About this file

This is an evaluation clause template for commercial products and commercial services procurements under FAR 52.212-2 (Revision 02, effective 04/18/2025).

The Government will award a purchase order to the responsible quoter whose quotation conforming to the solicitation provides the best value, considering price and other factors. Quotations will be evaluated using a comparative evaluation process where responses are compared to one another rather than against a fixed standard. All responses must meet minimum solicitation requirements, though quotations may exceed these requirements. The Government reserves the right to select a non-lowest-price quotation that provides additional benefits and is not obligated to accept alternate quotations. Evaluation will be based on three factors: (1) Technical capability—assessed on the extent to which the quotation meets and/or exceeds Government requirements as outlined in the solicitation and instructions to quoters; (2) Past Performance—evaluated through the quoter's record of past performance using the contracting officer's knowledge and experience, customer surveys, past performance questionnaire replies, Contractor Performance Assessment Reporting System (CPARS) data, or other reasonable bases to assess relative risks of successful performance; and (3) Price—calculated by summing all line item prices. This is a template clause and does not address specific products, services, response deadlines, or award dates.
