1.0 Scope
This Statement of Work (SOW) defines the requirements necessary to perform non-recurring and recurring efforts required to fabricate, assemble, and support prototyping/system integration/installation of Engineering Changes to aircraft designated by the H-53 Program Office, PMA-261.
1.1 Statement of Problem(s):
CH-53E, CH-53K, and MH-53E require depot modifications to support fleet requirements.
1.2 System Description:
1.2.1 The CH-53E Super Stallion has proven to be extraordinarily relevant to the execution of our national security strategy, Navy and Marine Corps warfighting concepts and the associated need for capable heavy lift. The Super Stallion incorporates Global Positioning System (GPS), Forward-Looking Infrared Radar (FLIR), Aviator Night Vision Imaging Systems Heads Up Display (ANVIS-HUD) sensors, and carries three (3) 50 caliber guns (as a mission kit). Communications include Ultra High Frequency (UHF)/Very High Frequency (VHF)/High Frequency (HF) radios, secure communications capability, and Identified Friend or Foe (IFF).
1.2.2 The CH-53K is the United States Marine Corps’ (USMC) heavy lift replacement for the CH-53E. The most powerful helicopter in the Department of Defense, the CH-53K is a new-build helicopter that will expand the fleet’s ability to move more material, more rapidly throughout the area of responsibility using proven and mature technologies. Designed to lift nearly 14 tons (27,000 lbs/12,247 kg) at a mission radius of 110 nautical miles (203 km), in Navy high/hot environments, the CH-53K is designed to lift triple the baseline CH-53E lift capability with an equivalent logistics shipboard footprint, lower operating costs per aircraft, and less direct maintenance man hours per flight hour.
1.2.3 The MH-53E Sea Dragon incorporates Global Positioning System (GPS), Doppler radar, and an Approach/Hover/Tow Coupler. Communications include Ultra High Frequency (UHF)/ Very High Frequency (VHF)/ High Frequency (HF) radios, secure communications capability, and Identified Friend or Foe (IFF). The MH-53E Sea Dragon will perform the Airborne Mine Countermeasures (AMCM) mission until at least 2025.

3.0 General Requirements
3.1 The Contractor shall install the Technical Directives (TD) listed in Section 3.11, provided as Government Furnished Information/Equipment/Material (GFI/E/M), in accordance with the quantities and schedule per Enclosure (X). The Contractor shall inventory kits to ensure one-hundred percent kit accuracy and immediately notify the Government of any deficiencies. The Contractor shall conduct installations in accordance with the schedule in Enclosure (X).
3.2 The Contractor shall be responsible for inspection, disassembly, modification, assembly, post-inspection, and documentation of aircraft modification kit installations in accordance with COMNAVAIRFORINST 4790.2 Series, H-53 Maintenance Instruction Manuals (MIMs), and the applicable TD.
3.3 The Contractor shall have the capability to obtain licensing/agreements with the Original Equipment Manufacturer, Sikorsky Aircraft Corporation, to develop and execute aircraft modifications requiring USN airworthiness certifications.
3.4 The Contractor shall ensure installed modifications meet all TD Operational Checks and Post Operational Checks requirements. Any operational checks requiring main aircraft grounds turns or Functional Check Flight (FCF) requirements will be conducted by the Government. If the TD Operational Checks and/or Post Operational Checks requirements cannot be met, the Contractor shall contact the Government TPOC for Government direction.
3.5 Whenever possible, multiple modifications on an aircraft will be combined and installed at the same time to reduce the amount of time an aircraft will be unavailable for fleet operations. Aircraft modification kit installations shall be completed at various continental United States (CONUS)/outside of the continental United States (OCONUS) locations listed in Paragraph 8.0 of this SOW.
3.6 Naval Aviation Technical Data & Engineering Services Command (NATEC) Technical Publication Library (TPL) Database Program Contractor shall gain access to the NATEC and its TPL site, and shall use the most current version of NAVAIR manuals and technical directives.
