GENERAL BID NOTES

a) Award will be evaluated on the price proposed for CLIN 0001, which consists of Contract Line

Items 0001A, and 0001B, as well as the sum of the extended prices for Contract Line Items

0001C, 0001D, 0001E, 0001F,0001G and 0001H. For CLINs 0001C, 0001D, 0001E, 0001F, 0001G and 0001H, enter unit prices and extended totals in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

b) Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR

17.206(b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the Option(s) to the total price for CLIN 0001. In accordance with FAR 52.217-5 Evaluation of Options, evaluation of options will not obligate the Government to exercise the Option(s).

c) The Government reserves the unilateral right to award Line Items 0008-0010 to the Contractor at the proposed price within 365 calendar days after the contract award and in accordance with all bid notes. A firm fixed proposed price is required for Line Items 0008, 0009 and 0010. No provision is made for economic price adjustment. If the Option(s) are exercised, the contract completion date remains 1,017 calendar days after award of the contract.

d) The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

e) Failure to enter a price for any Line Item will result in a proposal being rejected.

f) For bid items where unit prices are indicated as required, bidders shall enter unit prices and extended totals in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an

Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price. If Line Items 0002-0010 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all items.

g) For CLIN 0001E: Unit price for providing all work in connection with excavation, handling, storage, sampling, analysis, transportation, any necessary treatment and disposal of contaminant impacted soil media (including but not limited to, PFAS, petroleum, VOCs, PAHs and metals) at a permitted licensed facility. Sampling shall be performed in accordance with Specification Section

01 57 19. Soil samples shall be analyzed for Total Petroleum Hydrocarbons (TPH) diesel range and gasoline range organics (DRO & GRO), and Benzene, Toluene, Methylbenzene, and Xylenes

(BTEX), PFAS, plus other analyses required by the treatment/disposal facility. Unit price shall include all work in connection with removal, testing, treatment and disposal of contaminant impacted soils encountered within planned excavations and CLIN 0007, at a permitted licensed treatment/disposal facility and backfilling the excavation with compacted clean imported structural backfill. Unit price shall include all work in connection with evaluation and handling, any necessary storage, stockpiling and related storage maintenance and transportation, and all that entails. The volume of contaminated soil removed will be based on approved truck scale measurement and the quantity will be approved by the Contracting Officer. Any work under this

CLIN will not proceed without prior written approval and field verification from the Contracting

Officer.

h) For CLIN 0001H: Price to provide First Responder Distributed Antennae Systems within LP-48A:

Provide First Responder Distributed Antennae System within all or parts of LP-48A as indicated by results of RF Survey included as part of Base Bid in accordance with the drawings and specifications.

i) For CLIN 0008 OPTION Item No. 7: Geotechnically Unsuitable Subgrade Soil Removal, Disposal, and Replacement: Unit price for all work in connection with the removal, disposal, and replacement of geotechnically unsuitable subgrade soil (i.e. soft subgrade soils) with imported structural back fill or imported aggregate as specified. Unsuitable subgrade soil determinations must be made by the Government Geotechnical Engineer and approved by the Contracting Officer. The price shall include removal of geotechnically unsuitable soils identified during proof rolling of planned subgrades, disposal at the specified disposal facility, and backfilling the excavation with compacted imported structural backfill or imported aggregate. Soils disturbed by the contractor's construction activities, or that are excessively wet and soft due to lack of proper site maintenance and protection measures, and lack of specified drainage or excavation dewatering will not be considered unsuitable. Unit price shall include all handling and transportation. The volume of material removed and imported backfill required shall be neat quantities determined based on field measurements (length x width x depth) of the completed excavation to remove the unsuitable soil as approved by the Contracting Officer. Any work under these CLIN's will not proceed without prior written approval of the Contracting Officer and direction of the Government Geotechnical

Engineer.

j) For CLIN 0009 OPTION Item No. 8: Unit price for providing demolition and excavation of buried concrete foundations/structures, utility lines and construction debris that is encountered within planned excavation limits and not identified in the Contract Documents for demolition, greater than

