About this file

This is a federal contracting provision template regarding representations for covered telecommunications and video surveillance services or equipment, effective November 2021, based on Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019.

The provision establishes two primary prohibitions: Section 889(a)(1)(A) prohibits executive agencies from procuring or obtaining any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component or critical technology, effective August 13, 2019. Section 889(a)(1)(B) extends this prohibition to contractors and subcontractors, prohibiting agencies from contracting with entities that use such covered telecommunications equipment or services regardless of whether the use is in performance of federal contract work, effective August 13, 2020. The prohibitions contain carve-outs for services connecting to third-party facilities (backhaul, roaming, interconnection arrangements) and telecommunications equipment that cannot route or redirect user data traffic. Offerors must conduct a reasonable inquiry and represent whether they will provide covered telecommunications equipment or services and whether they use such equipment or services. For affirmative responses, offerors must disclose detailed information including the producing entity name, unique entity identifier, CAGE code, equipment brand and model numbers, and an explanation of proposed use with factors relevant to permissibility under the prohibitions. Offerors must also review the System for Award Management (SAM) exclusions list for entities barred from federal awards for covered telecommunications equipment or services. The provision does not require completion if the offeror has already made corresponding representations in other FAR provisions (52.204-26 or 52.212-3).