3.7 Contractors Requiring Access to a DOD Facility or Installation. The Contractor and all associated subcontractor employees shall comply with adjudication standards and procedures using the National Crime Information Center (NCIC), Department of Defense Instruction (DODI) 5525.19, DODI 5200.46, and applicable installation or facility access policies and procedures provided by the Government as specified in the individual TOs. Contractor and all associated subcontractor(s) employee(s) shall comply with adjudication standards and procedures as previously mentioned in conjunction with Status of Forces Agreement (SOFA) and other theater regulations at OCONUS locations.
3.8 Contractor personnel performing installations on aircraft at MAG-36, Okinawa, Japan will have Status of Forces Agreement (SOFA) Article I(b) status. The contractor shall comply with US Forces Japan Instruction 64-100, Contract Performance in Japan. The Contractor shall use the Synchronized Predeployment and Operational Tracker (SPOT) web-based system, to enter and maintain the data for personnel supporting MAG-36 in Okinawa, Japan. The Contractor shall enter the required information about their contractor personnel prior to deployment and shall continue to use the SPOT web-based system at https://spot.dmdc.mil to maintain accurate, up-to-date information throughout the deployment for all Contractor personnel.
3.9 The Contractor shall support overtime requirements necessary to facilitate the work accomplished at each of the locations. All required overtime must be authorized by the TPOC/Procuring Contracting Officer prior to working.
3.10 Over and Above Work.
In the event the contractor determines additional Organizational or Depot level work is required due to inspection or discovery while performing installation tasks under any task order, the Contractor shall notify the TPOC and PCO of the discovery no later than 24 hours after discovery via Enclosure (X) Over and Above Form. If the Government directs the correction of these defects, they shall be considered to be over and above efforts. In accordance with the H-2 Clause on N0001922R0044.
3.11 Installs
Installations will be conducted in accordance with Enclosure (X), Schedule. Attachment (X) to Solicitation Number N0001922R0044 captures all Government Furnished Information (GFI) provided below. Additionally, Enclosure (X) to this SOW provides a table reflective of each install by SOW Paragraph and associated Technical Directive. All GFI will be provided with Request for Proposal (RFP) release unless noted otherwise.
3.11.1 CH-53E
3.11.1.1 AFC-586 Engine Nacelle Installations
The Contractor shall remove legacy nacelles and install improved Engine Nacelle kits on the CH-53E aircraft in accordance with AFC-586.
3.11.1.2 AFC-601 APR-39D(V)2 Installations
The Contractor shall install the APR-39D(V)2 in accordance with AFC-601 on identified CH-53E aircraft and trainers/training devices.
3.11.1.3 AFC-TBD Fire Suppression Installations
The Contractor shall install Fire Suppression Installations in accordance with AFC-TBD on identified aircraft and trainers/training devices.
3.11.1.4 AFC-519 PT3 IMDS Installations
The Contractor shall install IMDS Installations in accordance with AFC-519 PT3.
3.11.1.5 AFC-571 Embedded Global System/Inertial Navigation System (EGI Installation) The Contractor shall install EGI Installation in accordance with AFC-571.

3.11.3.4 AFC-TBD Digital Interoperability-Medium (DI-Med)
The Contractor shall install digital interoperability-medium on identified CH-53K.
3.11.3.5 Emergent Modifications
The Contractor shall install emergent modifications on identified CH-53K utilizing Government Furnished Information (GFI) that will be provided on individual Task Orders, utilizing Labor Categories as defined in Enclosure (X).
3.12 Modification Completion and Government Inspection
The Contractor shall be responsible for supporting the Government personnel to ensure technical directive operational checks and COMNAVAIRFORINST 4790.2 Series (Naval Aircraft Maintenance Program (NAMP)) requirements have been satisfied. The Contractor shall submit a Bureau Number (BUNO) specific Modification Certificate of Conformance (CoC) for each aircraft, in accordance with CoC (CDRL A00C).

3.13 Aircraft Retrofit Kits
The Contractor shall design and develop aircraft retrofit A Kits per Government provided GFI.
3.14 Program Management
The Contractor shall manage the overall program for cost, schedule and performance. The Contractor shall establish management systems to provide planning and control of technical activities, subcontract activities, risk and opportunity management of cost, schedule and performance including recommended solutions to resolve program issues.
