About this file
This is a Justification and Approval (J&A) document authorizing the use of other than full and open competition for a federal construction contract.
Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) is procuring a Duplex Direct Inline Pump System (Overwatch OW21-4VV) from manufacturer Overwatch for solicitation N4008526R0001, a Design-Bid-Build project for the USCG Offshore Patrol Cutters (OPC) Homeport Pier at Naval Station Newport, Newport, Rhode Island. The overall estimated project value is redacted, with the pump system representing a redacted portion of that total. The work will be funded by FY22 Major Acquisition Systems Infrastructure (MASI) and FY25 One, Big Beautiful Bill Act (OBBBA) Department of Homeland Security, Coast Guard funding, with a required completion timeframe of 918 calendar days after contract award. The contract will be solicited as an unrestricted, full and open stand-alone construction solicitation per an approved DD2579 dated February 18, 2026.
The justification for the brand name specification is that the redesigned pier requires a sanitary forced main routed flat alongside the pier to prevent submersion and corrosion, necessitating direct inline duplex pumps at each pier utility connection to overcome backpressure and provide 150 gallons per minute flow. The single manufacturer assembly eliminates construction issues, change orders, and third-party assembly requirements while providing quality control and testing capabilities. A sources sought notice was published on Sam.gov on March 11, 2026 with a response deadline of March 26, 2026, which yielded no responses. The Contracting Officer will determine fair and reasonable pricing using comparative analysis, independent government cost estimate comparison, historical information, or market survey results prior to award.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC
MIDLANT)
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes the use of brand name specifications for a Duplex Direct Inline Pump System (Overwatch OW21-4VV) from manufacturer Overwatch in solicitation N4008526R0001, Design-Bid-Build, USCG Offshore Patrol Cutters (OPC) Homeport Pier, Naval Station Newport, Newport RI.
3. Description of Supplies/Services.
The intent of solicitation N4008526R0001, Design-Bid-Build, United States Coast Guard (USCG) Offshore Patrol Cutters (OPC) Homeport Pier, Naval Station Newport, Newport RI is to demolish an existing stormwater management, fire/potable water, electrical, telecommunications & compressed air utilities, etc.
The solicitation includes the requirements for a Duplex Direct Inline Pump System (Overwatch OW21- 4VV). The solicitation will include brand name specifications for a Duplex Direct Inline Pump System (Overwatch OW21-4VV) from manufacturer Overwatch. The project will provide a sanitary sewer forced
This acquisition will solicit proposals as an unrestricted full and open, stand-alone construction solicitation as authorized by the approved DD2579 on 18 February 2026. The estimated value of the work included in the construction solicitation is approximately , of which is estimated for the Duplex Direct Inline Pump System. The project will be funded by FY22 Major Acquisition Systems Infrastructure (MASI) and FY25 One, Big Beautiful Bill Act (OBBBA), Department of Homeland Security, Coast Guard funding. The work under this contract is required to be completed within 918 calendar days after contract award.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C.
requirements, as implemented by Revolutionary Federal Acquisition Regulation Overhaul (RFO) 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Before being demolished, Pier 1 at Naval Station Newport had a gravity sanitary main routed beneath the pier that was sloped. This sanitary main was submerged at times by the tide where premature corrosion and damage from floating objects resulted in failure. The current designed pier includes a sanitary forced main routed flat alongside the pier, above the fender framing, eliminating the pipe from being submerged.
J&A No. ML-26-43
CON/343
Because the pipe is not sloped, the discharge from the OPC will see settling of solids and backpressure when discharging the sanitary. To overcome this issue, direct inline duplex pumps will be located at each pier utility connection. These pumps will modulate to overcome any back pressure when discharging and provide a design flow of 150 gallons per minute (gpm.) at each service station.
The pumping system outlined above will be assembled and shipped by one manufacturer with all accessories and controls required for operation. This will limit potential issues during construction, limit change orders, and eliminate the need for a contractor or third-party assembly of the system. This manufacturer also has a dedicated facility to build and test this equipment to provide a high level of quality control and troubleshooting for their product. The sanitary pump design requirements and selection were determined using the USCG OPC Integrated Logistics Support Plan (ILSP) Facilities Requirements.
Therefore, the above brand name item is required.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought notice was published on Sam.gov on 11 March 2026 detailing the requirements for an Duplex Direct Inline Pump System. The notice sought commercially available products that could meet the same requirements. The response date was 26 March 2026, and no responses were received.
A solicitation notice will be publicized on SAM.gov, in accordance with the requirements of RFO Part 5.
The approved J&A will also be made publicly available as required by RFO 6.301.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine if the price for this acquisition is fair and reasonable in accordance with RFO Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results. The fair and reasonable determination will be made based on the total price of the project. This proprietary item is not an individual line-item price in the solicitation.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
