52.222-56 Certification Regarding Trafficking in Persons Compliance Plan (Oct 2025)
L.01 - Pre-Proposal Conference
(a) All potential Offerors are invited to attend a Pre-Proposal site visit to be held at the USIBWC San Diego Field Office, 2995 Clearwater Way, San Diego, CA 92154 at 09:00 AM PST (10:00 AM MST) on Fridayday, November 7, 2025. The group will walk through the plant site. Virtual site visits (video/live streaming) are not permitted. Visitors shall not take photographs or record videos of any infrastructure that is used for monitoring the border, such as security cameras or radio towers belonging to U.S. Customs and Border Protection or USIBWC.

(b) Names of individuals who plan to attend must be furnished on or before 09:00 AM PST (10:00 AM MST), on November 3rd, 2025, by email to the CO, Philip Johnson at Philip.Johnson@ibwc.gov.
(c) Due to time, distance, and cost associated with the Pre-Proposal site visit, prospective Offerors who fail to attend on the scheduled date will not be given a further opportunity to reschedule another site visit.
(d) The purpose of the site visit is to provide prospective Offerors, subcontractors and suppliers an opportunity to observe and evaluate project conditions; to present questions arising during preparation of offers; to discuss procedures and other matters anticipated to arise during operation and maintenance of the SBIWTP.
(e) Offerors are urged to submit questions in writing, before or after the site visit, to the SharePoint site, referencing the solicitation number 191BW26R0001. Answers will be prepared through the Request for Information log on sam.gov’s Solicitation Announcement.
Questions shall be submitted to arrive at the aforementioned not later than 10:00 AM PST (11:00 AM MST) November 26th, 2025.
(f) While every effort will be made to provide meaningful responses or clarifications to all inquiries, no answer shall be binding by the Government and subsequently answered by means of a formal amendment to this solicitation.
L.02 - Questions
Written questions may be submitted to the CO, via the SharePoint site to the Q&A folder with a email notice sent to Philip.Johnson@ibwc.gov, with courtesy copy to seone.jones@ibwc.gov and suzette.smith@ibwc.gov, until 10:00 AM PST (11:00 AM MST) on November 26th, 2025. Questions received after the cut-off deadline will NOT be responded to, unless deemed significant by the Contracting Officer or the question conveys a material mistake and/or error in the Solicitation.

L.04 - Proposal Composition Requirements and Instructions
L.04.A. In order to assess the Offeror's Qualifications, the Offeror shall submit a proposal in accordance with the instructions contained in this provision. The Offeror is advised to carefully read the entire Solicitation.
To safeguard sensitive procurement data, the U.S. Section of the International Boundary and Water Commission (USIBWC) utilizes its secure FEDRAMP Microsoft SharePoint environment for the submission of bids and proposals. SharePoint is a cloud-based platform that integrates with Microsoft 365 and leverages enterprise-level security protocols, including data encryption at rest and in transit, multi-factor authentication (MFA), and role-based access controls. When folders are shared with external users for bid submission, access is limited to specific, authenticated email addresses. External users must verify their identity through a secure email link and authentication code prior to gaining access, ensuring that only authorized parties can view or upload content.
Permissions can be tailored (view or edit), and access can be revoked or expire automatically. All activities on the platform are logged and monitored, providing traceability and accountability. These measures collectively ensure that procurement documents are handled with confidentiality, integrity, and compliance with federal IT security standards.
L.04.B (a). Due to the schedule and security requirements associated with this solicitation, all proposals must be submitted exclusively via the U.S. IBWC's secure Microsoft SharePoint portal. This replaces prior instructions for submitting hard copy or physical media (DVD/CD) proposals.

