About this file

This is a negotiation response letter and key personnel bio forms submitted by Consultant Engineering, Inc. (CEI) to the Arizona Department of Transportation (ADOT) in response to ADOT's solicitation for On Call Acquisition and Relocation Services (Solicitation No. BPM006797). CEI proposes to provide comprehensive acquisition and relocation advisory services for ADOT's transportation projects, including activities such as property inspections, appraisals, offer negotiations, condemnation preparation, relocation eligibility determinations, entitlement calculations, replacement housing identification, and claim processing. The response confirms that all proposed key personnel remain available for the contract and that CEI has adjusted its proposed rates downward to provide enhanced value to ADOT. CEI's full-time in-house recruiting team is actively searching for additional staff to support service delivery on ADOT projects.

CEI proposes three key personnel: Mornith "Clark" Hochstein as Project Manager (50% time availability) with 21 years of acquisitions experience and 23 years of government experience, including extensive work on ADOT's Tres Rios Freeway, I-10 Broadway Curve, South Mountain Freeway, and other projects; Ariel Star-Winters as Senior Acquisition and Relocation Agent (50% time availability) with 6 years of acquisitions and relocation experience, all in government work; and Michelle Williams as Senior Acquisition and Relocation Agent (75% time availability) with 8 years of acquisitions and relocation experience, all in government work. All three personnel hold Arizona real estate licenses and notary commissions. The response demonstrates CEI's existing relationships with ADOT and multiple Arizona municipalities, including extensive experience on major federally funded projects involving complex residential and commercial relocations, inventory management, compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act, and condemnation proceedings.

RE: On-Call Acquisition and Relocation Services Negotiation Response

Dear Ms. Brenden, Consultant Engineering, Inc. (CEI) is very grateful for the opportunity to respond to your request for clarification on our submittal. I have highlighted the teams specific relocation experience on both residential and commercial properties for each licensed agent.

As per your request, please accept this letter as confirmation that there have been no changes to the key personnel CEI proposed in our submittal. All proposed staff are ready and able to work on any ADOT task.

Furthermore, CEI’s full time in house recruiting team are currently searching for additional team members to support our teams ability to provide staff for ADOT’s projects. Additionally, I have complied with the directions in the solicitation to only provide those team members that are currently available to work on this contract and not those that may become available in the future.

When determining the proposed rates for this contract, I reviewed our current rates. I chose to lower the rates to provide the best value to ADOT for our services. We reviewed our maximum price increase percentages and feel they are fair in light of current economic conditions.

I hope that these adjustments to our proposed rates are acceptable and I look forward to a response from you soon.

Should you need additional information or have any questions, I can be reached at 480-201-8646 or via email at chochstein@cei-az.com.

Sincerely, M. Clark Hochstein Vice President Real Estate Services

1.

Describe knowledge and experience in acquisition services to include inspections, bids, offers, negotiations, condemnation, etc. See SOW section 4.1 and 4.3.

Clark has successfully completed hundreds of acquisitions on behalf of agencies all over the State. She has performed the full cycle of acquisition activities from the planning phase to right of way clearance. She performs inspections on both residential and commercial properties, accompanies appraisers on site visits for the valuation process, and solicits bids from approved vendors for cost-to-cure items that may have been requested by the property owner or not adequately addressed in the appraisal.

Clark is a skilled negotiator and has been able to reach an agreement with some of the most difficult property owners to avoid condemnation. She prefers to present all offers in person, but that is not always possible as many owners live out of State. In all cases, the offer packages are presented in clear and unambiguous language.

She makes herself available to property owners to answer any questions that arise, allowing her to gain trust.

She also ensures the properties are posted right after the offer is presented.

However, sometimes, condemnation is unavoidable. Clark is experienced in preparing files for condemnation and is available for testimony if needed. She keeps very detailed Records of Contact (ROC) for each property to ensure all communications are captured and documented.

Clark has expert knowledge of the Federal and State laws that govern the right of way acquisitions and complies with department policies as well.

