| Industry Day Q&A's for N0001919220044 | ||
| # | Question/Feedback | Government Response |
Is the USG able to provide an estimated Level Of Effort for the PMA-261 H-53 Modification opportunity? | The SOW tasks applicable to the LOE CLIN are specificed on page 41 of the Industry Day Slides. The government will define the installation technical requirements, it is incumbent upon the offerors to define their programmatic level of effort in their proposal response. The Government will not define a minimum set of requirements.
Will Contractor maintenance fall under NAVAIRINST 3710.1G? | Yes
Will NALCOMIS be utilized to document all completed maintenance actions? | This will be accomplished by squadron personnel
Will the USG state whether Ground Operating Procedures will be required as a CDRL? | GOPs are a CDRL and SOW requirement
Will the USG consider/evaluate the Past Performance of Principal Subcontractors? | The government will consider your inputs in formulating our source selection criteria. At a minimum, the preponderance of the Past Performance must match the solicited requirements.
Will Navy / Marine Corps Aviation Past Performance be evaluated as more relevant than generalized Past Performance? | The government will consider your inputs in formulating our source selection criteria. At a minimum, the preponderance of the Past Performance must match the solicited requirements.
Will the USG state whether the prototype effort will require FAR Part 145 capability to perform prototype manufacturing capability and integration? | No. We do not anticipate FAA Part 145 repair capability as a requirement. There may be other manufacturing quality requirements in the final RFP.
The Scope of Work indicates TDs, Installation Data Packages, and Kits will be provided as Government Furnished Information / Equipment / Material. Will the USG be providing engineering, technical data development and material / supply sourcing requirements for the prototype effort? | The individual prototyping engineering support requirements will be firmly defined in the individual task orders on those CLINs with corresponding GFI provided.
Will the USG state whether they will be incorporating the Ground Flight Risk Clause (DFARS 252.228-7001)? | Yes
Will the Contractor have access to H-53 publications? | Access to NATEC for H-53 technical publications will be required for contract execution. The level of GFI to be provided for bid and proposal preperation is being assessed.
How will Property Management and Material Management Systems be evaluated? | The property management and accounting systems must be approved via DCMA. The USG is evaluating the need for an approved Material Management System at this time. In order to receive a Cost Type contract, the Contractor must have an approved accounting system. In order to recieve Government Furnished Property, the Contractor must have an approved Property Management System.
Will the contractor have access to Navy/ Marine Corps Supply systems to requisition parts? | Access to government supply systems will be made available as required.
It was stated during the brief that all documents for the draft and final RFP would be dropped in DoD SAFE. However in the slides of the brief itself it is stated “All RFP documents, Amendments, Q&A’s, and other forms of communication shall be posted on beta.SAM.gov. All information shall be provided to all parties to ensure the integrity of the competition” Will the USG reconcile these two statements? | In the brief, it was stated that all documents related to GFI would be provided to interested parties via DoD SAFE. Specifically, the Technical Directive documents will be made available upon request. These documents cannot be made available on beta.SAM. All other documents related to the RFP and other Source Selection information will be made available on beta.SAM.
Doing engine mod at new river, is this an opportunity for CTR to work on the mod during downtime? | Yes. However, we are not focusing on Eng Mods currently. The focus for the program is getting 53K into the fleet and replacing the 53E.
The list for E mods was much longer, K was shorter. | We don't have as many defined mods for K, most fall under the Emerging Modfications CLIN. The Kilo routinely identifies new AFC's in test.
With no global sites, will the work be a contractor facility? | Contractor field teams will do work at fleet locations. Both CONUS and OCONUS. Most tooling will be GFE.
Corrosion, since corrosion is the highest degraders, any know corrosion issues (not happenstance). Known corrosion could be a different CLIN. | It's a fleet bill we'd have to work the funding on. For fixes, not mitigation.
Is this a MAC? | This is a single award IDIQ.