L.04.B (c). Technical Proposal (Volume I). Refer to the requirements contained in the Technical Proposal Instructions provision of this Solicitation.
L.04.B (d). Pricing and Business Proposal (Volume II). Refer to the requirements contained in the Pricing Proposal Instruction provision of this Solicitation.
L.04.C (a) Instructions concerning the content and organization of the proposal.
Each Offeror shall propose to satisfy the requirement as set forth in this solicitation. The proposals will be evaluated on the basis of content (what is written in the documents). No extraneous information will be used for evaluation purposes with the exception of past performance.
The USIBWC may utilize written and/or verbal communications with past performance references and/or information available in the Past Performance Information Retrieval System (PPIRS).
L.04.C (b) Each Offeror is responsible for including sufficient details to permit a complete and accurate evaluation of the proposal from both a technical and management standpoint. Each Offeror shall identify technical uncertainties and assumptions within the requirement set forth in this solicitation and provide specific proposals for their resolution. The Government will not make assumptions concerning the Offeror's intent, capabilities, facilities and experiences. Clear identification is the sole responsibility of each Offeror. The Offeror shall be prepared to provide all services as described in their proposal. In the case of a conflict between the Offeror's proposal and the PWS, the PWS takes precedence.
L.04.C (c) Proposals shall be as brief as possible but sufficiently detailed to completely and adequately describe what is proposed.
L.04.C (d) Offerors shall comply with all requirements of the proposal submission instructions. Deviations shall be fully explained;
however, inclusion of cost/price information with the technical/management volume of the proposal is not considered an acceptable deviation.

