About this file
This is a Justification and Approval (J&A) document for the use of other than full and open competition in a federal contract. Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) is authorizing the use of brand name specifications for a compressed air system from manufacturer Kaeser in solicitation N4008526R0001, a Design-Bid-Build project for the USCG Offshore Patrol Cutters (OPC) Homeport Pier at Naval Station Newport, Newport, Rhode Island.
The acquisition covers demolition of existing utilities and construction of new infrastructure, including a fully assembled and installed compressed air system from Kaeser housed within a shipping container to serve all utility connections along Pier 1. The estimated total project value is redacted, with an unspecified portion allocated to the compressed air system. The project is funded by FY22 Major Acquisition Systems Infrastructure (MASI) and FY25 One Big Beautiful Bill Act (OBBBA) Department of Homeland Security Coast Guard funding, with completion required within 918 calendar days of contract award. The statutory authority for the non-competitive award is 10 U.S.C. 3204(a)(1), citing only one responsible source. NAVFAC justified the single-source selection based on the requirement for a fully integrated, factory-assembled system that limits construction issues and change orders while providing cost-effectiveness. A sources sought notice was published on SAM.gov on March 11, 2026, with a response deadline of March 26, 2026; no responses were received. The Contracting Officer will determine fair and reasonable pricing through comparison of proposed prices with the Independent Government Cost Estimate, historical information, and market survey results prior to contract award. The solicitation will be publicized on SAM.gov in accordance with regulations, and the approved J&A will be made publicly available.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC
MIDLANT)
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes the use of brand name specifications for a compressed air system from manufacturer Kaeser in solicitation N4008526R0001, Design-Bid-Build, USCG Offshore Patrol Cutters (OPC) Homeport Pier, Naval Station Newport, Newport RI.
3. Description of Supplies/Services.
The intent of solicitation N4008526R0001, Design-Bid-Build, United States Coast Guard (USCG) Offshore Patrol Cutters (OPC) Homeport Pier, Naval Station Newport, Newport RI is to demolish an existing stormwater management, fire/potable water, electrical, telecommunications & compressed air utilities, etc.
The solicitation will include the requirements for an air compressor system which includes all compressors, driers and accessories to be provided from Kaeser and to be fully installed within a shipping container from Kaeser, which supplies the air compressor needs to all of the utility connections along Pier 1.
This acquisition will solicit proposals as an unrestricted full and open, stand-alone construction solicitation as authorized by the approved DD2579 on 18 February 2026. The estimated value of the work included in the construction solicitation is approximately , of which is estimated for the compressed air system. The project will be funded by FY22 Major Acquisition Systems Infrastructure (MASI) and FY25 One, Big Beautiful Bill Act (OBBBA), Department of Homeland Security, Coast Guard funding. The work under this contract is required to be completed within 918 calendar days after contract award.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C.
requirements, as implemented by Revolutionary Federal Acquisition Regulation (RFO) 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The project scope requires an air compressor system that is fully installed in an outdoor enclosure. There is no central compressed air utility so local generation of compressed air is required to serve the pier. This system will be assembled by one manufacturer to limit potential issues during construction and change orders while also providing the most cost-effective solution. This manufacturer also has a dedicated facility to build this enclosure, and can provide a high level of quality control and troubleshooting for their product.
This is the only product to provide a fully assembled and shipped compressed air system from one manufacturer, and therefore, the above brand name item is required. The compressed air system requirements were determined using the USCG OPC Integrated Logistics Support Plan (ILSP) Facilities Requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought notice was published on Sam.gov on 11 March 2026 detailing the requirements for the air compressor system. The notice sought commercially available products that could meet the same requirements. The response date was 26 March 2026, and no responses were received.
A solicitation notice will be publicized on SAM.gov, in accordance with the requirements of RFO Part 5.
The approved J&A will also be made publicly available as required by RFO 6.301.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine if the price for this acquisition is fair and reasonable in accordance with RFO Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results. The fair and reasonable determination will be made based on the total price of the project. This proprietary item is not an individual line-item price in the solicitation.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