Using modeling simulation, will modeling simulation maturity help with prototyping CLINs? | We would be willing to consider for evaluation criteria, Could be technical differentiation.
Are existing competing contracts a bridge? | We have not identified any contract as a bridge
Is a gov't LSI part of the strategy? | No.
What happens if all small businesses don't qualify? | Our market research shows there are small businesses. There's always a potential for no vendors bidding. In that case, we'll resolicit.
What's the minimum ratio for teaming large and small? | 51% small business
Can the Government provide more information on the OEM licensing requirement. | The Government is seeking feedback from industry on the feasibility and cost of obtaining licenses from the OEM.
Contractually, once a small business has been awarded, can they team with large businesses on inidivitual task orders? | If there is TO, a large business can do a whole TO as long as at least 51% of the total KT is done by the small business.
Classified work? | Secret level DD254 for avionics related installations task that require a secret clearance
Would any work be Contractor Owned/Contractor Operated tested? | All prototyping will on Government aircraft.
Is DoN LAIRCM part of any of these modifications? | Yes. It is incoprorated in the CH-53K DDSR mod, and already installed on CH-53E.
For the contract: having the LOE CLIN helps with indirect costs. Will it be funded at contract award? | The LOE CLIN will be the first task order funded at contract award and will be used for the Post Award Conference. The SOW tasks applicable to the LOE CLIN are specificed on page 41 of the Industry Day Slides. it is incumbent upon the offerors to define their programmatic level of effort in their proposal response. The Government will not define a minimum set of requirements. It is anticipated that this CLIN will be ordered via a one month unit of measure.
For the CLINs, each CLIN is designed around each TD? The install will go against the FFP, then the travel/material go against the travel/material CLINs? | Yes, FFP will be just the install labor. The material CLIN will cover incidentals.
In FY23, it looks like 167+ mods over 7 locations, then FY24, there are 73 mods+ in 7 locations, then tapering. Does the Gov't expect to level out the LEO with K coming on board? Or is most of the scope unlevel? | The schedule is draft, we expect the out-year schedule will become more firm as we get closer to RFP. The CH-53K will be most of the work in the out-years. The undefined tasks for CH-53K are larger and made to fall within orders issued on the emergent modifications CLIN. The USG expects that the amount of work under the emergent modifcation CLIN will be larger in the out years. The Government will create more specific estimates for the RFP.
When working O&A on CPFF, does that take into consideration the LOE CLIN? | The effort associated with O&A tasks would be invoiced under the O&A CLIN in accordance with a specific Task order. The LOE CLIN is distinct from the O&A CLIN.
WRT different sites, is there going to be a minimum number of staff expected at each location? Any semi-permanent locations? | We're open to feedback, we're trying to identify risk a contractor is willing to take on. Minimum staffing in locations could be a way for potential vendors to differentiate in a competitive strategy.
How many personnel or tasks will require Secret Clearance? | Secret Clearance may be required for Avionics tasks.
Is the gov't going to put out specific labor categories? | The RFP will contain specific labor categories for use on the CPFF CLINs.
In section 2.1 of the SOW, AS9110 is referenced. What about AS9100? | We are looking into various source selection criteria and requirements related to quality. We are open to feedback on these requirements.
With respect to past performance, recommend looking at H-53 depot level maintenance as criteria, but not just prime but also sub. Additionally, recommend requiremeing past performance for all the categories of tasking in the RFP, including engineering support, manufacturing, installation. | The Government will consider your inputs in formulating our source selection criteria. At a minimum, the preponderance of the Past Performance must match the solicited requirements.
One area of concern is related to the notional schedule for modifications and the location. It may be difficult to be "right sized" in terms of staffing to support the schedule. | The Government is open to feedback on balancing workload and level-loading staffing. Additionally, the schedule is currently a draft. We anticipate more specific detail regarding the schedule in the draft and final RFPs.
Are spares necessary for installation included as part of CLIN 0026? | Yes, this CLIN is for kits and could include spare parts that are incidental to installation. The CLIN is not for Production spares which are purchased separately using APN-6.