Each Offeror is cautioned that "parroting" of the requirements with a statement of intent to perform does not reveal the Offeror's understanding of the problem or his capability to solve it. The inclusion of filler material from previous proposals or commercial applications shall be avoided unless there is a direct application to the objective of this solicitation.
L.04.C (e) Unless the Offeror inserts a longer period of time on the Standard Form (SF) 33, page 1, block 12, proposals will remain valid for a period of 120 calendar days from the date specified for receipt of proposals in Block 9.
1) TECHNICAL PROPOSAL, VOLUME I: The technical volume shall contain sufficient quantitative and qualitative details (without reference to cost or price) to permit a complete and accurate evaluation of the proposal from strictly a technical viewpoint. Offerors are cautioned to keep in mind the criteria set forth in Section M against which the proposals will be evaluated. Proposals shall be organized into separate sections responding to each merit factor in the order listed below. The Technical Volume shall contain:
a. Factor 1: Past performance of wastewater treatment plant operations and maintenance service contract (s).
b. Factor 2: Specialized experience and technical competence in secondary activated sludge with aeration tanks wastewater treatment plant operations and maintenance.
c. Factor 3: Staffing and key personnel experience and qualifications/certifications for the operation and maintenance of the SBIWTP.
d. Factor 4: Safety and other regulatory requirements.
e. Factor 5: Financial stability and professional reputation of the firm.
f. Factor 6: Phase-In Plan.
g. Factor 7: Supervisory Control and Data Acquisition (SCADA) experience. The contractor shall submit a self-attestation that their Corporate System has implemented or will implement all the agency designated security controls selected from NIST 800-171.
The Technical Volume shall contain an addendum consisting of the proposed Phase-In Plan to provide for (1) a complete and orderly phase-in, (2) a timetable for orderly assumptions of each responsibility, as required, (3) performance of all functions, (4) adequate resources, and (5) plans covering key functional areas during the phase-in period. It is estimated that a transition period of sixty (60) days will be sufficient for the successful Offeror to be up to full strength and fully operational.
(1) The Phase-In Plan is subject to review and approval by the Contracting Officer.
(2) The Phase-In Plan will be evaluated. An Acceptable or higher rated Phase-In Plan is mandatory and will be evaluated during the initial evaluation. A Marginal or Unacceptable Phase-In Plan is one which demonstrates a lack of commitment on the part of the Offeror to meet the requirements in which would require substantial clarification, revision, and/or rewrite to stand a reasonable chance of being made Acceptable.
2) PRICE AND BUSINESS PROPOSAL, VOLUME II: Volume II shall include the SF 33, Amendments, Section K, Section L, Section 508 Compliance, Pricing, and Small Business Subcontracting Plan (if applicable).
a. SF 33: Offerors shall provide a completed SF 33 as part of its Price and Business Proposal.
b. Amendments: Offerors shall provide acknowledgement of ALL amendments issued against the Solicitation as part of its Price and Business Proposal.
c. Section K: Offerors shall provide a completed Section K for ALL provisions as a part of its Price and Business Proposal. NOTE:
In accordance with the provision at 52.204-8, if the provision at 52.204-7 is included in the Solicitation, paragraph (d) of 52.204-8 applies.
Offerors shall check the appropriate box for the provisions at 52.209-7 as part of their submission.
d. Section L: Offerors shall provide a completed L.03 as a part of its Price and Business Proposal.
e. Section 508 Compliance: The Offeror shall provide information as to how the solution meets all applicable standards and functional performance criteria of Section 508 identified in the attached accessibility determination template. The vendor shall complete the attached accessibility determination template or provide similar information in alternative format (Attachment 15). This deliverable is required as part of the response to this solicitation and will be evaluated prior to award.
f. Pricing: The Contract Line Item Number (CLIN) structure is provided in Section B, Supplies or Services and Price/Costs. Offerors shall utilize this structure for its firm-fixed price. Offerors shall propose the necessary labor, material, equipment, and services to meet the full performance objectives outlined in the PWS. Pricing shall be provided for the base year and ALL option years. Pricing assumptions associated with each task in the PWS shall be included. If there are any pricing assumptions that relate to the entire scope of the PWS then that information shall be provided as well.
(1) Offeror shall include a detailed breakdown of their pricing for the Firm Fixed Price, Time and Materials, and Cost Reimbursable.
The breakdown shall include but not limited to:
Labor, Fringe Benefits, Travel, Vehicle Expense, Office Supplies and Equipment Expenses, Delivery/Postage, Professional Fees, Dues and Subscriptions, Business Insurance, Telephone Expense, Subcontractors, Laboratory/Safety Supplies, Chemical Costs, Scrap/ Sludge, Repair & Maintenance, Utilities, Taxes, Depreciation/Amortization, Other Expenses, Indirect Rates (Overhead and General & Administrative), Profit, and Escalation Rate for Option Years.
(2) Labor costs must be realistic, reasonable, and consistent with industry, market average and trends, and the work to be performed as outlined in the Offeror's proposal
(3) A separate breakdown of labor by category, contract period as set forth in the solicitation, and basis for labor estimates shall be furnished. The breakdown and estimates shall include the proposed technical level-of-effort, management, administrative, quality assurance and any other personnel proposed to perform under the resultant contract.
(4) A separate breakdown of direct material indicating quantity and unit price shall be furnished.
(5) Rationale followed in the development of overhead rates shall be furnished.

(6) Phase-in costs shall be shown separately. Offerors shall propose phase-in costs in correlation to their phase-in plan.
(7) A narrative shall be provided for each cost category provided in the detailed breakdown. The narrative shall describe how the contractor arrived at that cost. For Chemical Costs this shall be broken down into the various chemicals required by the PWS.
(8) At this time the USIBWC does not require the submission of certified cost or pricing data. However, the USIBWC reserve the right to request certified cost or pricing data if determined necessary by the CO. If certified cost or pricing data is required, then the following clauses will be incorporated into the Solicitation and resulting Contract:

g. Small Business Subcontracting Plan: If an Offeror is classified as "Other than Small" the Offeror shall submit a Small Business Subcontracting Plan consistent with Contract Clause 52.219-9 Alt II. Consistent with Alt II the plan shall be negotiated within thirty
(30) calendar days of the CO's notice of intent to negotiate the Subcontracting Plan. Failure to submit and negotiate a Subcontracting Plan shall make the Offeror ineligible for award of a contract. NOTE: The Subcontracting Plan will be made available to the Small Business Administration (SBA) and will be subject to their review and approval.
