About this file
This is a Best and Final Offer (BAFO) response letter from Tierra Right of Way Services, Ltd. to the Arizona Department of Transportation (ADOT) regarding procurement BPM006797 for On Call Acquisition and Relocation Services. Dated June 10, 2025, the response addresses three critical areas identified during ADOT's negotiation phase: key personnel availability, pricing structure, and contractual exceptions. Tierra confirmed that all originally proposed team members remain available for the contract except Gregory Wittenburg, who is no longer employed by the firm. The company intends to maintain its original hourly rates while revising the price increase structure to reflect zero percent increase during the first renewal period and two percent increases for all subsequent renewal periods. Tierra withdrew all previously listed exceptions and confirmed acceptance to ADOT's original contract language, providing specific responses in an attached spreadsheet.
The BAFO submission represents Tierra's final negotiated position following ADOT's May 29, 2025 negotiation letter and Tierra's June 3, 2025 response letter. This response letter serves as the consolidated Best and Final Offer, incorporating all revisions and clarifications requested by ADOT's Procurement Officer, Bambi Brenden. The submission demonstrates Tierra's willingness to align pricing escalation expectations with ADOT's requirements while maintaining competitive hourly rates. No additional changes or modifications were offered beyond those previously submitted on June 3, 2025. The contract structure appears to include multiple renewal periods with defined pricing adjustment mechanisms, positioning this as a multi-year on-call services agreement for right-of-way acquisition and relocation support services.
