About this file
This file contains a Department of the Army Permit (SAJ-2019-02065) issued by the U.S. Army Corps of Engineers, Jacksonville District, in conjunction with a Consolidated Joint Coastal Permit and Sovereign Submerged Lands Authorization (Permit No. 0379716-003-JM) issued by the Florida Department of Environmental Protection. The permits authorize Flagler County Board of County Commissioners to conduct a beach and dune restoration project along approximately 7.3 miles of shoreline in Flagler County, Florida. The project involves dredging approximately 2.1 million cubic yards of sand from Borrow Area 3A, located approximately 10 nautical miles offshore in federal waters, and placing approximately 1.4 million cubic yards of dredged material into 113 acres of Atlantic Ocean waters for shoreline stabilization between R-46 and R-64.5. The project extends across two reaches: the North Reach (R-64.5 to R-80) and South Reach (R-94 to R-101), with staging and access areas at Varn Park and R-65 in Beverly Beach. The permit authorizes maintenance dredging of approximately 1.1 million cubic yards from the borrow area and placement of approximately 700,000 cubic yards for up to two maintenance events. The permits are effective through October 14, 2040, and March 10, 2040, respectively, allowing multiple construction events over the 15-year authorization period.
The permits establish comprehensive environmental and operational requirements including compliance with the South Atlantic Regional Biological Opinion (SARBO) for marine species protection, adherence to Statewide Programmatic Biological Opinion conditions for sea turtle protection, and implementation of shorebird protection measures during breeding seasons. Turbidity monitoring is required with a compliance standard of 29 NTUs above background at specified mixing zones up to 150 meters offshore and 1,000 meters alongshore. Post-construction sediment testing must be submitted within 90 days, and biennial physical monitoring surveys are required beginning one year after construction completion. The permitted sediment must comply with specifications including maximum 5% silt content and maximum shell content as detailed in the approved Sediment Quality Control/Quality Assurance Plan. Approved upland sand sources include materials from Vulcan-Goldhead, Vulcan-Keuka, Vulcan-Grandin, Cemex-Davenport, and E.R. Jahna-Independent North mines. The project must comply with conditions regarding hopper dredge deflector devices, marine turtle handling protocols, manatee protection measures, Eastern Indigo Snake protection measures, and specific provisions for preventing impacts to nesting shorebirds and migratory birds. Cultural resource protection, including immediate cessation of work upon discovery of archaeological materials and notification of the Florida State Historic Preservation Officer, is mandatory.

DEPARTMENT OF THE ARMY PERMIT
Permittee: Flagler County Board of County Commissioners
Attention: Hamid Tabassian Flagler County Board of County Commissioners 1769 East Moody Boulevard, Building 2 Bunnell, Florida 32110
Permit No: SAJ-2019-02065 (SP-TMM)
Issuing Office: U.S. Army Engineer District, Jacksonville
NOTE: The term "you" and its derivatives, as used in this permit, means the permittee or any future transferee. The term "this office" refers to the appropriate district or division office of the U.S. Army Corps of Engineers (Corps) having jurisdiction over the permitted activity or the appropriate official of that office acting under the authority of the commanding officer.
You are authorized to perform work in accordance with the terms and conditions specified below.
Project Description: Authorization for the following:
1. DREDGE: To dredge 2.1 million-cubic-yards of sand from a 320-acre existing OCS offshore borrow area known as Borrow Area 3A located approximately 10 nautical miles offshore of the city of Flagler Beach, Florida. The hydraulic dredging would be conducted via a hopper dredge to -64.5-foot-depth NAVD 88 with a 2-foot of allowable over depth.
Because the borrow area is in Federal waters (more than 3 Nautical Miles offshore) on the OCS, BOEM holds the authority to authorize use of OCS sand and the applicant worked with BOEM to utilize the material.
2. FILL: To place approximately 1.4 million-cubic-yards of dredged material into approximately 113-acres of waters of the United States (1,120,000-cubic-yards of sand into 96 acres of open, tidal water of the Atlantic Ocean waterward of the mean high water line and 120,000-cubic-yards of sand into 17 acres of tidal waters between the high tide line and the mean high water line) from R-46 to R-64.5 of the Atlantic Ocean shoreline for shoreline stabilization. The above amounts include incorporation of the entire 2.1 million-cubic-yards of dredged material to account for loss of sand during transit as well as to account for sand that may be required as identified upon resurveying prior or during construction.
As part of the 1.4 million-cubic-yards of material placed, 160,000-cubic-yards of those cubic yards, from the Outer Continental Shelf Borrow Area 3A, would be placed into 23-acres of uplands landward of the high tide line. The proposed work would also include use
PERMIT NUMBER: SAJ-2019-02065
PERMITTEE: Flagler County of staging areas at Varn Park and R-monument 65 in Beverly Beach that could cause closure to public parking. These upland areas are not under the Corps jurisdiction, but would be within the National Environmental Policy Act, Endangered Species Act, and Section 106 scope of analysis that the Corps would review.
3. MAINTENANCE: In the event of any storm events, the proposed work would include dredging of approximately 1.1-million-cubic-yards of sediment from borrow area 3A and place approximately 700,000-cubic-yards of material into 113 acres of waters of the United States between R-46 – R-64.5 in up to two maintenance events for a total of 2.2-million-cubic-yards of dredge and 1.4-million-cubic-yards of fill. The maintenance events would depend upon potential storm events that could cause erosion and the surveyed beach and dune conditions immediately prior to such renourishment events. Specific maintenance project designs have not been developed at this time, therefore estimated volumes of dredge and fill are approximations. The applicant would work with BOEM in the future for a lease agreement for any maintenance events. The work described above is to be completed in accordance with the 24 pages of drawings (Attachment 1) and 15 attachments affixed at the end of this permit instrument.
Project Location: The project would affect waters of the United States associated with the Atlantic Ocean. The project site is located along the uplands, 404 waters of the shoreline between the high tide line and mean high water line, and in Section 10/404 waterward of the mean high water line of the Atlantic Ocean between the Florida Department of Environmental Protection (FDEP) Range (R) monuments R-46 and R- 64.5, Sections 46, 15, 14, 23, 26, Township 11 South, Range 31 East, in Flagler County, Florida. The borrow area associated with this project is Borrow Area 3A, which is located approximately 10 nautical miles east of the shoreline in Federal waters on the Outer Continental Shelf (OCS).
Directions to site: From Jacksonville, take Interstate 95 south to Exit 284 (State Road 100 East / East Moody Boulevard). Traveling east, proceed on State Road 100 for 10 miles to the intersection of Florida Highway A1A. Travel north approximately 2.6 miles.
The project lies along the shoreline of the Atlantic Ocean.

