About this file
This is a Warranty Bond Form template for the Flagler County Board of County Commissioners and the City of Bunnell, Florida. The form establishes a surety bond requirement for contractors completing projects under contract with Flagler County. The bond guarantees contractor performance and protects the Owner against defects in workmanship and materials for one year following project approval and acceptance. Contractors must furnish a surety bond conditioned to cover all claims, damages, losses, expenses, costs, and attorney's fees resulting from defective materials or workmanship. The bond obligates the Principal (contractor) and Surety (bonding company) to ensure prompt performance and satisfactory completion of warranty work, payment to all subcontractors and suppliers, and fulfillment of all contract obligations within the one-year warranty period. The form specifies that the exclusive jurisdiction and venue for any disputes relating to the bond shall be the Circuit Court of Flagler County, Florida. The bond must be executed in the presence of witnesses and signed by authorized representatives of both the Principal and Surety agent.
This template bond form contains blank fields for completion, including the Principal's name, Surety corporation details, bond amount in dollars, project description, contract date, and project completion and approval dates. The form does not establish independent pricing or funding requirements but rather serves as a standard contractual instrument that bidders on Flagler County projects must comply with as part of their contract obligations. The form reflects standard bonding practices for public works projects and aligns with the Flagler County Beach Nourishment Project - Reach II requirements, which mandate that successful contractors furnish performance and payment bonds equal to 100 percent of the contract amount, along with a one-year warranty bond following project acceptance.