3.14.1 Program Plans and Controls
3.14.1.1 The Contractor shall develop, maintain, and execute to an Integrated Program Management Report (IPMR)/Integrated Master Schedule (IMS) that includes a detailed schedule for engineering efforts, design development, hardware procurement, and manufacturing efforts, and all program meetings and milestones in accordance with CDRL A001 . The schedule shall include necessary elements, durations, start and finish dates to successfully complete the effort. Upon approval of PMA-261, this schedule shall be baselined by the Contractor, and used as the master schedule. Re-baselining of the schedule shall not occur without PMA-261 approval.
3.14.1.2 Contractor shall submit a tailored IPMR in accordance with CDRL A001 (Format 1, Formats 5-7). The Contractor shall support a joint schedule scrub no later than 60 calendar days after contract award. The joint team will assess the contractor’s baseline to ensure complete coverage of the statement of work, logical scheduling of work activities, adequate resourcing, required management processes are appropriately implemented and identification of inherent risks are apparent.

3.14.2 Post Award Conference
No later than ten (10) business days after award, the contractor shall participate in a post award conference at a location to be determined. The duration of the Post Award Conference shall not exceed one business day. The purpose is to allow the contractor(s) and the Government to establish lines of communication, set program objectives, priorities, and address issues or concerns. At a minimum, the conference agenda shall encompass staffing, transition plans and site implementation activities. The Contractor shall deliver the agenda in accordance with Meeting Minutes (CDRL A002).

3.14.3 Program Meetings and Reviews
The Contractor shall host semi-annual Program Management Reviews (PMRs) that will alternate between the contractor facility and Patuxent River, MD unless extenuating circumstances prevent travel then a virtual means will be utilized. Each PMR shall not exceed two working days. The contractor shall evaluate and coordinate site personnel attendance as required to support the PMRs. PMR content shall encompass all aspects of contract cost, schedule, performance and quality. The contractor shall coordinate agenda items, briefing materials, meeting minutes and action items in accordance with Meeting Minutes (CDRL A003).

3.14.4 Weekly Integrated Product Team (IPT) Meetings
The Contractor shall support weekly IPT meetings via conference call or Microsoft Teams. The contractor shall support any additional meeting requests or teleconferences as directed by the TPOC. Meetings shall be no longer than 1 hour in duration.
3.14.5 Pre-Induction Meeting
The Contractor shall participate in aircraft modification pre-induction meetings. These meetings will be hosted by the Government via conference call no later than (NLT) seven (7) calendar days prior to an aircraft induction. The TDs will be provided seven (7) days prior to pre-induction meeting for compliance/incorporation. Based upon the results of the pre-induction meeting, the aircraft Estimated Completion Date (ECD) will be baselined by the TPOC on the date of induction.
3.14.6 Transition
The Contractor shall fully cooperate in planning, committing resources, and communicating with the Government and the incumbent and follow-on contractors to provide an orderly transition between contracts. The Contractor shall manage its activities during transition and monitor, document and report all concerns to the TPOC in writing. The Contractor shall be required to perform orders under this contract while the incumbent contractor is completing contractual requirements under the previous contract. The Contractor shall carefully coordinate resource requirements, to include transition of incumbent personnel and use of Government facilities and GFE/M to prevent disruption of support to on-going requirements. The Contractor shall cooperate in the resolution of all transition issues to assure successful performance of requirements under this contract and to prevent disruption of performance under the incumbent contract and any follow-on contract. The Contractor shall appoint a site Contractor Project Lead (CPL) for the transition effort to interface with the TPOC.