24. Proposed Species/Critical Habitat: At this time, this project does not fall within the range for any known candidate or proposed species to be federally listed and/or proposed critical habitat to be designated under the Endangered Species Act. If any species or critical habitat should become federally listed within the range of the permitted action, the Permittee is required to stop work and ask the Corps to re-evaluate effects on the species or designated critical habitat, and if needed, complete Section 7 consultation with the United States Fish and Wildlife Service or National Marine Fisheries Service to address potential impacts to the species and/or designated critical habitat.
25. Fill Material: The Permittee shall use only clean fill material for this project. The fill material shall be free from items such as trash, debris, automotive parts, asphalt, construction materials, concrete block with exposed reinforcement bars, and soils contaminated with any toxic substance in toxic amounts, in accordance with Section 307 of the Clean Water Act.
26. As-Built Certification: Within 60 days of completion of the work authorized by this permit, the Permittee shall submit as-built drawings of the authorized work and a completed “As-Built Certification by Professional Engineer or Surveyor” form (Attachment 14) to the Corps. The as-built drawings shall be signed and sealed by a registered professional engineer or surveyor and include the following:
a. A plan view drawing of the location of the authorized work footprint, as shown on the permit drawings, with an overlay of the work as constructed. The plan view drawing should show all existing water management structures and the completed structures, dredge/fill activities, and wetland impacts.
b. A list of any deviations between the work authorized by this permit and the work as constructed. In the event that the completed work deviates, in any manner, from the authorized work, describe on the attached “As-Built Certification by Professional Engineer” form the deviations between the work authorized by this permit and the work as constructed. Clearly indicate on the as-built drawings any deviations that have been listed. Please note that the depiction and/or description of any deviations on the drawings and/or “As-Built Certification by Professional Engineer” form does not constitute approval of any deviations by the Corps.
c. The Department of the Army permit number on all sheets submitted.
27. Notice of Permit: The Permittee shall complete and record the “Notice of Department of the Army Permit” form Attachment 15 with the Clerk of the County Court, Registrar of Deeds or other appropriate official charged with the responsibility of maintaining records of title to or interest in real property within the county of the authorized activity. No later than 90 days after the effective date of this permit, the Permittee shall provide a copy of the recorded Notice of Permit form to the Corps, clearly showing a stamp from the appropriate official indicating the book and page at which the Notice of Permit is recorded in the official records and the date of recording.
Further Information:
1. Congressional Authorities: You have been authorized to undertake the activity described above pursuant to:
(X) Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403)
(X) Section 404 of the Clean Water Act (33 U.S.C. 1344)
( ) Section 103 of the Marine Protection, Research and Sanctuaries Act of 1972 (33 U.S.C. 1413)
( ) Section 14 of the Rivers and Harbors Act of 1899 (33 U.S.C. 408)
2. Limits of this authorization.
a. This permit does not obviate the need to obtain other Federal, State, or local authorizations required by law.
b. This permit does not grant any property rights or exclusive privileges.
c. This permit does not authorize any injury to the property or rights of others.
d. This permit does not authorize interference with any existing or proposed Federal projects.
3. Limits of Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following:
a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of current or future activities undertaken by or on behalf of the United States in the public interest.
c. Damages to persons, property, or to other permitted or unpermitted activities or structures caused by the activity authorized by this permit.
d. Design or construction deficiencies associated with the permitted work.

4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public interest was made in reliance on the information you provided.
5. Reevaluation of Permit Decision: This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following:
a. You fail to comply with the terms and conditions of this permit.
b. The information provided by you in support of your permit application proves to have been false, incomplete, or inaccurate (see 4 above).
c. Significant new information surfaces which this office did not consider in reaching the original public interest decision.
Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The referenced enforcement procedures provide for the issuance of an administrative order requiring you comply with the terms and conditions of your permit and for the initiation of legal action where appropriate. You will be required to pay for any corrective measures ordered by this office, and if you fail to comply with such directive, this office may in certain situations (such as those specified in 33 CFR 209.170) accomplish the corrective measures by contract or otherwise and bill you for the cost.
6. Extensions: General Condition 1 establishes a time limit for the completion of the activity authorized by this permit. Unless there are circumstances requiring either a prompt completion of the authorized activity or a reevaluation of the public interest decision, the Corps will normally give favorable consideration to a request for an extension of this time limit.
Your signature below, as permittee, indicates that you accept and agree to comply with the terms and conditions of this permit.