Will there be any prototyping on this contract? | There will not be hardware prototyping, but there may be labor requirements to support installation of prototypes and prototyping support including validation and verification.
Do we anticiapte any reverse engineering requirements related to obsolescence/sustainment ? | None is anticipated.
For pricing FFP CLINs, will that include material? | For anything on FFP, we'll provide A kit and B kit, FFP will be just installation labor.
What would the gov't expect to see in an OCI mitigation plan? | Mitigation of OCI's is the contractor's responsibility. There are mutliple types of OCIs and the response may be different depending on the type of OCI and the particular circumstances. For some OCIs, such as access to information, a firewall might be an effective mitigation strategy, depending on the circumstances. We encourage you to consider whether there is a risk of all the types of OCIs and address any risk in the mitigation strategy.
Do you see an FMS element in this contract for the contract? | We don't expect FMS under this contract
How will major subcontractor past performance be evaluated? | The Government is open to feedback of past performance structure. The preponderance of the evaluated past performance has to correspond with the scope of contract.
Would the gov't consider relaxing approved material pruchasing system & property management systems, or at least make it required post award? | The Government is still considering the extent of its material requirements. Property management probably will not be able to be relaxed. The Government is considering whether the requirement will be at time of contract award or possibly within a window of time after award.
How will the Government define major subcontractors? | We have not defined the threshold for major subcontractors and are open to feedback.
Why is the contract 5 years vs 10? | It's a 5 year ordering period and could have up to 9 years of performance if four year order was issued in the last year of the ordering period. Contracts longer than 5 years require additional justification and at this time, it was determined that it wasn't in the Government's best interests to commit to a longer term contract.
Will the Government provide guidance on which sites will require continuous staffing, and which will require field teams? | The Government is open to feedback, we're trying to identify risk a contractor is willing to take on. Minimum staffing in locations could be a competitive strategy.
Do you see an engineering presence being greater on the contract to do tasks such as developemnt of an ECP? Or will the engineering be more related to validation and verification? How will the engineering piece be covered in the proposal? | This effort will not be responsible for ECPs or major requirements for enginering changes. The H53E will not have many changes other than safety. For the H53K, the majority of engineering will be accomplished organically or with the OEM, Sikorsky, since we're still in test. The 53K is not expected to complete all testing prior to the close of this contract.
Will Yuma be a permanent site or travel site? | The Government is open to feedback, we're trying to identify risk a contractor is willing to take on. Minimum staffing in locations could be a competitive strategy.
Feedback: A best value structure is good and past performance would be a useful evaluation criteria to achieve best value. | The Government appreciates this feedback and will take it under advisement in determining the evaluation criteria.
Will the Government require resumes for key personnel? | No. This contract is considered a product as opposed to services. Key personnel are typically only requried for services contracts.
Feedback: Recommends doing the first few modifications as CPFF then converting to FFP once the actual costs are known. | The Government appreciates this feedback and will take it under advisement is determining the evaluation criteria.
What type of tasks will O&A CLIN be used for? | O&A will be for repairs that are discovered during performance and that need to be accomplished in order to complete the aircraft modification. They type of work will be dependent on specific mod. It will not be used for corrosion control.
Will O&A be a plug-in number of hours? | Yes, for proposal submission we anticipate providing a set number of hours.
The kit build requirements seem open ended. Will some be manufactured on this contract and some provided as GFE? | Yes, many kits will be built on separate contracts and provided as GFE. Some may be built by this contractor and then provided back to the contractor as GFE to complete the installation.
Is the expectation that the offerror gets a drawing? | Yes, when the Government issues a Request for Cost Submission, it will provide the necessary technical data.
For which tasks would we use CLIN 0026-0027 vs 0033 | CLIN 26 is for manufacture of kits, whereas CLIN 33 is for material incidental to the installation of a kit provided as GFE.