3.14.6.1 Transition Phase-In
3.14.6.1.1 The Contractor shall provide program management and oversight during transition-in to ensure that tasks executed during the transition-in period are successfully performed with no negative cost, schedule, or performance impact to the tasks being completed by both the Contractor and the incumbent. The Government’s intention is to have a clean line of demarcation between aircraft being completed on the previous contract and the start or performance on this contract. The Transition Phase-In period begins on the period of performance start date and shall last for a period of 30 calendar days. The Transition Phase-In shall be the Contractor's preparation period for the purpose of hiring, relocating, and training of personnel. This includes: site familiarization; ordering material; inventorying GFP; developing site specific Ground Operating Procedures (GOPs); and coordinating all Phase-In matters associated with the Contractor's execution of the H-53 Modification functions to enable the Contractor's personnel to perform the requirements specified in this TO. During the Transition Phase-In period, the incumbent Contractor is fully responsible for maintenance operations and all GFP (A004). The incumbent Contractor is responsible to manage and maintain accountability of material until delivered and accepted by the Government. The contractor shall support a joint inventory at all locations including aircraft Work in Progress (WIP) with the incumbent contractor and government. The Contractor shall deliver its plan in accordance with Transition Plan Phase-In (CDRL A005).
3.14.6.1.2 The Contractor shall be 100% staffed at 30 calendar days after award. The Contractor shall provide the TPOC a weekly status report by email, until staffed at 100% that outlines the steps taken in the previous week to ensure that the Contractor is on track to have all personnel hired in the timeframe outlined above. The Contractor shall report transition progress to the H-53 Modification IPT on weekly basis via teleconference.

3.14.6.2 Transition Phase-Out
The Contractor shall perform transition-out efforts and ensure an orderly transition between this contract and efforts required by any follow-on contract. The Contractor shall ensure that all tasks executed under this contract are successfully completed during the transition out phase with no negative cost, schedule, or performance impact to the tasks required by this contract and any follow-on contract. The transition process may involve the temporary sharing and/or eventual transfer of GFP. During this transition period, the Contractor shall ensure that GFP is properly maintained during and after use to promote the safety and well-being of all personnel. During this Transition Phase-Out period, the incumbent Contractor shall be fully responsible for continued operations. The Contractor shall continue to manage and maintain accountability of material until delivered and accepted by the Government. The Contractor shall report transition progress to the H-53 Modifications IPT on weekly basis via teleconference. The Contractor shall deliver its plan in accordance with Transition Plan Phase-Out (CDRL A006).

3.14.7 Contract Management and Administration
3.14.7.1 The Contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between the support operations as specified in this TO and the contractor's corporate offices. The Contractor shall establish processes and assign appropriate resources to effectively administer the requirement.
3.14.7.2 The Contractor shall identify points of contact as specified in this TO. The Contractor shall manage and account for employees during normal working hours and designated Government non-work days or other periods when Government sites are closed or in restricted access. The Contractor shall provide necessary infrastructure to support contract tasks as specified in this TO. The Contractor shall be responsible for the selection, recruitment, hiring, assignment and reassignment of duties, transfer, supervision, management, control, and termination of contractor employees in performance of the RESET requirements. The Contractor shall provide all qualified personnel required for maintenance at the site as specified in this TO. The Contractor shall accommodate rapid response and deployment to any designated operational Government location worldwide as specified in this TO.
3.14.7.3 The Contractor shall be responsible for the management and administration of contract personnel performing this task, and the Contractor bears all responsibility for Contractor performance. All managerial duties for Contractor personnel shall be the responsibility of the Contractor, not the Government. The Contractor shall assign a Program Manager as the main Point of Contact (POC) between the Government and the Contractor.
3.14.7.4 The Contractor shall independently determine how best to complete the desired workload, and not as an agent of the Government furnish the necessary qualified personnel to perform the work.
3.14.7.5 The Contractor shall submit a monthly progress/status report in accordance with the Program Management Report (CDRL A001), to include monthly financial expenditures against each Contract Line Item Number (CLIN); current performance against program objectives as identified in Paragraph 5.2.1 Turn-Around Time (TAT); and any additional issues not previously reported to the Government.
3.14.8 Quality Assurance/Quality Control (QA/QC) Program
The contractor shall implement and maintain a Quality Assurance (QA) program. The Contractor shall develop and use a QA program to support quality maintenance on aircraft, systems, subsystems, and support equipment as specified in this contract. The Contractor shall prepare and implement a quality control plan to support quality service to meet program and site-specific requirements, in accordance with Quality Control Program Plan (CDRL A007). The Contractor shall develop and submit Standard Operating Procedures (SOPs) for internal policies, Local Operating Instructions (LOI), GOPs, as well as detailed procedures for inspections, repairs, and records maintenance as specified in this contract in accordance with Contractor Ground and Flight Operations Procedures (CDRL A007).

