About this file
This is a Payment and Performance Bond form required by Flagler County Board of County Commissioners for the Flagler County Beach Nourishment Project - Reach II (FPN 429573-1-38-01). The bond document establishes the Principal (contractor) and Surety's joint obligation to the Owner (Flagler County) and the State of Florida Department of Transportation to ensure full performance of the construction contract. The project involves restoring approximately 5.5 miles of critically eroded coastline across Painter's Hill, Beverly Beach, and northern Flagler Beach by placing approximately 1.8 million cubic yards of offshore beach-compatible sand. Work must commence upon issuance of a Notice to Proceed and be completed within 240 calendar days, with a total contract performance period of 365 calendar days for final completion and acceptance. The optional pre-bid meeting is scheduled for March 27, 2026 at 10:00 a.m., bidder questions are due by April 3, 2026 at 2:00 p.m., and sealed bids must be submitted by April 16, 2026 at 2:00 p.m. through the OpenGov Procurement portal.
The bond must equal 100 percent of the contract amount and cover the Principal's compliance with Florida Statutes Section 337.18(1), including prompt payment to all labor, material, equipment, and supply providers, payment of workers' compensation and unemployment compensation taxes, and remedy of any defects within one year of final acceptance. The Surety remains fully liable for contract modifications up to 25 percent of the original contract amount without notice or approval; modifications exceeding 25 percent require Surety approval. The project is funded through the Florida Department of Environmental Protection under Agreement No. 23FL2 (Amendment No. 2) with $44,544,369.25 in total state cost sharing and no local match requirement. As a federally-funded hurricane recovery project through the Federal Emergency Management Agency, the contract is subject to federal requirements including the Contract Work Hours and Safety Standards Act, Clean Air Act compliance, non-debarment verification, and Byrd Anti-Lobbying Amendment certification. Liquidated damages will apply at rates ranging from $904 to $10,224 per calendar day depending on contract value, with five percent retainage held until satisfactory completion and payment made in accordance with Florida's Local Government Prompt Payment Act.

In the event of default by the Principal, the Surety shall pay the Owner in addition to the above obligations, all liquidated damages and disincentives assessed against the Principal because of the default which were not withheld from Agreement proceeds and if the Owner at its sole option demands that the Surety take over the project, then in such event, the Surety may not select the Principal or any affiliate of the Principal to complete the project for and on behalf of the Surety without the Owner’s express written consent and, finally if the subject Agreement required contractor qualification, under Section 337.14, Florida Statutes, or otherwise, the Surety must use a qualified contractor, who is approved by the Owner to perform the work. Notice to the Surety of such alterations, extension, or forbearance is hereby specifically waived. Under this Bond, the Surety, pursuant to Section 337.11(9)(a), Florida Statutes, shall be fully liable under such surety bond to the full extent of any modified contract amount up to and including 25 percent over the original contract amount and without regard to the fact that the Surety was not aware of or did not approve such modifications. However, if modifications of the original contract amount cumulatively result in modifications of the contract amount in excess of 25 percent of the original contract amount, the Surety’s approval shall be required to bind the Surety under the Bond on that portion in excess of 25 percent of the original contract amount. This obligation shall remain in full force and effect until the full performance of all covenants, terms, and conditions herein stipulated.
