Proposed Project Team: The Government will evaluate the resumes provided for the proposed team members based on relevant and recent experience, certifications, licenses, and specialized training relevant to the scope, and prior experience working and/or managing projects of a similar size, scope, and complexity.

This factor is a Go-No-Go factor.

“Go” is defined as the offeror has provided a resume for all key positions that meet the minimum requirements outlined in the Specifications.

“No-Go” is defined as the offeror has not provided a resume for all key positions and/or the resumes do not meet the minimum requirements outlined in the Specifications.

Factor 4, Phasing Narrative: The phasing narrative will be evaluated to determine (1) it is realistic, appropriate, and efficient; (2) clear and efficient management of impact on daily operations of the hospital; (3) accounts for subcontractor/trade coordination, man power and number of teams available, resource and time constraints; and (4) demonstrates risk mitigation and successful completion within the required period of performance. Phasing narratives that present lower levels of risk and mitigation strategies will be more favorably rated. Phasing narratives which do not demonstrate these attributes present higher levels of risk and will be less favorably rated. The VA will evaluate and use as an aid to help determine that the Offeror understands and can perform all the required elements of the project in the time frame specified with limited impact, to the greatest extent possible, to the Medical Center.

Factor 5, Price: The total evaluated price will be determined by the Offeror's price provided on the Price Schedule.

Note: If none of the offerors are within the available funding limitation or is otherwise determined to be other than fair and reasonable, the VA reserves the right to enter into discussions with those offerors who are determined to be within the competitive range.

If the Offeror communicates in its proposal any qualifications, exceptions, exclusions, or conditions to the proposed prices in the Offerors proposal documents, the Contracting Officer may reject the proposal and exclude the Offeror from further discussions.

Basis of Award: For RFP 36C77626R0002, all technical factors when combined are significantly more important than price.

2.9 DETERMINATION OF RESPONSIBILITY

In accordance with FAR subpart 9.1, Responsible Prospective Contractors, a responsibility determination will be made for the apparent successful offeror prior to award of the project. The Contracting Officer reserves the right to request information to assist the Government in determining the apparent successful offeror responsible, including information regarding the offeror’s previous experience (including points of contact), organization (including company officers), technical qualifications, financial resources, and other information deemed necessary.

These requests for information do not constitute negotiations. NOTE: Any information received by the Government that would be cause for a negative responsibility determination may deem the offeror ineligible for award

2.10 VETS 4212

Title 38, USC Section 4212(d), codified at 41 CFR Section 61-300, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS-4212 reporting information can be done electronically at:

http://www.dol.gov/vets/vets4212.htm. Award cannot be made unless the awardee has filed their VETS-4212 report. Therefore, all offerors are encouraged to file every year. The Contracting Officer may request a copy of the email confirmation of receipt notification prior to awarding the project.

2.11 SYSTEM FO`R AWARD MANAGEMENT (SAM)

The FAR requires that federal contractors register in the SAM database at https://sam.gov/ and enter all mandatory information into the system. The Offeror shall have an active Federal Government contracts registration in the System for Award Management (SAM) when submitting an offer or quotation in response to this solicitation and at the time of award (see FAR 52.204-7). Failure to be registered in SAM.gov at any point during the solicitation period will result in removal from the competition. The initial screening of proposals includes reviewing SAM.gov for compliance with this section.

2.12 REVIEW REQUIRED REGISTRATION WITH CONTRACTOR PERFORMANCE

ASSESSMENT REPORTING SYSTEM (CPARS)

As prescribed in Federal Acquisition Regulation (FAR) Part 42.1102(e), the Department of Veterans Affairs (VA) evaluates contractor past performance on all construction contracts that exceed $900,000 and shares those evaluations with other Federal Government contract specialists and procurement officials. The FAR requires that the contractor be provided an opportunity to comment on past performance evaluations prior to each report closing. To fulfill this requirement, VA uses an online database, CPARS, which is maintained by the Naval Sea Logistics Center in Portsmouth, New Hampshire. CPARS is available to all Federal agencies and is the system used to collect and retrieve performance assessment reports used in source selection determinations. CPARS also includes access to the federal awardee performance and integrity information system (FAPIIS). FAPIIS is a web-enabled application accessed via CPARS for contractor responsibility determination information.

http://www.dol.gov/vets/vets4212.htm https://sam.gov/

Each contractor whose contract award is estimated to exceed $900,000 is required to register with CPARS database at the following web address: http://www.cpars.gov/. Help in registering can be obtained by contacting the CPARS Customer Service Desk at cpars-helpdesk@us.navy.mil. Registration should occur no later than thirty days after contract award and must be kept current should there be any change to the contractor’s registered representative.

For contracts with a period of one year or less, the contracting officer will perform a single evaluation when the contract is complete. For contracts exceeding one year, the contracting officer will evaluate the contractor’s performance annually. Interim reports will be filed each year until the last year of the contract, when the final report will be completed. The report shall be assigned in CPARS to the contractor’s designated representative for comment. The contractor representative will have thirty days to submit any comments and re-assign the report to the VA contracting officer.

Failure to have a current registration in the CPARS database, or to re-assign the report to the VA contracting officer within those thirty days, will result in the Government’s evaluation being placed on file in the database with a statement that the contractor failed to respond.

2.13 BACKGROUND INVESTIGATIONS AND SPECIAL AGREEMENT CHECKS

All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation is commensurate with the level of access needed to perform all work as identified in the solicitation documents. This requirement is applicable to all subcontractor personnel requiring the same access. As per VA Directive 0710, costs of background investigations will be borne by the contractor. Please be advised that the awardee will need to coordinate with the VA Medical Center concerning badging requirements.

2.14 REFERENCES TO VA ENGINEER, RESIDENT ENGINEER, OR PROJECT MANAGER

Any reference contained within the solicitation/contract specifications and/or drawings to the “VA Engineer,” “Resident Engineer,” or “Project Manager,” or their abbreviations shall be replaced with “Contracting Officer’s Representative (COR).”

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign construction material,…