The Contractor is responsible for performing or having performed all inspections and tests necessary to substantiate that the supplies furnished under this contract conform to contract requirements, including any applicable technical requirements for specified manufacturers’ parts.
3.14.9 Performance and Cost Reports.
The Contractor shall prepare a Performance and Cost Report (CDRL A008).

3.14.10 Monthly Status Report
The Contractor shall prepare a Technical Report - Study/Services, which indicates the progress of work and the status of the program and the assigned tasks, to include aircraft modification status, ECD, a Bill of Material (BOM), procurement tracking sheet, shipping tracking sheet, annotating purchase order number and anticipated delivery date, and also informs of existing or potential problem areas. This report shall also include current on-hand inventory, tracked at piece part level, (CDRL A009).

3.14.11 Integrated Product Teams (IPTs)
The Contractor shall conduct IPTs consisting of the PMA-261, Prime Contractor, and relevant Sub-Contractors every other week to discuss technical, schedule, and performance matters throughout the project’s lifecycle. IPTs shall be held at the Contractor’s Facility with dial-in capability for customers and remote locations. IPT meetings shall include regular attendance by all members of the IPT core team with additional ad hoc participation by functional area representatives as required by the IPT. The Contractor shall prepare a record of all meetings (CDRL A002).

3.15 Configuration Management (LOE)
The Contractor shall designate a single point of contact for all configuration management (CM) functions. The Contractor shall maintain configuration control in accordance with the Contractor’s established CM procedures. The Contractor shall impose and enforce these CM requirements on all Sub-Contractors and vendors.
3.16 Data Management (LOE)
During this Contract, all data pertaining to the individual Contract shall be returned to the Government or destroyed upon Contract expiration. The Contractor shall not retain classified or unclassified material generated or received under this contract and any resultant contract action after the individual Contract ends without written approval from the appropriate office of primary responsibility. The Government will retain custody of all records associated with contractor deliverables and will have exclusive control of all records associated in the distribution of all written deliverables. At the end of the Contract, if the Contractor elects to destroy unclassified data, confirmation of destruction shall be provided to TPOC no more than 60-days after end of contract.
4.0 Engineering
4.1 Prototyping/ Validation (VAL)/Verification (VER) Support
The Contractor shall assist NAVAIR in modification efforts by providing support to prepare Technical Data Packages (TDP), Installation Data Packages (IDP), and attending Technical Interface Meetings (TIMs). The assistance required shall be at the senior/expert level in the respective technical field. The senior/expert level technicians shall advise on best practices to develop installation instructions and procedures for new TD TDPs and IDPs. During the prototype and VAL/VER process of a new TD, the senior/expert level technicians shall review draft IDPs for accuracy of installation instructions and procedures. Senior/expert level technician communication for recommendations shall occur through the IPT forum. During prototype and VAL/VER installations senior/expert level technicians shall perform a physical kit inventory to include comparing the kit inventory to the material list on the TD to ensure accuracy. Submit any necessary data to draft installation feedback and draft engineering action chit (EAC) – add manual/form/reference document (CDRL A00A).
Additionally, the Contractor shall provide rapid engineering and technical support services in the areas of air vehicle, avionics, and systems integration design engineering in support of ongoing installations, to include the following tasks:
Air vehicle:
(1) Rapid design and modeling of aircraft racks, shelves and hard points
(2) Rapid development of structural analysis
(3) Manufacturing and installation drawings development
(4) Technical directive and technical manual source data development
Avionics:
(5) Rapid aircraft lighting and instrumentation panel design/modification and prototyping
(6) Rapid avionics weapon Replaceable Assembly design/test
(7) Rapid aircraft wiring design and installation
(8) System level test bench design, development and documentation
Integration:
(9) Rapid engineering and technical support for electrical and mechanical systems integration
(10) Rapid electrical systems cable harness design, development, and documentation
(11) Rapid aircraft systems hardware/firmware installation
VAL/VER Report The Contractor shall document all TD, data, drawings, and installation instruction changes/corrections using a VAL/VER report and submitted to the Government (CDRL A00B).

