About this file

This Justification and Approval (J&A) document supports a non-competitive procurement for Lutron Quantum Lighting Controls for Building 606 MSEC Renovation at West Point, NY. The U.S. Army Corps of Engineers (USACE), New York District will solicit a firm-fixed-price construction contract requiring offerors to include Lutron Quantum Lighting Controls, which will integrate lighting and shading control systems. The justification is based on the system's unique features, compatibility with existing infrastructure, and plans to standardize lighting controls across academic buildings.

The procurement will be conducted as a Best Value Trade Off (BVTO) using 10 U.S.C. § 2304(c)(1) authority for a sole source acquisition. A Notice of Intent (NOI) was published on 13 December 2024 with no responses received. The Lutron system was selected for its flexibility, scalability, and ability to provide centralized control from a single user interface. The project is funded through Sustainment, Renovation & Modernization (SRM) and is part of the Academic Building Upgrade Program (ABUP), with the adjacent CEAC building also being outfitted with the same lighting control system.

JUSTIFICATION AND APPROVAL

REVIEW

FOR OTHER THAN FULL AND OPEN COMPETITION

FOR:

Lutron Quantum Lighting Controls Building 606 - MSEC Renovation

West Point, NY

21 January 2025 rev 1 – 14 February 2025

1. CONTRACTING ACTIVITY:

The U.S. Army Corps of Engineers (USACE), New York District (NAN), Contracting (CT), 26 Federal Plaza, New York, NY 10278.

2. DESCRIPTION OF ACTION:

This Justification and Approval (J&A) supports the use of brand name components for the Building 606 - MSEC renovation project. The government will not purchase the components directly, but rather will require that offerors include Lutron Quantum Lighting Controls as part of proposals submitted in response to the solicitation to comply with the Contract specifications that will lead to the award of a new firm-fixed-price (FFP) construction contract.

The United States Army Corp of Engineers (USACE) is responsible for the acquisition and administration of the construction contract. Funding for this acquisition will be Sustainment, Renovation & Modernization (SRM). The project will be solicited and awarded as a Best Value Trade Off (BVTO) procurement in accordance with FAR Part 14.

3. DESCRIPTION OF SUPPLIES/SERVICES:

The need for Lutron Quantum Lighting Controls is determined by the functionality and maintenance requirements at the United States Military Academy, Department of the Army and Department of Defense. The building 606 MSEC renovation will be outfitted with the Lutron Quantum Lighting controls system used to integrate lighting and other control systems (i.e. shading) within the building.

4. AUTHORITY CITED:

10 U.S.C. § 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(c), Application for Brand Name Descriptions. In accordance with FAR 6.302-1(c), the Contracting Officer will specify that all offerors be required to procure an item particular to one supplier (brand-name item).

5. REASON FOR AUTHORITY CITED:

A. Background:

To maintain the highest level of flexibility, operability and maintainability on projects that are included in the Academic Building Upgrade Program (ABUP) Lutron was chosen as the manufacturer of choice given the features within the Lutron Quantum series of controls. Additionally Lutron Controls will be the required lighting control system in all academic buildings given the scalability and functionality.

B. Justification:

Lutron lighting controls will be used to provide flexibility and capability with control systems on other projects and in addition will result in familiarity and ease of maintenance. The Lutron Quantum lighting control systems offer all of the features required by the building users such as capability to seamlessly integrate time clock control, room-based control, and the addressable control required for classrooms and conference rooms under a single platform. This system is being installed in the first major academic building project (CEAC) which is adjacent to this facility. The system is capable of being controlled remotely from one user interface. Given another system, west point would be required to maintain and operate multiple systems supporting all academic building requiring additional training, equipment, etc.

C. Alternatives:

There are no viable alternatives that meet the features provided by the Lutron Quantum controls that would be able to be integrated into Lutron system given the proprietary nature of these systems. In addition, the CEAC building adjacent to this project is being outfitted with the same controls as well as future projects and training for operations and maintenance will be carry over from building to building.

D. Impact:

If this J&A is not approved and a different item is provided, rather than the subject item, this would fail to meet the requirements as stated above.

6. EFFORTS TO OBTAIN COMPETITION:

The brand name product has been published as required by FAR 5.201, a Notice of Intent (NOI) to determine sources for this system was synopsized on 13 December 2024. No responses were received for the Notice of Intent. The brand name justification and approval will be posted with the solicitation. As stated in paragraph 5 above, the Lutron Quantum Lighting Control system is the only brand available to ensure compatibility with the United States Military Academy Command Existing Information Technology infrastructure and are compliant with DoD information technology policies and directives.

7. ACTIONS TO INCREASE COMPETITION:

This J&A supports a discrete requirement that will end when the project is complete. Therefore, there are no planned actions to increase competition for the requirement covered by this J&A.

8. MARKET RESEARCH:

A Notice of Intent (NOI) to determine sources for this system was synopsized on 13 December 2024. The NOI was published for the required 15 days in SAM.gov. There were no responses to the NOI. Additional research was not done besides the NOI.