2.

Describe knowledge and experience in relocation advisory services to include calculating entitlements and replacement housing benefits, bids, notices, inspections, appeals, etc. See SOW section 4.2 and 4.3.

Clark has successfully completed multiple relocations on behalf of agencies all over the State. She has performed relocations on both residential and commercial properties, tenants and owners. Clark has performed the full cycle of activities from determining eligibility to submitting the closed file once the final claim has been processed. Clark is an excellent communicator, which is vital when conducting personal interviews with displacees. Displacees are often overwhelmed at the prospect of relocating, and Clark is able to gain trust early on in the process, allowing for a smooth transaction. Clark is meticulous with the details gleaned from the interview to ensure the displaced receives all of the benefits they are entitled to. She has calculated housing entitlements for other agents on her team.

Clark has taken inventory of personal property to be relocated, along with photos as backup documentation.

She prefers to work directly with the property owner through this process to ensure nothing is overlooked and to gain a quick certification from them. Once the inventory is certified, she solicits detailed, itemized bids from two commercial movers, including the disconnection and reconnection of personal property. Clark is very focused on ensuring compliance with all required notices being issued properly. This includes Notices of Intent, Eligibility, 90 and 30 day, and vacate. All of these documents are kept in the files and noted in the ROC.

Clark has submitted hundreds of claims for payments to agencies, with each line item supported by a specific federal regulation. If a claim is denied, she will review an appeal made by the discplacee before sending it to the Client Manager for approval. As a licensed Real Estate Broker in the State of Arizona, Clark has access to the MLS and has searched for replacement properties for displacees. She has also performed multiple decent, safe, and sanitary inspections of replacement homes and taken photos to evidence the condition. Clark has expert knowledge of the Federal and State laws that govern the right of way relocations and complies with Department policies as well.

Clark relocated 100+ storage tenants on a project with multiple tenants choosing to relocate their belongings to other states. Several of the tenants were un-housed citizens with created complications in communication and meetings. She also performed the calculation of entitlements for one of the more complicated residential relocations in the firms portforlio: A family of 10 who lived on a 3-acre ranch raising goats and chickens. The multigenerational family wanted to stay in the same community as there were young children who needed to stay in the same schools. Clark was able to present to the agency, a fully defendable and fair determination that allowed the family to find a replacement property that had 2 homes and enough room for the 100+ goats and chickens. Clark performed the Decent, Safe and Sanitary inspection on the replacement property as well as the vacate inspection on the property they moved from.

3.

This improvement project transformed the corridor from a primarily two-lane, rural cross-section roadway to an urban, multimodal corridor with new pedestrian, bicycle, and transit infrastructure. Michelle served as the Project Manager and Senior Acquisition and Relocation Agent for this roadway improvement project, which involved both partial and full acquisitions of commercial and residential properties. In this capacity, she was responsible for coordinating and participating in meetings with key stakeholders, ensuring clear communication and alignment throughout the project. Her duties included creating and maintaining detailed right-of-way reports, preparing all notices and documents associated with each acquisition or relocation, and determining whether properties can be valued through Market Analysis. Michelle was also responsible for leading negotiations with property owners to reach fair and mutually beneficial agreements. Her comprehensive approach ensured that the project progressed smoothly, adhering to timelines and regulatory requirements. Michelle also managed a full residential relocation involving a seasonal agricultural worker, which presented unique challenges due to the tenant’s inconsistent income and limited housing options. Recognizing the complexity of the situation, she conducted extensive research to identify viable alternatives that would accommodate the tenant’s financial circumstances. Ultimately, Michelle located a suitable mobile home that the tenant was able to purchase outright using last resort housing assistance funds. In addition, she coordinated the prepayment of 12 months’ lot fees, ensuring long-term housing stability and a smooth transition. Her resourcefulness and commitment to equitable outcomes were instrumental in achieving a successful resolution for the displaced tenant.