4.1.2 The Contractor shall participate in TD/Installation Data Package (IDP) development and reviews. The Contractor shall evaluate and review externally generated TDs/IDPs. The Contractor shall evaluate and review aircraft integration, validation, verification, and installation of modernization efforts defined by TDs and Engineering Change Proposals (ECP). The tasks will be conducted at fleet field locations.
4.2 Supportability
4.2.1 Common Access Card (CAC)/Public Key Infrastructure (PKI) The Contractor shall establish within 30 calendar days of contract award CAC/PKI card capability. This shall be required to execute Modification support. Access to one or more of the following websites may be required:

The Contractor shall maintain the capability for all employees to communicate externally with United States Marine Corps (USMC), United States Navy (USN) and other DoD personnel via digitally signed and encrypted email.
4.2.2 Document Control
The Contractor shall employ the latest versions of technical manuals, instructions, drawings, specifications, inspection or test instructions, and other documents necessary to satisfy production, inspection, testing as specified in the requirements of this TO. The Contractor shall maintain records of all maintenance actions, inspections, tests and material transactions. The Contractor shall record program requirements, contract actions, and reports digitally in Microsoft Suite compatible format. All documents generated in the conduct of this task order shall be made available upon request by the TPOC.
5.0 Security
5.1 Security Requirement
5.1.1 The Contractor shall implement and maintain security procedures and controls to prevent unauthorized disclosure of controlled unclassified information and to control distribution of controlled unclassified information in accordance with DoD 5220.22-M, National Industrial Security Program Operating Manual (NISPOM), and Secretary of the Navy (SECNAV) M-5510.36B. All Contractor facilities shall provide an appropriate means of storage for controlled unclassified information and materials. All controlled unclassified information shall be appropriately identified and marked as For Official Use Only in accordance with Department of Defense Manual (DoDM) 5200.48, Controlled Unclassified Information (CUI).
5.1.2 CUI including Legacy FOUO and Covered Defense Information (meeting the definition of 48 CFR 252.204-7012(a)) generated and/or provided under this contract shall be marked and safeguarded as specified in DoD Instruction 5200.48, CUI available at https://www.esd.whs.mil/Portals/54/Documents/DD/issuances/dodi/520048p.PDF. Any product containing Covered Defense Information shall be assigned a distribution statement (distribution statements B through F) using the criterial set forth in DoDI 5230.24 (Distribution Statements on Technical Documents); and have this statement displayed per DoDI 5230.24, Enclosure 3.
5.1.3 All controlled unclassified technical information shall be appropriately identified and marked with the following distribution statement(s): Distribution Statement D: Distribution authorized to Department of Defense and U.S. DoD Contractors only (Administrative or Operational Use), (date of SOW generation). Other requests shall be referred to PROGRAM EXECUTIVE OFFICER, AIR ASW ASSAULT AND SPECIAL MISSION PROGRAM (PMA-261), 47123 Buse Road, Bldg 2272, Room 155, Patuxent River, MD 20670.
5.2 Operational Security Program (OPSEC)
The Contractor shall develop, implement and maintain an OPSEC program to protect controlled unclassified and classified activities, information, equipment, and material used or developed by the Contractor and any subcontractor during performance of the contract up to and including the level of SECRET. The Contractor shall be responsible for the subcontractor implementation of the OPSEC requirements. This program may include Information Assurance and Communications Security (COMSEC). The OPSEC program shall be in accordance with National Security Decision Directive (NSDD) 298, and at a minimum shall include:
(1) Assignment of responsibility for OPSEC direction and implementation.
(2) Issuance of procedures and planning guidance for the use of OPSEC techniques to identify vulnerabilities and apply applicable countermeasures.
(3) Establishment of OPSEC education and awareness training.