½ cubic yard in size. Buried concrete foundations/structures, utility lines and debris meeting the specified criteria will be field verified by the Contracting Officer prior to removal and will be segregated from the surrounding soil during demolition and excavation operations. Pieces of buried concrete and debris encountered within the planned excavation limits smaller than ½ cubic yard in size shall be considered to be incidental to the work. Unit price shall include all work in connection with buried concrete and debris removal and disposal and replacement with clean imported structural backfill or other material specified. Unit price shall include removal and disposal of buried concrete, utility lines and construction debris encountered within planned excavations at a permitted licensed disposal facility and backfilling the excavation with compacted clean imported structural backfill or other material specified. Unit price shall include handling and transportation.

The volume of buried concrete and debris removed will be based on approved truck scale measurement and the quantity will be approved by the Contracting Officer. Any work under this

CLIN will not proceed without prior written approval and field verification from the Contracting

Officer.

k) For CLIN 0010 OPTION Item No. 9: Removal and disposal of buried asbestos containing pipe insulation: Unit price for providing all work in connection with identifications, sampling, removal, and disposal of buried asbestos containing pipe insulation. If suspect pipe insulation or pipe fitting insulation is encountered during excavation the Contractor must stop work in the immediate area until the material is properly identified (sampled) and addressed. The Contracting Officer, government Environmental Design Specialist, and Installation asbestos manager must be notified prior to sampling the pipe insulation/pipe fitting insulation. The quantity will be determined based on field measurements that are agreed upon by the Contracting Officer, government Environmental

Design Specialist, Installation asbestos manager, and Contractor. Work from this line item must not proceed without prior field verification and written approve from the Contracting Officer.

BID NOTES FOR ESS, FF&E AND A/V (LINE ITEMS 0002 – 0007)

a) The estimated amount for FF&E, A/V, and ESS has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E, A/V, and ESS including freight and installation charges. The Government FF&E, A/V, and ESS Estimate is only an estimated amount.

b) If awarded, line items will be funded separately after completion of FF&E, A/V, and ESS design package review by the Government, and receipt of appropriate funding by the Government, and receipt of appropriate funding by the Government. Requirements and details for FF&E are provided in Section 12 00 01.00 20 FURNITURE, FIXTURES, AND EQUIPMENT (FF&E)

PACKAGE.

c) Bonding

1) Bonding is not required for the design, procurement and installation of FF&E at time of

Construction Contract Award.

FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the FF&E Option Item is not part of the original contract award, the Construction Contractor must not be required to secure bond for the FF&E at the time the basic contract is awarded.

2) Additional Bond at FF&E Option Item Award

FAR 28.102-2(d) requires the Government to secure additional bond from the Construction

Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the FF&E Option Items award, to protect the Government against the

Construction Contractor not providing FF&E ordered and to ensure that the vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the FF&E funding source and is not a part of the Construction Contractor’s HAR.

3) Bonds Required by the Construction Contractor

If the Construction Contractor requires bonding from the FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.

d) Offerors may propose a Handling and Administration Rate (HAR) for the FF&E, A/V, and ESS not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E, A/V, and ESS. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E, A/V, and ESS. The proposed

HAR is a fixed rate.

e) The Government is not obligated to award Line Items 0002, 0003, 0004, 0005, 0006 and 0007.

Should the Government choose to award ESS, FFE and AV, the line item will be awarded as a negotiated modification to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E, A/V, and ESS.

f) If awarded, the FF&E, A/V, and ESS modification will be awarded at least six months prior to the contract completion date. A minimum of six months is required for the Contractor to purchase, deliver and install the FF&E, A/V, and ESS without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the FF&E, A/V, and ESS as a option. No schedule extensions will be granted if the option is awarded at least eight months prior to the contract completion date. If the Government decides to negotiate and award the furniture option with less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final FF&E, A/V, and ESS package was submitted within the approved schedule deadlines and sufficient lead time for the FF&E, A/V, and ESS is not available and the

Government's award of the option is in the last six months of the contract.
