About this file
This justification and approval document allows for the procurement of a Romteck Australia Pty Ltd, Alarm Signalling Equipment (ASE) model RM3118-IP-WIP-ASE on a sole source basis for the FY20 MCAF PAF180200 APR - Jet Fuel Storage Tanks project at Royal Australian Air Force Base Tindal, Australia. The $50.45 million military construction project will construct fuel infrastructure including two bulk fuel tanks, two pump houses, a filter building, and fuel transfer lines. The Romteck fire alarm transmitter is required to interface with the existing base fire detection and monitoring network. No other equipment was found capable of meeting this requirement after a market survey. Using non-Romteck equipment could endanger life and safety by diminishing fire protection capabilities and would require substantial additional costs to upgrade the base's network. The anticipated $1,385 cost of the Romteck transmitter was determined fair and reasonable. Future procurements will include market surveys to consider new technology and additional responsible sources.

J&A No. 21-001
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
FOR ONLY ONE RESPONSIBLE SOURCE
1. CONTRACTING ACTIVITY:
Department of the Navy, Naval Facilities Engineering Command, Pacific, Joint Base Pearl
Harbor-Hickam, Hawaii.
2. DESCRIPTION OF THE ACTION BEING APPROVED:
The purpose of this Justification and Approval (J&A) is to include proprietary specifications for the following brand name items in Solicitation Work Order Number 1606003, Fiscal Year
2020 Military Construction Project PAF180200 Asia Pacific Resiliency (APR) - Jet Fuel
Storage Tanks, Royal Australian Air Force (RAAF) Base Tindal, Australia.
a. One (1) Romteck Australia Pty Ltd, Alarm Signalling Equipment (ASE) model
RM3118-IP-WIP-ASE
3. DESCRIPTION OF SUPPLIES/SERVICES:
a. Fiscal Year 2020 PAF180200 APR - Jet Fuel Storage Tanks, RAAF Base Tindal, Australia will construct Petroleum, Oil, and Lubricant (POL) infrastructure needed to support military exercises at RAAF Base Tindal, NT, Australia. Supporting infrastructure includes two pump houses, a filter building for aviation fuel, pipelines, and fill stands for loading and unloading fuel.
As part of the project, a Romteck Australia Pty Ltd, ASE model RM3118-IP-WIP-ASE is required at RAAF Base Tindal to connect to the base wireless alarm monitoring network, using Private Cellular WAN and 3G/4G services. This sole source requirement is provided as written direction from the Host Nation via formal letter dated 13 November 2020. The estimated cost of construction is $50,445,000, of which $1,385 (0.03%) will be for the procurement of the Romteck fire signaling equipment.
b. Fiscal year 2020 military construction funds will be used to fund the aforementioned supply. The period of performance is approximately 985 calendar days.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION:
Statutory authority 10 U.S.C. 2304(c)(1) – Only one responsible source and no other supplies or services will satisfy agency requirements.
Subj: JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION FOR ONLY ONE RESPONSIBLE SOURCE; SOLICITATION WON

FUEL STORAGE TANKS, ROYAL AUSTRALIAN AIR FORCE (RAAF) BASE TINDAL,
AUSTRALIA
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY:
Utilizing the Romteck Fire Alarm Signaling Equipment meets the requirements of “USGS-28
31 70 Interior Fire Alarms System, Addressable”, while simultaneously meeting the Host
Nation requirement to interface with the existing Tindal Fire Department base receiving equipment.
Specification Section 28 31 63.00 20, Analog/Addressable Interior Fire Alarm System, paragraph 1.6.1 requires the devices and equipment for fire alarm service to be listed by
ActivFire, which provides the Evidence of Suitability as required by the Building Code of
Australia. Under the ActivFire Scheme, products are processed according to their certification classification and verified as complying with relevant standards, technical specifications and/or the requirements of recognized conformity assessment bodies.
The purpose of the ActivFire listing is to ensure quality, suitability, and reliability of the equipment, with the objectives of the ActivFire Scheme for certification and listing of active fire protection equipment including the following outcomes:
To verify the conformity (compliance) of equipment through physical testing and appraisal to relevant and endorsed standards and specifications (reference criteria);
To verify and recognize approvals and certifications by other national and international bodies;
To provide an effective and transparent mechanism for appraisal, testing, certification and listing of emerging and new technologies in the field of active fire protection equipment and systems;
To provide reference documentation and information which supports the various building regulation and authority requirements for "Evidence of Suitability" for equipment used in building construction;
To maintain a continuing process that provides means by which the conformity of changes to products can be submitted and verified; and
To maintain a Register of Fire Protection Equipment to publicly list and promulgate, products which meet established reference criteria for listing.
The ActivFire listing ensures that either the equipment or material meet appropriate standards or has been tested and found suitable for use in a specified manner, however, provides no assurance that fire detection and prevention equipment is compatible with other proprietary equipment. A fire alarm system comprised of mixed manufacturer’s equipment is not known to have been approved to date. The possibility of using non-Romteck equipment to interface with the existing base fire detection and prevention equipment may diminish fire protection capabilities, and therefore, has the potential to endanger life and property. The requirement for Romteck Alarm Signaling Equipment ensures reliable fire alarm protection for the personnel and new assets to be installed under this project.
1296438, FY20 MCON PROJECT PAF180200, ASIA PACIFIC RESILIENCY (APR) – JET
Installation of non-Romteck alarm signaling equipment will result in substantial duplication of cost to the Government that is not expected to be recovered through competition. If a non-
Romteck ASE was procured for this project, NAVFAC Pacific would subsequently need to procure a non-Romteck base wireless alarm monitoring network, using Private Cellular
WAN and 3G/4G services, to replace the existing system in order to meet the Host Nation
Requirements. It will cost the RAF Tindal base in excess of $1M to upgrade the entire installation’s fire notification system to service/operate non-compatible devices on
PAF180200. The cost of this change in base infrastructure, training, and operational costs of maintaining multiple systems far outweighs the cost of $1,385 for the Romteck Australia Pty
Ltd, ASE model RM3118-IP-WIP-ASE.
Installation of non-Romteck alarm signaling equipment will also result in unacceptable delays in fulfilling the agency’s requirements. Installation of non-Romteck alarm signaling equipment will prevent approval by the Fire Department at RAAF Tindal, which will preclude the introduction of fuel to the site and thus delay the commissioning and handover to operations.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY
OFFERORS AS PRACTICABLE:
On 25 November 2020, an announcement was published on beta System for Award
Management (SAM) in accordance with DFARS 206.302-1 to identify other potential responsible sources of supply that can provide a fire alarm transmitter that can meet the
Government’s requirements for FY20 MCON Project PAF180200. The announcement identified salient characteristics that the fire alarm transmitters had to demonstrate at a minimum. No responses were received in response to this announcement. As such, it can be interpreted that there are currently no other responsible sources of supply, other than
Romteck, that can meet the Government’s requirements for FY20 MCON Project
PAF180200. Therefore, the Romteck Australia Pty Ltd, ASE model RM3118-IP-WIP-ASE is the only fire alarm transmitter that meets the Government’s requirements.
7. DETERMINATION OF FAIR AND REASONABLE COST:
The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION:
This is a one-time procurement. Although the utilization of a brand name in this project is indicated by this J&A, each future project that includes a ROMTECK Fire Alarm Transmitter will conduct the same market survey to ascertain the availability of new technology that may provide for other sources that can meet the Government's needs. Should any other offers for compatible fire alarm transmitters be submitted during the source selection process, the
Government will consider each as applicable.