(4) Provisions for management, annual review, and evaluation of OPSEC programs.
(5) Flow down of OPSEC requirements to subcontractors when applicable.
While performing aboard NAVAIR or NAVAIR sites, the contractor shall comply with facility OPSEC program instructions and contribute to organizational-level OPSEC efforts. Include OPSEC as part of its ongoing security awareness program and take all required Agency training. Be responsive to the Supporting OPSEC Manager on a non-interference basis. Protect sensitive unclassified information and activities, which could compromise classified information or operations, or degrade the planning and execution of operations performed by the responsible officer and contractor in support of the mission.
5.3 Cybersecurity
5.3.1 The Contractor shall ensure continued adherence to the Department of the Navy’s (DON) Cybersecurity Program prescribed methodologies in protecting and defending information and information systems by ensuring their availability, integrity, authentication, confidentiality, and non-repudiation to support the DON missions. The Contractor shall utilize existing methods and processes in order to deliver secure, interoperable, and integrated information management and information technology (IT) to the DON and its contract support.
5.3.2 The Contractor shall ensure that the system(s) in no way violate a current Authority to Operate (ATO), Conditional Authority to Operate (CATO), or Interim Authority to Test (IATT) issued by the CH-53K Authorizing Official. All hardware and software changes required by this statement of work shall be assessed for negative cybersecurity impact to the aircraft.
5.3.3 The Contractor shall ensure that all IT systems, software and interfaces that contain Government data meet Government security certification standards in compliance to DFARS clause 252.204-7012 and requirements appropriate to the particular classification level of operation as specified by the US Navy, Department of Defense, or other cognizant government authority for the purposes of the above-mentioned DON goals in accordance with SECNAV Instruction 5239.3C and OPNAVINST 5239.1D.
5.3.4 The Contractor shall ensure that personnel who perform any of the IA functions described in Chapters 3 and 4 of the DOD 8570.01-M, IA Workforce Improvement Manual, possess the information assurance certification to perform the information assurance functions. The Contractor shall provide a counterpart point of contact to the Program Information System Security Manager (PISSM), herein identified as the Cyber Security (CS) Point of Contact (POC). The CS POC shall ensure that the Contractor is aware of and adheres to all CS requirements. The CS POC shall coordinate with the PISSM in all matters related to CS.
5.4 Public Release
Any controlled unclassified information pertaining to this contract shall not be released for public dissemination, including posting to any social media sites such as Facebook or Twitter, unless it has been approved for public release by appropriate U.S. government authority. Proposed public releases shall be submitted for approval prior to release through PEO (A), Public Affairs Office, 47123 Buse Road, RADM William A. Moffett Building 2272, Patuxent River, MD 20670-1547.
5.5 Government Controlled Installation, Facility or Area
5.5.1 Contractor working on a Government controlled installation, facility or area, shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures. The contractor shall comply with all applicable physical and cyber security requirements identified in Enclosure “A” Reference Documents, abide by direction given by military police or other security personnel, and adhere to installation traffic laws, and other governing policies. Contract security shall be in accordance with DOD 5000.02, DOD 5220.22-M, and DOD 5220.22-R. In addition to the changes otherwise authorized by the changes clause of this TO, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes.
5.5.2 The Department of the Navy Local Population ID Card/Base Access Pass Registration, Secretary of the Navy (SECNAV) 5512/1 is required for installation access and to conduct NCIC background checks for all visitors without a CAC, or Navy Commercial Access Control System (NCACS), (RAPIDGate)/Defense Biometric Identification System (DBIDS) credentials. This form requires two forms of identification to be presented prior to the NCIC background checks being conducted and a temporary pass being issued for installation access. Base Security is required by CNIC and the Department of Justice to view and note two forms of identification. The Contractor shall inform visitors or new hires of this policy prior to entrance at the gate.