Can the Government elaborate on the OEM licensing. What would be required to obtain a license? Is obtaining the licencing a prerequisite? | Licenses are negotiated company to company, so other entities have been able to execute those arrangements. Enter into a maintenance agreement between companies, allow access to drawings for installation/maintenance. The license would be for 53K only. The Government has all the necessary data for the H-53E. The Government acknoewledges that may be a challenge to get licenses and we're looking for feedback. Looking to see if industry can do it. It's not uncommon for the OEM Lockheed Martin/Sikorsky to enter into licenses. It would not be unusual to reach out at this point in the procurement, it happens regularly.
NAVAIR has identified the pricing structure, does the Government intend to have a single price within a certain year for FFP, or does the contractor take on risk. Feedback: The unknowns in the schedule may result in price risk and challenges in proposal preparation. A suggestion for overseas work is to allow flexible hours to lower per diem costs. | The Government appreciates the feedback on pricing and risk. We are looking at whether our current structure has the right balance of risk and how can we reduce the price risk. Use of field teams could be a competitive strategy; however, the Government is looking to the Offerors to establish the best approach to performing the work.
The Medford location in map is not in schedule. | The Government is still finalizing the schedule. We will take a look at this and make in corrections prior to final RFP.
Is the base contract the IDIQ then orders are issued from it? | Yes. Additionally, the first order issued will be for CLIN 29, LOE.
What type of funding will be used for this effort? RDT&E? | This effort will primarily be funded with APN-5 and there is the potential for some OM,N.
Will O&A be separately negotiated? The processing timeline may be problematic. It's administratively burdensome to approve O&A, it's a disincentive. | The Government will take that feedback into consideration. In order to avoid making O&A efforts become the focus of the contract, we are narrowing this CLIN to repairs discovered during performance and that need to be completed in order accomplish the modification.
Is there a timeline associated with approval of contractor business systems? (material management and property management). Additionally many companies may never have had to do EVM. There is a cost and time element for having DCMA approve. | The Government is trying to keep the value of this contract below the thresholds for many of the more burdensome systems, such as EVM. We are trying to avoid needing to require business systems that many small businesses have not had to procure before. The most likely systems that will be required are approved accounting systems and Government property management. Additionally, the Government is considering whether the requirement will be at time of contract award or possibly within a window of time after award.
Feedback: Cost reimbursement contracts present management challenges for contractors, FFP can become rigid and not as flexible. FFP efforts may be a higher risk for price. | The Government appreciates the feedback on pricing and risk. We are looking at whether our current structure has the right balance of risk and how can we reduce the price risk.
FFP for 5 years results in a lot of price risk for the contractor, particularly given the uncertainty in the schedule. The more specifics that can be provided for the per year schedule, the less price risk falls on the contractor. How will new requirements be a priced and will they be awarded on a sole sources basis. | The Government appreciates the feedback on pricing and risk. Orders for new requirements will be issued under CLIN 0025 for Emergent Modifications and will be CPFF. Based on our contract structure, we do not anticipate needing to award any "sole source" modifications that would require a Justification & Approval pursuant to FAR Part 6.3, Other Than Full and Open Competition. This is a single source IDIQ, so there will not be competition for actions awarded uder the IDIQ structure.
Will validation and verification be on a CPFF CLIN? Once through val/ver and there is a defined TDP, will the installation be FFP? Is the FFP effort limited to what is defined today? | Validation and Verification will be CPFF. The Emergent modifications CLIN, which is CPFF, will be used for any new TDs. For the CPFF CLINs, the RFP will likely require offerors to propose rates for the whole ordering period.
If the offeror proposes CPFF rates out 5 years based on a certain set of assumptions, what gets invoiced is actuals as rates can change. Is that correct? | Yes, that's correct. For evaluation purposes, the RFP will provide a set number of hours and labor mix. Once the contract is awarded, the Government will provide the TDs when it issues a Request for Cost Submission and the hours and labor mix will be negotiated . This process is explained in the draft ordering procedures and will be contained in the final RFP. Although the contractor will bill actuals, the negotiation to establish the ceiling of the delivery order will utilize the proposed rates of the apparently successful offeror..
