About this file

This is a Payment and Performance Bond form for the Flagler County Beach Nourishment Project - Reach II, issued by Flagler County Board of County Commissioners in partnership with the State of Florida Department of Transportation. The bond secures a construction contract for restoring approximately 5.5 miles of critically eroded coastline across Painter's Hill, Beverly Beach, and northern Flagler Beach by placing approximately 1.8 million cubic yards of offshore beach-compatible sand. Project deliverables include mobilization and demobilization, beach and dune fill placement, structure inspection and vibration monitoring, beach tilling and decompaction, endangered species monitoring, sea turtle trawling services, sand fencing installation, vegetation dune planting of approximately 364,200 units, and environmental monitoring. The contract performance period is 365 calendar days for final completion and acceptance, with work to commence upon issuance of a Notice to Proceed and be completed within 240 calendar days. The optional pre-bid meeting is scheduled for March 27, 2026 at 10:00 a.m., with bidder questions due by April 3, 2026 at 2:00 p.m., and sealed bids due April 16, 2026 at 2:00 p.m. through the OpenGov Procurement portal.

The bond amount is set at 100 percent of the contract amount and must be recorded in the official records of the Clerk of Court of Flagler County prior to work commencement. The surety is fully liable under the bond to the full extent of any modified contract amount up to and including 25 percent over the original contract amount. The principal must comply with Section 337.18(1), Florida Statutes, promptly pay all laborers and material suppliers, maintain State Workers' Compensation and Unemployment Compensation compliance, and remedy any defects within one year of final acceptance. The project is federally funded through the Federal Emergency Management Agency as a hurricane recovery project under Florida Department of Environmental Protection Agreement No. 23FL2 (Amendment No. 2), with $44,544,369.25 allocated in total state cost sharing and no local match requirement. Liquidated damages apply at rates ranging from $904 to $10,224 per calendar day depending on contract value, and payment is made in accordance with Florida's Local Government Prompt Payment Act with five percent retainage held until satisfactory completion. The contractor must provide comprehensive insurance coverage including worker's compensation, commercial general liability, automobile liability, and builder's risk insurance, and maintain a one-year warranty bond following project acceptance.

Notice to the Surety of such alterations, extension, or forbearance is hereby specifically waived. However, if modifications of the original contract amount cumulatively result in modifications of the contract amount in excess of 25 percent of the original contract amount, the Surety’s approval shall be required to bind the Surety under the Bond on that portion in excess of 25 percent of the original contract amount. This obligation shall remain in full force and effect until the full performance of all covenants, terms, and conditions herein stipulated.
