The document requires bidders to certify that they are not "Iran Linked Businesses" as defined by the Act and commit to maintaining this status throughout contract performance if awarded. The affidavit must be executed by the bidder's owner or authorized officer and notarized before a notary public, with spaces provided for the contractor's signature, title, date, and notary acknowledgment including county location and commission expiration date.
The document establishes significant penalties for false certification, including civil liability of up to $250,000 or twice the contract amount, whichever is greater, plus investigation costs and reasonable attorney fees. Bidders who submit false certifications are also rendered ineligible to bid on future invitations to bid for three years from the determination date. This affidavit serves as a mandatory compliance requirement as part of Mason Consolidated Schools' request for proposal process for the roofing replacement project.