How does Government anticipate pricing and ordering for prototyping efforts on CLIN 0028? | Each prototype order will be separate, then followed by a seperate order for a defined number of installs.
AS9110C Quality Management System Certification was identified as a requirements document. Is certification a requirement prerequisite for award? | We are looking into various source selection criteria and requirements related to quality. We are open to feedback on these requirements.
If we have a subcontractor, can we use sub past performance? Does it have to be specifically H-53 work? | The Government is open to feedback of past performance structure. The preponderance of the past performance has to correspond with the scope of contract.
Feedback: Recommend trying to combine as many mods into each order as possible. Try to keep a type in one spot as much as possible. | The Government appreciates the feedback on pricing and risk. We are looking at whether our current structure has the right balance of risk and how can we reduce the price risk.
Will SCA apply? | No
Is this a single award IDIQ? | Yes
Is the current work an IDIQ? | Yes
How will the material be proposed? | There will be a plug number for materials.
Will HAZMAT consumables be provided? | HAZMAT requirements and source of supply will be specified in each TD and procured by the squadron.
How many teams/sites at any given time? | The schedule is draft, we expect the out-year schedule will become more firm as we get closer to RFP.
Will unique support equipment be GFP? | Yes, Unique SE will be GFP.
Will license agreement be mostly for K? | Yes, license agreement will be with the OEM for CH-53K related mods.
Is there a point of contact at the OEM ? | We will make that available after we get the information from the OEM.
Will any crypto requirements be handled locally? | Generally, yes. Specific cryptographic handling requirements will be defined in each Technical Directive Task Order.
Will drawing data be provided with each modification? | For FFP CLINS, the GFI (including drawings) will be available for bidding purposes with RFP. For the CPFF CLINs, as much GFI will be provided as possible with RFP, drawings will be provided prior to being asked to provide a Request for Cost Submission on the individual Task Order.
Will each location have the special support equipment and tooling? How will HAZMAT be handled? | Yes, SE will be provided as GFP. HAZMAT requirements and source of supply will be specified in each TD and procured by the squadron.
Is this effort Service Contract Act covered? | No
Different locations have different pricings structure, how can the price be the same in different locations? Suggestion: having a multiplier for different regions. | The Government appreciates the feedback on pricing and risk. We are looking at whether our current structure has the right balance of risk and how can we reduce the price risk. Use of regional multipliers could be a competitive strategy; however, the Government is looking to the Offerors to establish the best approach to performing the work. FFP CLINs will only cover the labor, all travel and incidentals will be cost. It's up to the contractor to amortize risk.
Will the contractor be taking possession of the aircraft? | No
Efficiencies can be gained doing a mod repetitively, the number is still unknown. If the contractor can do mods concurrently, it lowers the price. | The Government appreciates the feedback on pricing and risk. We are looking at whether our current structure has the right balance of risk and how can we reduce the price risk. Use of efficiencies and concurrency could be a competitive strategy; however, the Government is looking to the Offerors to establish the best approach to performing the work. FFP CLINs will only cover the labor, all travel and incidentals will be cost. It's up to the contractor to amortize risk.We can't determine timing on every single mod. Efficiency factors could be proposed as a contract term.
Are the modifications done on the ramp or in the hangar? | Depends on location. The Gov't will not assume any liability for falls. Followup on the fall protection stand?
Will there be a fall protection stand? | There will be fall protection. The Gov't will not assume any liability for falls. Followup on the fall protection stand?
How will past performance be graded? | The government will consider your inputs in formulating our source selection criteria. At a minimum, the preponderance of the Past Performance must match the solicited requirements.
Did the Government consider an 8(a) setaside? | Based on market research, the Government did not think there were enough qualified 8(a) businesses to support an 8(a) set-aside competition.