6.0 Navy Trademark Protection
The contractor shall not assert any claim, in any jurisdiction, based on trademark or other name or design-based causes of action that are based on rights the contractor believes it has in the term(s) CH-53E, “Super Stallion”, MH-53E “Sea Dragon” and CH-53K “King Stallion” (the “Designation(s)”), against the Government or others authorized by the Government to use the Designation(s) (including the word(s), name, symbol, or design) acting within the scope of such authorization (i.e. claims for trademark infringement, dilution, trade dress infringement, unfair competition, false advertising, palming off, passing off, or counterfeiting). Such authorization shall be implied by the award of a Government contract to any party for the manufacture, production, distribution, use, modification, maintenance, sustainment, or packaging of the products and services identified under this contract, and the scope of such implied authorization is defined as the use of the Designation(s) in performance under such contract by the prime contractor and its subcontractors and suppliers at any tier. In all other cases, the scope of the authorization will be defined by the Government in writing.
The contractor shall notify the contracting officer at least 30 days before asserting rights in, or filing an application to register, any one of the Designation(s) in any jurisdiction within the United States. Any such notification shall be in writing and shall identify the Designation(s) (including the word(s), name, symbol, or design), provide a statement as to its intended use(s) in commerce, and list the particular classes of goods or services in which registration will be sought.
7.0 Special Safety Requirements
7.1 Safety
The Contractor shall be responsible for the safety and accountability of all its employees and must provide all safety and protective equipment. The Contractor shall comply with the safety program, airport safety requirements, Environmental Protective Agency (EPA) instructions and Public Law 91-596. The Contractor shall implement and maintain a Safety Program, to include mishap, accident, incident reporting and investigation procedures, that complies with Occupational Safety and Health Administration (OSHA), Commander Naval Air Forces Instruction (COMNAVAIRFORINST) 4790.2 series NAMP, Defense Contract Management Agency (DCMA) INST 8210.1C Contractor’s Flight and Ground Operations and NAVAIRINST 3710.1G Contractor’s Flight and Ground Operations and other safety directives listed in Enclosure “A” Reference Documents.
7.2 Emergency Procedures
Contractor personnel working at Government facilities shall follow Government employee’s instructions in regards to emergency response procedures, i.e. fire, tornado, active shooter, bomb threats. See Enclosure “A” Reference Documents. The Contractor shall provide guidance and establish procedures for responding to emergencies for their personnel. The Contractor shall account for its employees following an emergency. Contractor personnel shall participate with Government personnel in all emergency response procedures and drills.
7.3 Personal Protective Equipment
The Contractor shall ensure applicable maintenance personnel have Personal Protective Equipment (PPE) common to the specialty of work they are expected to perform (e.g. safety shoes and work boots).
7.4 Mishap Reporting
7.4.1 Personnel Mishaps: The Contractor shall immediately notify the Government Flight Representative (GFR)/ Ground Government Flight Representative (GGFR), TPOC and the Marines Aviation Logistics Squadron (MALS) Aircraft Maintenance Officer (AMO) of any on-the-job death, medical examination or treatment as a result of an on-site incident. The Government may conduct its own investigation of mishaps involving Contractor employees.
7.4.2 Safety Reports: All safety reports relating to aircraft and general incidents/accidents shall be reported through the GFR/GGFR to the TPOC and MALS AMO, utilizing standard reporting procedures outlined in OPNAVINST 3750.6S. The Government will be responsible for security of any requested records and/or removed aircraft components and/or piece parts of aircraft. The Squadron Maintenance Material Control Officer (MMCO)/AMO will coordinate with the Contractor for required information necessary to convene an Aircraft Mishap Board (AMB), produce Hazard Reports (HAZREP), Foreign Object Damage (FOD) reports or any other report required per the Naval Aviation Maintenance Discrepancy Reporting Program (NAMDRP). In conducting a mishap investigation, the Government has unlimited access to the Contractor's records, and personnel pertinent to the mishap. All mishaps which involve damage to Government property shall be investigated by the Government unless otherwise directed by the Government.
7.4.3 Property Damage Reporting: The Contractor shall report damage to Government property not covered by OPNAVINST 3750.6S in accordance with OPNAVINST 5102.1D/MCO P5102.1B. The contractor and subcontractors shall assist the Government in support of aircraft or related systems mishap investigations in accordance with OPNAVINST 3750.6S and OPNAVINST 5100.23G.
